It appears to me that MBNA refers all of their accounts in this region to Wolpoff & Abramson (WA). Last year (March 1, 2004) I was issued a Arbitration Award in my favor with (Solomom Arbitration Group)against MBNA.

On May 14, 2004 I recieved the following notice from (IDBS)Indivualized Bankcard Services (MBNA):

**This acknowledges reciept of your complaint requesting that IDBS agree to arbitrate claims involving your above referenced account before the Solomon Arbitration Group agency.

The card holder agreement that governs your account requires you and IDBS to arbitrate claims resulting from use of your credit card before the National Abitration Forum.

IDBS rejects any attempt on your part to amend the credit card agreement to enable you to use an arbitration forum of your choosing.

If you wish to file an arbitration claim, you may do so by contacting the NAF at the following address:

On 12/18/03 Wolpoff and Abramson sent:

**RE: MBNA/Visa

Balance due $11151.51

Please be advised that this law firm represents the above creditor. Our client alleges that you owe the above-reference balance, and I have reviewed information reguarding this matter provided by our client.

After you have read the important notice on the reverse side of this letter, if appropriate, please call our office to resolve this matter. If you dispute this debt, or any portion thereof, I urge you to take advantage of your rights to dispute this debt as described in the important notice on the reverse side of this letter.**

On 11/21/04 I faxed NAF a letter stating: "I have attached copies of my award and other information. I feel that I am being harrassed by MBNA. Please view the attached award and documents and let me know if I need to do anything else to bring this to a close"

On 11/23/04 NAF responded with:

Dear Respondent:

The National Arbitration Forum is in reciept of the document you filed in the above referenced case.

However, because these documents did not include proof of service that they were served on all Parities involved in this action as required by Rule 6 of the Forum Code of Procedure, they are deemed deficient as a Response as described in Rule 13 of the Code.

Should you desire to have your documents filed with Forum as a formal Reponse pursuant to Rule 13, you must file proof of service to the Forum no later than Fifteen(15) days from the date of this letter.

After that time, the case will be appointed to an Arbitrator, a Hearing will be held, and an Award or Order issued.

Can they issure an award after you have recieved a award in the same case? Can WA claim an arbitration award when I have no contract with them?
