I purchased a 2010 BMW 3 series 328xi on 07/29/2010 from BMW of Orland Park, now known as Zeigler Auto Group.  The purchase included a manufacturer's factory warrant for four years or 50,000 miles.  I still own the car and the mileage is less than 30,000 as of today.

The air conditioner blew warm when the controls were set to cool.  I took the car to BMW of Orland Park service department on 05/18/2013.  The service department rep Carlie Welch said the refrigerant was low; no leaks were found and they evacuated and recharged the AC system.  

This happend again on 05/23/2014 and I took my car to Zeigler service dept and the rep Joseph Giuliano said the refrigerant was low; no leaks were found and they evacuated and recharged the AC system and claimed to put dye in the AC system. They charged me $209.19 and I paid it.

It happened again on 03/31/2015 and I took my car to the Zeigler service dept.and asked the rep Craig Lantz, to replace or repair the AC system. When my car was returned to me 3 days later, Craig Lantz said he couldn't find anything wrong with the AC system.  He said they evacuted the system, recharged the refriderant and claimed to put dye in the AC system.  

I requested the factory warranty be executed by repairing or replacing the aire conditioning system.  My request and the warranty was nevered honored. They charged me $267.19 and I paid it. When my car was returned to me on 04/02/2015, it smelled like cigarette smoke, the odometer had extra 30 miles on it and 3/4 tank of gas was used.

Upon inspection by Imperial Automotive, it is documented that there is no evidence of dye on any components under the hood.  I had to pay $35.86 for the inspection.

 

On 04/03/2015, I filed a formal complaint with BMW customer relations and the BMW service department that provided the service.  I attached all supporting documents verifying my claim.  On 04/03/2015, BMW manager, Mark Boomsma called me and apologized to me and promised that the next time the air conditioner blows warm air, he would do exactly the same thing that the BMW service department the he manages, did the previous 3 times;  do a diagnosis, evacuate and recharge the system.  

On 04/04/2015, I filed a complaint with the office of Lisa Madigan, Illinois Attorney General, Consumer Fraud Bureau. I was contacted by Delores Rodman from the Illinois Attorney General office and she advised me to allow Zeigler BMW to have an independent BMW factory rep inspect my car because this is as far as she can take my complaint.  I agreed and i never heard from Delores Rodman, Zeigler Auto Group nor the independent BMW factory rep on this issue.

The inspection you paid $38.67 for. I would very much like to read that. I think that inspection is virtually impossible for that charge. To check for The leak trace dye youhave to cause a leak in the AC system, Easy to do, Light it with the Ultra Violet Light, prove or disprove its there. Then top up the refridgerant. Though if you get luck it is possible to release so little that the system will not need re-filling, but that would need to be proved. So I am guessing that $100.00 minumum if no Supplies used.

The Dye should have been installed at the first failure, not the third, so yes your BMW is a failure!

Now I am going to relutantly defend them, a 1 year period between failures means a leak so tiny that it is virtually impossible to find. The dye is a tracer inside the system and not visible outside, and most dyes used for this are not visible to the naked eye.

So as they did not fix it under the original warranty and claimed they did means they should cover it untill repaired properly.

But I doubt you will win on a should with an Auto Maker.
