On February 15, 2019 I paid $2,000.00 to Stephen Giametta & Associates to perform a collection service agianst JUanito Macutay & Associates.  Stephen Giametta  did not do their job and I have to keep asking for progress update through email. Thye responded only on May 1, 2019 that they started to review the case.  Again I requested update on Juen 23, 24, 28 and only received a respond on July 14, 2019. I again asked for update on September 17, 2019 and Nove 20, 2019 and only received a respond on November 29, 2019. On December 3, 2019 Mr. Giametta informed me that he will file a Default Judgrment against the defendant. I asked for after update on December, 2019, January 2020 and February 2020 but the lawyer never responded.

As explain in my report, the LAST communication from Mr. Giametta was December 3, 2019 email where he acknowleged to file a default judgement against Mr. Macutay the defendant in the case he was suppose to be handling. I sent several emails asking an update  after that towards the end of December 2019, January 2020, February 2020 and March 2020.  He never responded to these emails.  This gave me the assumption that he abandoned my case without any reolution and putting me hanging.  This was very unprofessional.

As the owner of the company in question it is my opinion that Mr. Viggayan's allegations are inaccurate.  Contrary to his claim, the complaint was provided to him for review in early March, not May.  In fact, on March 9, 2019 he provided me additional information via email, to which I responded the very same day and provided an amended complaint with the new information several days thereafter.  I also took the time to draft a detailed email to Mr. Viggayan in May to explain the process from both a legal and factual standpoint so that he was well informed. 

In July I drafted and provided Mr. Viggayan an affidavit to be used for entry of a default judgment since no response to the complaint was received.  I asked that he return such to my office along with documentation required to be used an exhibits.  Again, this was all provided in a very detailed email to Mr. Viggayan.  While preparing to enter the default judgment I received word from counsel for Defendants. 

The next several months, as Mr. Viggayan is well aware, were spent going back and forth with settlement discussions.  Mr. Viggayan was informed on these discussions througout the process.  After such discussions broke down we again turned to entry of the default judgment, which is indeed with the court for entry.
