"I go to my local Wachovia and pay 6000.00 on my acct. so that it is paid ahead for a year and what happens? I made that payment on Aug. 13th. 2010. On the 20th. they drafted an even 444.00. "
I'll bet you were thinking if you paid them $6000, you wouldn't have to make another payment for a year, right? That's a very basic misunderstanding of how loans work. What really happened is that they took your $6K, deducted the normal monthly payment, then applied the remainder to the principle. That's what they do when you give them a higher amount than you owe. Works that way at any bank.
The bank is not legally allowed to take future monthly payments in a lump sum. If they did that, they would be collecting interest that hadn't been earned yet. A big no-no for banks.
The only thing you did by making that lump sum payment was to shorten the term of your loan. You're still obligated to make the monthly payments until it is payed off.

By that I mean close the account, stop ALL auto-drafts (And auto-deposits, if any) and take your business to another bank (I recommend a credit union) then they CANNOT rob your account.
Then at your bank DO NOT set up auto-drafts, but instead send them checks each payment, that forces them to create a paper-trail for each payment, and also YOU have a record of payments they cannot "Vanish".
It's a Lot of work, and they'll try hard to deny you closing their account, BUT DESPITE THEIR BULLSH1T THEY CANNOT LEGALY STOP YOU
Hint, drain the account FIRST, or they'll demand you leave some in for them to steal, leave a buck (Or so) and don't look back when you go, Expect them to "Forget" and pretend the auto drafts were NOT stopped, the play that game (According to the hundreds of reports here)
The way to stop that is to call them (Ask for the head Cashier at your branch when you do) a few days BEFORE the next car payment is due, REMIND them No auto-draft, and MAKE them send a statement to your home, and RECORD the call.
They're extremely inept, or deceitful whenever it will profit them and hurt YOU, but never err in YOUR favor.
Forget "Class action" all that means is Lawyers get rich, and You don't
