IF this is true, your company could be in big trouble. California state statutes REQUIRE that ALL PARTIES to a telephone conversation CONSENT to the call being recorded. IF your company really records all calls, then they are required to inform the calling party of this beforehand, and permit the calling party to OPT-OUT of the telephone call without their participation being recorded, not after the fact. Further California statutes allow for CRIMINAL and CIVIL remedies against those individuals or companies that violate these statutes. Your company had better check with a competent attorney. ""The only comfort I have, is that the company I work for, will follow though will legal consequences."" Then you have no comfort at all. IF your report is true and Westlake did NOT know that the call was being recorded, then the only "legal consequences" are going to be against the company you work for. Further, California provides for ADDITIONAL criminal charges and civil remedies when these illegal recordings are made public. Also, these illegal recordings will be INADMISSIBLE in any judicial proceedings you or your company initiate against Westlake Financial. Any "legal consequences" are most likely to be your company successfully sued and/or fined for violating California statutes. One question for you. Does management of the company you work for know that you are posting on the internet that your company ILLEGALLY records incoming telephone calls?
