your right there is a statute of limitations in ill of 2 years, however this is 2 years not following the accident rather two years from when xsport dismissed my claim. Thank you for your concern

I do intend on taking legal action
- The only legal action you may be able to take at this point is against your lawyer. Because just based on what you wrote here it does not sound like they were actually doing anything for you except for probably taking your money.
There is something known as the Statute of Limitations. This is the period of time you are able to take "legal action". If this happened two years ago you are probably past(or getting very close) to the Statute of Limitations. If you are past the Statute of Limitations any "legal action" you take will go nowhere, even if they are liable.
Also, your lawyer should be going after the person that injured you..because they are the one's who did it..not the gym. Not to mention that when you signed up your agreement probably had several sections that said you would not hold the gym liable for any injuries, even if they were caused by other members.
