Something very similar happened with me. A salesman came to my & my fiance's home and asked if we wanted to change our phone company & it sounded like a good deal. Well, my fiance' agreed & started to fill everything out (but with my info b/c the prev. service was in my name). He called me as he was filling it out while i was at work, & i told him we'd have to talk about it later b/c i was busy. so he scratched out my info with the pen and NEVER signed (which even if he did, he would have had to sign my name which would make the whole thing invalid)and told the salesman he would have to talk to me first. The salesman told him he still needed to take the top copy of the paper & explain to his boss what happened b/c their info papers were accounted for. needless to say, somehow, they still switched my service to their company. we still had the same phone #, so we had no idea until we got a bill. of course i called & they said they have a copy with a signature & MOST of my identification info. they didn't have my id # b/c my fiance' hadn't gotten that far on the report. well, i faxed the company our copy that showed it was never signed & also that it was scratched out. they said they would investigate. we recieved yet another bill this time larger because they tacked on a late fee. well, we kept getting bills & about 4 months after the fact, we called and they said that they found that everything was valid. which all i can do is guess that the salesman looked beyond the scratches and signed my name to say he got a sale. i am still in the process of fighting all of this. it's ridiculous. they say that now i owe them anyway b/c i used their phone service for 4 months, but i didn't agree to thier service!!! it's ridiculous that i actually have proof that i didn't agree to this and yet they still don't care. the most ridiculous thing is that my phone service before was cheaper than their deal. the only difference was that they offered voice mail. why would agree to change to a more expensive service just for voicemail, when i have an answering machine??? my recommendation to you is that you contact a lawyer. that is what we are in the process of doing, b/c they just won't work with us at all & they act like we are lying to them.
