To begin with this company is totally unprofessional. I have had my auto financed with Wells Fargo since 2006. They are always calling, harassing, breaking every privacy law there is. Always saying my acct. is past due either for lack of payment or unreasonable late fees. Well the payments are always drafted out to Wells Fargo, they say they have not received anything. speak with numerous different people, have to fax in my bank statements for them to go through my personel business to show them that my bank did pay them their payment, then I never get a call back. have to begin the entire process again with completely different people and never get credit for my payments or my money back. So finally I go to my local Wachovia and pay 6000.00 on my acct. so that it is paid ahead for a year and what happens? I made that payment on Aug. 13th. 2010. On the 20th. they drafted an even 444.00.

I called and spoke with Ms. Harris, who is totally rude, will not let you speak, told me that She did collections and did not have to talk to me for me to call customer service. I asked for her supervisor was told that his name was Tim Rogers. Have been given 3 different extension numbers for him, have left messages, no call back. Well then again on aug. 31st. they draft another 442.70. Well once again on the phone with probably 20 different people. Have faxed in bank statements twice, left messages, one person did call my husband back and said that they were going to send back the 6000.00 that we pd on this acct. What??? This is plain and very simple. My acct is pd. until Aug. 2011. All I want is those 2 drafts back and them to stay out of my bank acct. This company is full of nothing but crooks and liars. They take your money, shuffle you from one person to another, as far as I'm concerned they are robbing me blind and have a bunch of idiots working for them. This is the 2nd. time payments have come out of my acct. but they say they have not received anything and at this point in time I am out of 886.70 that was sent from my acct. to them but not put on my acct. Are there any class action suits against them at this time?

  I'll  bet you were thinking if you paid them $6000, you wouldn't have to make another payment for a year, right?    That's a very basic misunderstanding of how loans work.   What really happened is that they took your $6K, deducted the normal monthly payment, then applied the remainder to the principle.   That's what they do when you give them a higher amount than you owe.    Works that way at any bank.

  The bank is not legally allowed to take future monthly payments in a lump sum.  If they did that, they would be collecting interest that hadn't been earned yet.  A big no-no for banks.

  The only thing you did by making that lump sum payment was to shorten the term of your loan.  You're still obligated to make the monthly payments until it is payed off.

By that I mean close  the account, stop ALL auto-drafts (And auto-deposits, if any) and take your business to another bank (I recommend a credit union) then they CANNOT rob your account.

Then at your bank DO NOT set up auto-drafts, but instead send them checks each payment, that forces them to create a paper-trail for each payment, and also YOU have a record of payments they cannot "Vanish".

It's a Lot of work, and they'll try hard to deny you closing their account, BUT DESPITE THEIR BULLSH1T THEY CANNOT LEGALY STOP YOU

Hint,  drain the account FIRST, or they'll demand you leave some in for them to steal, leave a buck (Or so) and don't look back when you go, Expect them to "Forget" and pretend the auto drafts were NOT stopped, the play that game (According to the hundreds of reports here)

The way to stop that is to call them (Ask for the head Cashier at your branch when you do) a few days BEFORE the next car payment is due, REMIND them No auto-draft, and MAKE them send a statement to your home, and RECORD the call.

They're extremely inept, or deceitful whenever it will profit them and hurt YOU, but never err in YOUR favor.

Forget "Class action" all that means is Lawyers get rich, and You don't
