In January 2021 I entered into a construction agreement with Timur Tursunbaev, owner of Timurland Construction to repair an irrigation feed hose that he installed which was damaged by another contractor. Timur agreed to repair the damage but needed several weeks before he could replace the hose. Timur then took steps to fulfill our agreement by contacting & coordinating the repair with the other contractor and we all agreed that the work would be performed a month later on February 5, 2021. On this date Timur said he didn’t have an irrigation installation license. But I checked with the Oregon State Construction Contractor Board which I formed me that he did have a Oregon Construction license (CCB 178997) which includes installation and repair of irrigation systems.

I asked him to call me and he basically told me he now decided not to do the work he agreed to do a month ago and coordinated with the other contractor. He then told me to find another contractor and not to call him again and hung up on me. This caused me to incur $257.00 in out of pocket costs to find another contractor at the last minute delaying this repair over a month.

Mr. Timur Tursunbaev is intentionally making false statements in his response which I have maintained documentation to prove this.

"We/our company did not get into any written agreement with Ken Olson,"

I entered into an agreement with Timur, documented via text messages, to replace a cut irrigation hose. There is no written agreement necessary as this is the same as hiring a plumber to repair a leaking faucet or and electrician to install a door bell. There is no written agreement required if verbally, or in this case agreed to do the work in a text message. Timur is trying to mislead by making his failure to perform the work that he agreed to was okay because he never gave me a written agreement. Such agreements are provided by the contractor, Timur, if he wanted one could have but in this case Timur didn't.

"spoke on the phone and promised to come look at the irrigation pipe that I installed 13 years ago" :

Timur is admitting that he agreed to come look at the irrigation pipe. This constitutes an acceptance of the proposed statement of work. But Timur never fulfilled his "promise" and never came to look at the pipe a month after he said that he would.

"Some other contractor recently accidently broke the pipe while performing services on a neighboring property,...At the same time ..., he wanted me to come fix/replace the pipe and the neighbor's contractor to pay for my service"

The 3rd Party Contractor damaged the hose and agreed to pay for the repair.

On January 13, 2021AM at 1:47 I sent a text to Timur: "Lee will be contacting you to hire you for the repair. He will discuss your rates and parts required as well as coordinate schedule. He will also have one of his guys help you....Let me know when you can schedule this after talking with Lee. Thanks!"

To which Timur replied:"Next month I dont know exactly the day yet."

On February 1, 2021 at 5:12pm I sent Timur a text " For your invoice (3rd Party Contractor's address and telephone numbers) I have emails where he is agreeing to pay your invoice so you can send your invoice to the above and this will close this out.

To which Timur replied: "OK Thank you."

Timur then coordinated with both the 3rd Part Contractor and me that he will do the repair on February 5, 2021 as Timur admits below.

"I did not coordinate any work with that contractor"

This is a false statement as Timur did coordinate with the 3rd Party Contractor to meet on February 5, 2021 to do the repair. You can now see how Timur intentionally lies in his statement.  He says he didnt coordinate any work with the contractor but then in the next sentence describes how he did call and coordinate work with the contractor!  Is this someone you would want to do business with?

"spoke with him (3rd party Contractor) on the phone and found that he's offended by Ken Olsen's decision to proceed with the repairs as he could easily fix it by himself, he also said that he does not guarantee to pay in full for my service."

This is another false statement as after talking with the 3rd Party Contractor to discuss payment Timur was satisfied as he did not cancel doing the repair, in fact he for a second time agreed to do the repair on February 5, 2021.

In fact Timur states that after this call: "I agreed to come help with the broken pipe later on when I have time for that, "

"One day before the scheduled appointment day/February 5, 2021 I injured/cut my foot and was in a hospital. I called and explained Ken that I injured myself and won't be able to come work on his pipe for few more weeks "

This is again another false statement. My call records show that Timur did not call me on February 4, 2021 as he claims. What actually happened was that on February 5, 2021 at 8:03 an I sent Timur a text asking what time will he be arriving? Timur responded with a text message, not a call, saying "Good Morning Looks like I cant come today and Couple more weeks Yesterday I had an accident on job site..."

I asked Timur to call me and during the call I asked how he was doing and there was no rush we can schedule this when he was well enough and returned to work. This is when Timur said he wasnt going to do what he agreed to do, dont call him again and hung up on me. There was no discussion about lawyers on the call as he cut me off and hung up on me.

"started to insist and require me to still come and perform the job that he won't pay for,"

This is a false statement, as he already discussed and agreed to invoice the 3rd Party Contractor so he knows, and agreed, that I was not the responsible party for payment and who was going to pay him. So why would he lie like this?  Bdecause he is not truatworthy and will not keep the agreements that he makes.  In a mjor building project like a house this can be a serious problem.

The morning of February 5, 2021 Timur failed to show up and also called the 3rd Party Contractor and cancelled with him as well.

"Now he complains that he had to pay someone else $257 to fix the problem, like it would be free if I fix it, that's ridiculous!"

Again Timur is attempting to be misleading as the 3rd Party Contractor did the damage and agreed to pay and coordinated with Timur to pay his invoice. I had to incur expenses after Timur failed to appear on the date we all agreed to which so these out of pocket expenses are not the responsibility of the 3rd party Contractor.

"I am a very responsible person and was actually planning to go help this person... , especially when we don't have a written contract and I'm now glad that I didn't get to perform any service for him. Timurland Construction, LLC"

Not only is Timur NOT responsible or honest as evidenced in the above, but the builder of our home no longer subcontracts to Timur because of similiar descripencies.

Written contracts are the responsibility of the contractor to provide which in this case Timur did not provide one. So why didnt he when he agreed to do the repair? Because repairs such as this are not big construction projects and do not require a written contract.  This is just an excuse.  Do you want your contractor making excuses on your project when he decides not to do the work he agreed  to and coordinated with a 3rd party contractor?

His warning should be a RED FLAG for anyone considering to do business with Timurland Construction: "We/our company have a right to refuse service to anyone at any time" Even after agreeing to perform the work as he admitted he did in his own statement.  Denial of service is done BEFORE agreeing to do the work and BEFORE coordinating the work wtih 3rd Party Contractors, NOT the morning of the date of the scheduled work!

Once accepted there is no written agreement necessary as this is the same as hiring a plumber to repair a leaking faucet or and electrician to install a door bell. There is no written agreement required if verbally, or in this case agreed to do the work in a text message documentation. Timur is trying to mislead you by making his failure to perform the work agreed to was okay because he never gave us a written agreement. Such agreements are provided by the contractor, which is Timur, if he wanted one he would have given one to the 3rd party Contractor he was aware agreed to pay him, but he didnt.  Just another excuse in an attempt to make his failure to fulfill his responsibility look like it was someone elses fault. 

If you were his client be ready for him to come up with some excuse why his failure is your fault and not his. Timur is incapable of accepting responsibility for his actions.

Some other contractor recently accidently broke the pipe while performing services on a neighboring property, he was willing to fix what he damaged, but Ken didn't want him to and insisted on me coming to fix it instead. At the same time Ken did not want to get into an agreement with me and pay for my services, he wanted me to come fix/replace the pipe and the neighbor's contractor to pay for my service there after, so it was a red flag for me!

I did not coordinate any work with that contractor, but spoke with him on the phone and found that he's offended by Ken Olsen's decision to proceed with the repairs as he could easily fix it by himself, he also said that he does not guarantee to pay in full for my service. Still, I agreed to come help with the broken pipe later on when I have time for that, just to be nice and helpful. One day before the scheduled appointment day/February 5, 2021 I injured/cut my foot and was in a hospital. I called and explained Ken that I injured myself and won't be able to come work on his pipe for few more weeks and suggested him to hire someone else to perform the work sooner, but Ken started to insist and require me to still come and perform the job that he won't pay for, then he started to frighten me with his lawyer, so I asked him not to call me anymore and hung up the phone.

Now he complains that he had to pay someone else $257 to fix the problem, like it would be free if I fix it, it means he did not plan to pay me for my work! I am a very responsible person and was actually planning to go help this person, but because of the injury I had to cancel the appointment. We/our company have a right to refuse service to anyone at any time, especially when we don't have a written contract/agreement. Timurland Construction, LLC
