In July 2009 I purchased a vehicle from a Dealership here in  Salinas, Ca financed with Westlake Financial Service. The dealership part of purchasing my vehicle was great.

From the first  week of having the vehicle, I recieved 5 repeated phone calls  from Whistle  reference department to verify my vehicle. I understand that in todays auto industry that this is standard protocol to protect the consumer who purchased the vehicle and lien holder who will be financing the vehicle from possible dealership fraud.( verifying that what a lien holder is financing is actually what is true on the vehicle contract as  what the consumer purchased) i.e color, model, leather , sunroof, manual, standard, door, door.

I finally brought it to the attention of the Westlake Rep @ telephone number 1-866-619-2518 placed from San Jose, Ca that someone from Westlake had already called me. Her reply was "oh I was not aware of that".  (the first sign of Westlake Financial Service Business Incompetence) I did not take heed

Within the first month of making my first vehicle payment, I recieved a phone call from the collection department stating that they had not recieved my first car payment. I told the gentleman Nick that called from  1-323-900-3328 that I did send my payment. Nick replied  stop lying, I here the same sob story all the time, and if I could not make payments I shouldn't of purchased a vehicle. Mind you never mailed a payment book.

I  did infact send my first payment to Westlake Financial Service that arrived to them via express mail, with verified confirmation number, no signature required to  there payment address at P.O. Box 76809 Los Angeles, Ca 90076. Which was on my vehicle contract. I only sent it express mail because I recieved a letter in the mail from Westlake stating my due date had changed from what was originally on my contract.  Note: not a request made by me.The new due date fell on a Sunday, I recieved there notice Friday of that same week two days before. I wanted it there in time with no mishaps.

Dealing with Westlake as a paying consumer I'm stressed over their business practice.

March 2011 last year was the very first time in my contract history with Westlake Financial I have ever been late on my vehicle payment! One time late, 60 exact days. My personal identifying information and my account has never been accurate with Westlake Financial from day one of me becoming a customer.

During My One Time, 60 days late

I received repeated phone calls of threats and harassment at my place of employment, home, and cell. Not forgetting to mention that all my family members that I used as references were threatened and harassed by Westlake Financial with repeated recieved phone calls on their cell, home and place of employment as well. My mother was called all the way in Virginia. Westlake identifying themselves as an investigator. I requested to the Westlake Collections Department to please stop calling me at my place of employment.  I also requested that they not call my family members at there place of employment. Note. (I only gave cell and residential numbers as reference).

They continued, even getting very nasty and rude with my boss, and also with the owner of the company I work for. Joel  from 1-866-584-1284 ext.7268 who called my place of employment several times replied that he and  any other employee will continue to call until they had there payment. Joel stated he could call me anywhere he wanted so as long as my account was past due.  MY and my boss's request were void.I made pay arrangements from the beginning of the very first phone call I recieved from Westlake Financial Service and  as to when I would have both payments in there office, but they continued to call with repeated threats and harassment.

Pulling a credit report from all 3 of the major bureau it currently shows that my vehicle was REPOSESSED, and Financial Counceling Program. Westlake for-real?...What F..... or Who's Financial Counceling Program? Seriously! My vehicle was never repossed, I was never approached physically or verbally by any repossession tow company or any representative thereof!

I currently have my vehicle in my possession, currently financed with westlake,  I currently make on time payments and always have besides the one time late in 60 days.

When  contacting Westlake Financial Service accounts and collections department as to Why and What is being reported by Westlake to my credit profiles. For "Quality Assurance"  I warned Westlake that my conversations with their company needed to be recorded and to know that I was going to sue them for Violating my rights  as a consumer. I sited the FCRA, and FDCPA.

I was told by Harvy @ 1-323-900-3957 no extention. "That this is how it is reported when your account is ever placed with the collections department", Harvey also stated that there is no grace period. When I asked Harvey about the Financial Counceling Program he could not give me and answer. He acted as though he was unaware and never even  heard of it before. I stated to Harvy that my vehicle was never repossed, he placed me on hold and came back to replie that is the policy." you should of made your payments on time".

I've also requested in writing, verbal with many Westlake Financial Service employees a credit rating. I have also done this via the automated telephone system. To this day never recieved anything.

The names of numerous employees, company lines with extension numbers goes on for ever in my log. Requesting only to speak with Managers and or  Supervisors due to the seriousness  of my complaint, concern, and wanting a solution to resolve the inaccuracy with my Westlake Financial Service account and its illegal practices, threats, and harassment along with reporting of illegal inaccurate information to my credit profile.

My Solution Westlake Financial Service. 

To Put A Stop To Westlake Financial  Business Incompetence 

Take Legal Action  and Get Paid.

I comprehend and understand  the acts very well. Explained and reviewed with me.  Westlake Financial Service Violated.  It doesn't matter  to me  if you work for  Westlake Financial Service or not.

In response to the numerous reports I've read on Ripoff. A FABULOUS WEBSITE!

As a consumer currently dealing with the illegal practices of Westlake Financial Service myself. We must have a Accurate Verifiable Paper trail. Names, numbers with  extensions, dates times, proof such as phone bills from both cell and land line (at work most of  companies have caller ID), "we" have caller Id. Also continue to call make every effort possible to get your concern and complaint resolved. Save there messages!!!!! Always request to speak with a Manager or Supervisor.

Always take and return there calls, asking for the individual that left you the message.

Taking note  and documenting each time we've talked to anyone from Westlake, wether we called them or they have  called us, and the nature of the conversation. Don't avoid them answer they will continue to violate. Record them if you have to so when you do obtain counsel he knows your not B.S~n (only to show your proof of the violations)

Always request to speak with a Manager in accounts or collections. If they don"t identify themselves ask who they are, what department , there name and extension number. Document ,Document!( call from a cell or land line where you have proof you called or they have called you).

If they claim they are a investigator or repo company because your are behind in your payments. Save the message go through your phone especially if they called your cell regardless if its private... blocked. restricted,  most cell phones today  will give you the real number. ie.  (envelope information)

Example: I returned a call to  a repossession company who  really was Westlake! from a message that was left on my cell. The message gave the time the call came in, I hit missed call in my cell phone to match the time of the message left,  it dialed to Westlake, a female answered Repossession. In  Her message left  she stated she was from a Repo Company. Not Westlake Financial Service. I still have her message. (note the time I hit for the missed call that matched the time the message was left, had no number it showed private, and  another time with prefix 831) In re to my previous post on my one time late in 60 days.

Verify your current account information in their data base. If its not accurate provide Westlake Financial Service with your  updated information. ( This way they can not claim they mailed us something, and we us as consumers not getting it and it went back to them returned mail)

Pull a 3 and one annual credit report on yourself. It is FREE.  @

you need to know what they are reporting.

Call accounts and collections  at Westlake only speaking with a manager in regards to any inaccuracy on your 3 reports. Make a request that for the inaccuracy be corrected and updated by Westlake. They put it there they can take it out and or correct it!

Call the automated system after hours is had good info. Request a credit rating, and a copy of your dealer contract. Even if you already have one. Get another one. It may be different!

Get copies of anything and everything you submitted to the dealer in  order to get financed. Note: I have someone that worked in finance for dealership that was terminated that financed all their vehicles with Westlake Financial Service. He was the GM and came clean with me.

Dealerships have to pay a Substantial  Service Fee  to Westlake Financial Service to become "Westlake Dealers"  in order for their customers to be  financed  with Westlake.

Also many of us can accurately state that the dealership we purchased our vehicles from stated to us "I'm positive your financed / funded" this is why. The fee the dealership pays to Westlake whether it is a major dealership or moms and pops  guarantee financing to the dealership customers as long as the "reference checks go through"

Another inside scoop from two patients of mine that own dealerships. When asked about Westlake Financial Service. They also stated the very same thing the terminated employee stated. They however don't do business with Westlake  due to Westlakes Financial Services illegal practices.  They also stated that the dealerships that do business with Westlake, do so on the basis to sell cars because they are hard up for business.

Westlake also has a Representatives that  solicit Dealerships to become  a Westlake Dealers. Those reps do the verifying that is supplied by us to the dealership before the packet goes to Westlake for funding. Our nearest office for Salinas is San Jose, Ca. I have her name but wont put her on blast just yet.

Regardless of your state educate yourselves about the  FDCPA, and FCRA. Go on the web and type it in. Inform Westlake Financial Service they are Violating your rights as a consumer and their customer. Inform Westlake   Financial Service that you know your rights as a consumer and your are seeking council.

Seek a credit lawyer some are based on
(contingency. No fee up front) They don't muck around and are serious. (They get paid when you win) Trust me you'll win. Have your paperwork in order for them with accuracy and true fact.

Get advocates such as Ed Magedson he is for us. To help us, and inform us. His reputation: he don't play.

Fair Debt Collection only applies to third party debt collection agencies - States do vary though from what I have read.  I suggest you read the statutes. And NO I do not work for these people.
