Last year, an elderly woman mrs. knill married to John zempleni a second marriage  for over 35 years retained Sally Benson as her attorney who is guiding her to divorce her husband and Mrs. Zempleni does not have the funds so she says and sally benson filed the petition and Mr. Zempleni was not even knowing that Mrs. Zempleni was going to divorce him and Ms. Sally Benson is assuring Mrs. Zempleni that she will win and it will be over this year.

Mrs. Sally Benson has been guiding mrs. Zempleni and her daughter Mary ann dax in how to manuver through process leadiong them to believe this is in the best interest of this couple to be divorced. Mrs. Zempleni has her children influencing her directly.  Mr. Zempleni was not even aware that he was even served the summons and to discover the petition for dissolution was discovered by a family member. So it appeared to be that he would miss the 20 days to respond to the petition.

Ms. Benson is leading Mrs Zempleni to believe that being divorced is in her best interest and Mrs. Zempleni does not really understand what is going on. This couple do not have enough assets or income to keep them pay expensive attorney fees, and Mr. Zempleni had to get an attorney with assitance so that Mrs. Zempleni would not take everything from him as she attempted to do so in 2012.

At that time she was guided by Andrew Curtis esq, and an fiancial advisor Ron Thompson to take all the assets and put Mr. Zempleni in a long term nursing facilities so that she would not have to spend the money on Mr. Zempleni.  Its totaly unethical for this couple to divorce as their assets will be depleted by attorney expenses which they will need for their medical expenses and costs now as they are elderly.

Who are you and what is your relationship to this individuals to file this report? Does this individual even know about this? First your inability to spell correctly makes this report hard to read. Second this is all hearsay. AND if you want to slander someone then I suggest that the Attorney you are speaking of have the right to tell their side of the story.

FYI this is really none of your business unless these individuals are incapacited and you have POA over their business/medical decisions. AND that will have to be decided by two medical professionals.

That Could Be The Case

You keep indicating that the divorce could financially be in the best interest of the wife, which most definitely would be the case if the intent is that the husband must go into LT nursing care, which is what this sounds like.  The care for Mr. alone would be very expensive and deplete virtually all of the assets of both Mr. & Mrs.  However, if they were to divorce and the assets were to be largely assigned to Mrs., then the intent is to claim Mr. as indigent.

This would then force either the State or the Feds to cover the cost.  The divorce is really intended to transfer the marital assets over to Mrs.  I don't know if I would blame the attorney though.  The legal fees needed to do this correctly are immaterial to what it would cost for LT nursing care.  It would bankrupt both.

It sounds more like the family members of Mrs. are the people you should be complaining about.  It sounds like they're trying to transfer all of the marital assets over to Mrs.  If they are successful, then they will be effectively writing off any beneficiaries from the estate of Mr. from ever collecting anything from the estate and keeping the remaining marital assets for the care of Mrs. and her beneficiaries.

It seems obvious to me from the narrative that you are part of the family of Mr.  I would secure an attorney looking out for his interests, and yours, if that is the reason for this report.  If Mr. is in a state where he can no longer care for himself, then a LT care facility is probably the right place for him.  Sorry, but that's the way it generally works.  If that's the case, then making sure your interests are protected now becomes necessary.

Good luck...
