Thursday July 6th I made a transaction of $1000 over the phone for the security deposit of 416 N. Hilton St. With WAZ Investments LLC. I called one of the real estate agents at 1:32 PM and told him that a deposit was made but he then told me that my roommate and I, would need to come to the office by Monday to sign the lease and do a walk through of the property before they could start renovations. As well as pay the remaining amount of the security deposit ($200) plus first month rent ($1200) for a total of $2400. If we didn’t come by the office, the property would then be placed back onto the market and the deposit would be returned back. Monday July 10th, neither my roommate or I were available to visit the office or property. The following day July 11th, I had decided that I did not want to rent the property, five days after the transaction. At 8:32AM I had called the Glen Ave office and spoke to a gentleman who, when asked for his name, would answer, “Yes.” I told him that I had made a deposit for the 416 N. Hilton St. property that past Thursday and was no longer interested in the property. The gentleman asked me multiple times as to why I changed my mind over the property and I had answered him each time that I did want the property. He he took my name and number and told me that he will contact me within an hour. I did not receive a call later the day. On July 20th, I contacted the Glen Ave. office and requested for a refund once again. I am told that I would have to call back the following day to speak with the female secretary that handles the finances. The following day, Friday July 21st I call the Glen Ave. office to speak with the secertary.

She informs me that she does not handle the refunds and that only senior management would be able to help and call back Monday morning. That following Monday, July 24th I contact the office once again and speak with one of the senior managers. I tell him the situation and how I have requested for a refund on July 11th for I have not signed a lease for the property in question, seen it before renovations started and would not like to further pursue this property. He only asks me why I would not want the place and does not directly answer my question for why I can not have a refund. He informs me that he’ll call me back within the hour and takes my name and number. I call the office at 10:43am to speak with that senior manager. He’s not in the office. So I call the office again at 3:00pm and receive no answer. At 5:28pm I speak with a other the secretary from earlier who informs me that no one is in the office and I should tomorrow.

Tuesday July 25th 9:59 am, I call the office and receive no answer. I visit the office and the secretary informs me that, that senior manageris in New York but she can call the Sidehill location for the other senior manager. After she makes the call, she informs me that the manager asked her to type a letter requesting a refund and that tomorrow morning I should call to find out which office to meet with him Thursday July 27th, I contacted the Sidehill office and spoke with another represenativr who informs me that the senior manager is not in the office. I go to the office and speak with the representative and sceretary. They inform me that holding deposits are non refundable and call the senior manager to verify my request for a refund. After waiting for 10 minutes or so, I am told to call the following day to meet with him if he’s available in the office. That Friday July 28th, I call the office and I am asked to come in.

I tell that senior manager what has transpired over the past weeks. Me contacting them over receiving a full refund of the deposit because I did not want the place nor did I ever sign the lease or do a walk through of the place before it was renovated and that no one has given me a direct answer or contacted me in a timely manner in order to resolve this situation. I'm nformed that the place is completely renovated but he can not give me a full refund. The most he said he could do was give half of the deposit because the property was held for nineteen days and he’s trying to make up for the lost time of not showing this property, which was still in the process of being renovated during the time I first requested a refund till then, everyone who works in the offices, and how long it would take to find another potential tenant. He offers half of the initial amount, $1000. Unable to come to an agreement I tell him that I can not accept just partial of the money and that we would have to go to the courts to settle this.

This manager then says that I would most likely either receive nothing or half of the amount because that’s how it works in the courts because it's a business and that I should take the check and we part ways. Knowing that in the long run, I would regret not receiving the full amount that I originally put up front, I decided that I couldn't let them get away with keeping any of the money that was deposited. Just for the reasons that a lease was not signed; a proper walk through of the place was not done by me nor my roommate, and I had been reassured by the agent that had shown me the place, that if we did neither of these things that was required in the time frame he gave us that I would receive my money back and the property placed back on the market. The property has stayed listed on the Trulia rental app as an available rental townhouse during this time. Via a notification through my email, the 416 N. Hilton Street property was officially taken off of the market August 1st, 2017.
