Following a parking lot accident, State Farm denied our claim because they had not updated their records to reflect the car we were driving (despite our notice to State Farm).  They blamed us for not catching their error. 

Rather than rectifying the error and covering the claim, they stated they would refund our insurance premiums (which does not make us whole; it denies us of the benefit of the contract we purchased).  Then, when they sent the refund check, the amount returned was substantially less than the premiums we paid over a 5-year period.  So, State Farm kept at least 40% of the premiums we paid, but refused to pay the claim we submitted.

We have been a State Farm customer for 20 years, insuring our house and two cars.  We never made a single claim.  This is our first claim ever, and the amount was not substantial (modest repair work to one car).   Their internal values say they "do the right thing" for customers -- they DO NOT live that motto.  This was a simple, cheap opportunity to live that value, and they chose the opposite.  

If State Farm would screw us on a small claim after 20-years as a customer, imagine what they would do if we (or anyone) had a large claim.  Do NOT trust State Farm to insure your family and your valuables.  In the event of a catastrophe, they will seize on any reason (even if it is their fault) to deny your claim.  

State Farm is NOT a Good Neighbor.  They will take your premiums for 20 years and then when catastrophe strikes, they will hide behind excuses, make you chase claims adjusters, engage in endless letter writing, and leave you holding the bag after your house burns down.  NEVER, NEVER INSURE YOUR LOVED ONES OR VALUABLES WITH STATE FARM

You are still incorrect.

And why must I correct their mistake?

- Because it is YOUR policy. We again are only getting one side of the story, we have no idea how you notified them. But regardless of how you notified them it is YOUR responsibility to make sure that the changes were correct. If you had notified them just a few weeks ago you would have a better claim, but after the amount of time you are claiming...5 years the responsibility becomes 100% on you.

The fact is that even if you have the same make and model, I figure your year would be different. So it doesn't take a detailed look to realize that the information on your evidence of coverage and renewal notices were different...unless YOU failed to even look at them once in the last 5 years which again puts this on you.

I am not going to go back and forth trying to figure out reasons why you received only a portion of the total premiums you claimed you paid, as we are only getting your story and the answer to this question would be explained by you actually talking to them and having them explain it to you. Perhaps you already did that and are just failing to post what they said.

The CRITICAL attribute of an insurance company is TRUST, and as their motto says "doing the right thing."

- And what is the right thing? They are required to provide coverage per the terms of the written policy. The policy does not state that they are required to cover a claim as long as the make and model match. As for your continual bringing up what if your house burns down, that has no relation here and it not what your complaint is about.

Of course if you still think they should pay the claim, then you need to contact your States Insurance comissioner and file a formal complaint. When you do please let us know what they said.

First, the new car and old car were both the same make and model, so unless you are paying close attention, easy to miss the mistake.  And why must I correct their mistake?  More importantly, a "Good Neighbor" would not quibble about whether I could have caught their mistake; They would work to correct their mistake and come to agreement on cost.  I volunteered to pay any additional premiums that might have been due for the prior years; they refused.  Good Neighbors don't do that.

Second, the refunded amount paid was 40% less than the premium I paid just for my car alone!  No one is suggesting they should repay for premiums paid for my other car and house.  Good Neighbors don't keep 40% of what you paid, but pay you 0% of the benefit you contracted for.

The CRITICAL attribute of an insurance company is TRUST, and as their motto says "doing the right thing."  State Farm did not do the right thing when it would have cost them little (the difference between what they should have re-paid me on my premiums and should have paid on my claim was about $300.  The total difference between what they actually paid and should have paid was about $1500).  What would they do if your house burnt down?  Or someone injured themselves badly on your property?    

STATE FARM IS NOT A GOOD NEIGHBOR; THEY DON'T DO THE RIGHT THING.  DON'T TRUST THEM!

Based on this report you went on for 5 years of having the wrong car insured, this puts it 100% on you.

You are sent a renewal notice every 6 or 12 months, this gives you 5-10 opportunities to see that the wrong car was being insured as in the notice you are sent not only details on the premium, but also an evidence of coverage card.   So YOU failed several times to review the documents.  

As for the premium returned, per your report you were insuring a house and 2 cars, so when they refunded your premium they are not going to refund ALL of your premiums because you still did have a house and 1 other car which you are not going to get your premium back on.

In just doing some quick math, if you were paying a very modest $500/year for that car, having 5 years of preimums returned and remembering you would need to pay the deductible.  This does not sound like it was a "modest" repair,
