In Dec 2003, the water pump went out on my wifes truck while she was out of town. She had it towed to the nearest dealer for repairs. It was after normal business hours and Wynn's could not be reached.

The dealer assured us that we would be reimbursed by Wynn's by filing a claim because a water pump is a covered repair.

My wife called in the claim the next day but it was denied because we did not have prior authorization.

Our contract states that if a breakdown occurs outside of normal hours and I determine that I have a covered breakdown, that I may authorize the repair. Then if the administrator agrees, I will be paid.

Wynn's has still not agreed to repay me even though the water pump is listed in the very same contract as a covered part.

I contacted Wynn's in Dec '03 and asked to speak to a supervisor but Eric in contract services denied my request. When I asked for Erics last name he refused to give it.

The Attorney Generals office has contacted Wynn's on my behalf, and the are still refusing to pay.

I haven't given up and I'll let you know what happens next.

1. What did that warranty cost you? 2. What was the cost of the water pump replacement & what did Wynns pay? 3. What other repairs did you need, that Wynns also paid for? 4. If you add up the benefits you received, would they justify your purchase of that warranty? When one reads the OP's original post: "Our contract states that if a breakdown occurs outside of normal hours and I determine that I have a covered breakdown, that I may authorize the repair. Then if the administrator agrees, I will be paid." Note that last (weasel word) part again: "Then if the administrator agrees, I will be paid." Well, apparently he/she DIDN't agree, so you didn't get paid. Right? But you DID get LUCKY! Right? Remember Carter's RIF: Reading Is Fundamental? ? ? ?

I was cleaning out my bookmarks and found the link to Ripoff Reports and it reminded me that I had an open complaint about Wynn's. Here's an update: It took almost a year but I did get most of my money back from Wynn's. It isn't easy and it takes some dedication but it can be done. When all else failed, I went to the dealer where I bought my truck and warranty and expressed my complaint to them. They informed me that they had trouble with Wynn's in the past and were thinking of discontinuing the sale of Wynn's warranties. She called a Wynn's representative and told him that very thing and suddenly Wynn's agreed to pay up. The important thing is not to give up, and contact your local Attorney General's office to file a consumer complaint. If the AG gets enough complaints and sees a pattern they will take action. By the way Wynn's paid most of, but not pay the full bill. They covered the water pump but not things associated with it such as the thermostat and new belt. Even though these things are typically replaced at the same time and are often required to not void the new pump warranty, Wynn's would not pay. But these costs were relatively small and I felt like I beat them at thier game so I let it go. Good luck in your efforts.

I would like to say that I have had similar problems but on a much smaller scale. I hate a bully and someone that abuses their authority more than anything at all. When I have problems with a company I immediately tape all telephone conversations ( NOTE: In Arkansas it is LEGAL to tape a telephone conversation with out consent as long as one of the parties know it is being taped. NOTE I SAID ONE not BOTH. I then conduct everything in writing VIA certified mail. After this I make it a point to end all correspondence with something similar you would see from this type of company. "Your failure to respond to this letter in three business days can only be considered your aceptance and agreement to the terms I have stated in this letter" Or something similar. Another trick I have noticed when someone wont give out their name always call after hours and when you get the usual recording begin experimenting with differnt phone button options... For example with Phoenix American. If you hit the # key at the menu you will be prompted to enter the persons last name using your phone keys. 276657 as in R. Steven Brooks (CEO CHAIRMAN ro Phoenix American)If you dont know who the ceo is go to their website and look at corporate information or something similar. If not call that state and get their corporation filing information (CEO, treasurer, vice president etc... Etc) The first name you hear will be tht of Illeen Brooks. Hit the the number 3 button it will que to the next person which is the CEO. At this point hit the # key to confirm this is who you want to email and you will go directly into his voicemail. Tell him exactly how you feel... I mean exactly. NOTE: In really big corporations you will quite often get tht persons assitants voicemail taking messages for them. I usually just hit the 0 key and it will default to the forwarding phone which is usuall the person who has the assitant. (CEO) After that I usuall call back and do this again except this time I will continue hitting the number 3 button or what ever button it is to go through their entire directory Making note of each and every persons name in the company. Make special note of anyone who is very grand and boistourous when thy speak their name for their voicemail. These are usually the people that everyone dislikes in the office because they are usually the know it all's and smart butts... (Quite often you will find the name and extension of the rude person who refuses to give their name.) You would be amazed how many places this will work at. I once spoke to the CEO of HP because I had not received my rebate. She was very concerned..... Not about my problem but more as to how I got her phone number......grin

The attorney General in California will not act on behalf of an individual,only in the interest of the public. They will investigate only if they find a pattern of fraud, deception, or misrepresentation. Because Wynn's is located in California, everybody can forward a copy of thier complaint to: E. Brooks, Public Inquiry Unit, PO Box 944255, Sacramento CA, 94244-2550. If we join forces, maybe we can all win against this rip off company.
