My name is Joan McCloskey.  I'm a Disable Senior.  I ordered furniture on 12-5-23 with a promise to be Delivered 12-26-23. However, it wasn't delivered until 1-2-24.  I bought the Furniture from Ashley Homestore: Westland, MI.     I was advised to allow Dufresne Spencer Group (DSG) dba Ashley Homestores 48 hours to respond, before I file any formal consumer complaints. A week later, DSG failed to respond. This is typical behavior from DSG, based on thousands of other complaints filed against them.    They delivered my order Broken and Damaged.  I did not pay good money for New, Unbroken Furniture, so they can delivery Damaged and Broken Furniture and force me to repair their furniture rejects. I am not an isolated story. This is their behavior, not just with the 150+ stores in the franchise, but is a Common Scam Ashley Furniture operates worldwide.   I spent big money for the Zero Wall Recliner and here are the noticeable issues:   1) The entire chair is crooked / lopsided.   2) The seat cushion is caved in at the tailbone area.   3) The left arm of the chair makes a popping noise when leaned on.    Upon returning to the store to seek help on the matter, I was approached by a sales clerk who  showed me a phone number to the "Solution Dept" and said ONLY they can deal with my concerns after sale. I promptly notified the number & was told that they basically don't care if it was delivered broken, they have the right to repair it and I don't have a choice. I didn't have the knowledge at the time to legally understand my rights. After much research, I learned Ashley Furniture Breached our Contract. I paid for New, Undamaged Furniture and they did not deliver as promised. I am legally entitled to be made whole. Instead they're trying to force me to repair their junk they sent me.    Regardless of my legal rights and my protest, they sent me some parts as a way to propagate their Bait and Switch Scam...that they run through out the USA and Ashley Furniture internationally.    Due to Ashley Furniture's Fraudulent Practices & Breach of Contract, our Contract is NULL and VOID. Violating Michigan’s Antitrust Laws and failure of the Federal Lemon Law (Magnusom-Moss Warranty Act), they Failed Me!  It’s not just me, it’s thousands of other Ashley Furniture Consumers (that’s just in the USA). Most complaints are regarding Broken Furniture, Not Honoring Warranties, Breach of Contracts and using Fraudulent/Deceptive Business Practices to Cheat Consumers.      I, in good faith, paid for my furniture. DSG took my money and I was left to trust they will uphold their end of Our Contract. And yet, they continue to threaten to keep my money, after their Failure of our Sales Contract.   DSG knew they never intended to deliver what was promised & sold and that the Quality of the Furniture is Subpar and Damaged. Their Fraudulent Business Tactics must be working most of the time to still be in business, but I will not be victimized. According to past employees, they even have secret areas in certain warehouses where they repair furniture to re-sell as new furniture, to unsuspecting consumers.    They refused to respond, so I am now filing Formal Consumer Complaint
