First, I would like to thank you for taking the time to hear my Complaint against a Florida registered company that is scamming hundreds if not millions, not to mention, falsely using unauthorized endorsements by Oprah, Dr. Oz, USA Today, ABC, CNN, Fox News and NBC. 
Like millions of Americans, I have been unemployed for one year this month.  I am trying to survive off $375.00 per week unemployment with two children.   Being a 17 year Legal Assistant, I try to be well informed of emails I receive.  I received an email for work @ home from www.googleprofithouse.com.  Upon researching, I discovered that the short blurb available would benefit me greatly since it was typing transcripts.  In order to learn more, one must download software for $1.99.  So I did.  Upon review of the download, it had nothing to do with what was stated in the original email.  I called with thirty minutes and told the Rep. that I was canceling and further voiced my opinion of what they are doing to people such as myself.
 
Around November 11, 2009, I had utility checks bound from my bank.  On November 13, 2009, my on-line bank statement showed that XM Brands in Cancun withdrew $79.97. I immediately called and was told that there was no documentation that I canceled.  I placed daily calls from November 13 - 27,  finally the Rep. said he would break the rules and authorize the credit (please see confirmation below).  He told me that it would process in 10 to 15 days which I told him was unacceptable since they took money from me without my permission; I further explained my situation and told him that I needed that money credited back asap.  As of today, December 14th, I still do not have my money.  I call every morning just to hear the same speech, yes, a speech.  While on the phone you can hear the other Reps. telling others that very same thing I am being told.  This is what I get "The credit was processed on 11/27 (and sometime 12/1), please keep checking with your bank.  When I request to speak with their legal department and/or Corporate office, I am told that they do not accept calls.
 
With my research nature, the following is what I have found:
 
XM Brands is registered with the State of Florida (P08000090812), although the website that is charging accounts is www.acaixm.com, please note, this site never came up when researching the work at home opportunity;
 
Depending on what research site, XM Brands has many addresses listed as their Corporate office.
 
On www.bbb.org; Kenneth Jacobi is listed as President.  He is non-existing.  BBB's complaints are numerous and they have an F rateing for the following reason:

We strongly question the companys reliability for reasons such as that they have failed to respond to complaints, their advertising is grossly misleading, they are not in compliance with the laws null licensing or registration requirements, their complaints contain especially serious allegations, or the companys industry is known for its fraudulent business practices.
 
As of today, I still do not have a refund credit and was told the same thing, it was processed.  HAS ANYONE BEEN SUCCESSFUL IN RECEIVING THEIR MONEY?

Still No Refund

As of today, February 13, 2010, I have yet to receive the promised refund from XM Brands.  I did however, received a letter from the Florida Attorney General informing me that the Company is under investigation.  That is all the news I have.

As of today, I still have not received my refund as promised by XM Brands on 11/27/09. I took all my documentation to my back and within 24 hours, the bank reversed the charges.  Unfortunately, my Bank is now owed these funds and they are not expecting to receive them.  I have never heard from any of Government agencies I filed Complaints with.

On Monday, December 14, 2009, I spoke with a supervisor, Davis Web. Mr. Web insured me, no, promised me that we would personally address my refund issue with the billing department and I would have my refund no later than Friday, December 18, 2009. As of today, December 18, 2009, there is no refund. I called Mr. Web and he stated that the billing department told him that the credit was issued. My response was "I would not waste my time and aggravation if the money was there". He responded with the same answer as Monday, he would personally go to the billing department and "TRY" to get this refund. He further told me that he has filed several reports with the billing supervisor in regards to this matter on behalf of other consumers. I advised him, once again, that I am unemployed and am having to use my cell phone to call them daily and it is costing me a lot of money since I am on a limited plan for job searches only.

I am listed on several sites trying to obtain help.  I just received the following email from someone with 1st hand knowledge:

"you said you asked to speak to Kenneth Jacobi. That is the owners alias his real name is Issa Asad. they are located in Hollywood , Florida. he has different companies rinning out of his office there. He has one called Telecom World in which he sells phone cards that is a scam as well. he also has one called Odyssey Promotions which he sells scratch off lotto tickets. which ,is a scam as well. he has been scamming people for over 15 years and has made millions doing so. I hope this helps. I know this information because my girlfriend use to work there for 1 week until she realized that it was a scam and quit."  This confirms my fear, I will never see this money again.
