On behalf of Zirpak Products LLC, Mr. Mark Clyburn, VP of Sales accepted and signed a contractual agreement with Nexus Disposal LLC for the removal of trash at their location on 12600 Exchange, Stafford Texas 77477 effective December 2008.  Our staff should have immediately caught on that this entity practiced bad business habits because the downpayment of $146.27 to initiate service returned NSF.  Our business is family owned and operated so we have a tendancy to give customers the benefit of the doubt and lots of second chances.  The second red-flag was when Mark informed us in March of 2009 (only 3 months later) that his business name had changed, however everything remained the same on the contract-- names, phone numbers, addresses.  In November 2009 it began to get very dificult to collect, we had to call Michelle in accounts payable on a weekly basis in order to get payment. 

We were forced to inturrupt service on several occassions due to lack of payment and unanswered calls.  Then Michelle informed us that Mr. Clyburn was upset because they had not been serviced and threatened to cancel service.  We left numurous messages with Jodie to speak with Mr. Clyburn but he never responded.  We always attempted to negotiate partial payments and continued to service them until June 2010 so as to not loose the customer even when payment had not been received since February 2010.  When our field salesman Obie Grindstaff went by the location he witnessed that there was a competitor's dumspter already on-site and recommeded that we pick-up our dumpster and file a small claims suit for breach of contract.  Neither Mark, Michelle nor Jodie ever gave our office a verbal or written notice of cancellation and now we cannot collect on services already rendered totaling in the amount of $509.41.  We sent a certified letter in June 2010 that returned "unclaimed" and thus had to send this account to a professional collections agency.
