I wanted to cancel my gym membership. I knew I had an auto renewal that I needed to get stoped. I called the gym (Any Time Fitness) and they told me I would have to contact ABC Finical Services and give them 30 days notice from the post mark on the envelope, before the auto renewal renews.

I sent a letter post marked on 3/10/08 (42 days before the renewal) to let them know that I wanted to cancel my account. I called on 4/10/08 and talked with Clorisa, and she assured me that yes my account was closed, and there would not be any more money taken out of my account.

Well what do you know, on 4/21/08 yes they took a payment out of my account. I call on 4/22/08, and was told the money would be but back in 2-3 business days. Well here it is 5 business days later, and still have not seen the money. I called ABC back, only to hear well I don't know who told you that, but it takes 8-10 business days to get your money back. I now have one over-draft fee which they said they would pay if it was their with drawal that made the over draft. Well, it wasn't, it was a damino effect. I had 1 check that I had written on 4/16, and 3 other auto payment scheduled to come out on 4/20/08. Well their came out first, and the other four came out the next day. So I propable will never see my money again.

When I ask Cindy on 4/28/08 why the took money out of my account in the first place, she replied "Well we didn't know about the cancelation until 4/20/08, and since the money is scheduled to come out on 4/21/08 there was no way they could have stoped the payment. I told her to stop lying to me, because i called on 4/10/08 and was assured by Clorisa that my account was closed, and they would not take any payment out. She then put me on hold, and came back in a few minutes and told me they where doing everything to assure I would get my money back. However she told be that unless their actions did not directly cause the over-draft they would not refund it. I went ahead and sent in the request for the refund of the over-draft fee, but don't think I will see anything.

However if the table where turned, and I didn't have any money in my account, the probably would have charged me all kinds of fees, along with my bank charging me all kinds of charges.

Please help me, I am but a lonly consumer who does not have the means to fight back.

I received the overdraft fee back, then a few day later I received the payment they took. I then received a letter in the mail stating that my account was closed, and no firther payments would be coming out of my account. For any one else dealing with this company GET IT IN WRITING!!!!!! Keep documented notes of every conversation, and hold them to it. Don't let them lie to you.

It has now been 10 business days, and the money is not returned to my account. After being told on 4/22/08 that it would be returned in 2-3 business days, and then I called on 4/28/08 and was told that really it is 8-10 business days. So I will have to call them again tomorrw. Still no word on the overdraft fee. I was told to mail the cancelation in through regular mail, and the 30 days started from the post mark. I have a copy of the envelope with the post mark on it. And on 3/10/08 They assured me my account was canceled and there would be not money taken out of my account.

When you sent the letter did you send it Certified Return Reciept Requested? If so, then you have record of them recieving notice? If not, then you probably will have to fight it tooth and nail. Always send anything like this Certified Return Reciept so that you have date and time of when they recieved it. That way you always have proof .If not, try calling their bluff........does their recording say it is going to be recorded? If so, let them know you have it recorded. Who knows, it has worked for me.
