Complaint Review: Adam J. Simons and Joy Serbanescu - Breckenridge Minnesota

He used to be a neighbor, cocky, manlipulates, keeps breaking into my home and steels food, prescripitons, laundry soap, the list goes on. He has stalked me, hangs out out with a creapy person 2 houses south of me, loves playing "Catch me if you can".    

Joy, much like myself, was physically abused by Adam.  She admitted in court that she lied numerous times, but stated that she did so because she was afraid of what Adam would do if she told the truth. Although, for obvious reasons, I wish she hadn't lied, I wasn't there to see what was going on and I do believe that she was afraid. I no longer believe she intentionally went along with defrauding anyone. 

That said, Adam is extremely manipulative and dangerous. There is also a warrant for his arrest, so if anyone knows where he is, please contact the Oak Park MI police department and turn him in.

I have more good news to update everyone on.  Unfortunately though, some of it started out as another headache for me...

On June 30, 2014, Adam S. again sent me a text threatening me, trying to get me to drop the charges against him.  It read, "You scuzzy b***h.  You put a warrant out on me now I can't get a job and live in my car.  YOU WILL REGRET THIS.".  So once again, I immediately called the police.  They took this threat a lot more seriously then the last one, because this time there is a felony arrest warrant for him and technically I'm a witness against him.  The detective advised that I go to the circuit court and file for an order of protection against Adam S., which I did.  The judge set it for a hearing, and Adam S. was served over the phone by the Oakland County, MI Sheriff's Dept. with a notice to appear.  Obviously, he didn't bother to show up.  Not that I expected him to, though.  On July 23, 2014, Judge Karen D. McDonald (Oakland County Family Court Division) granted my order of protection against Adam S.  He was again served over the phone by the Oakland County Sheriff's Dept. and they entered the order into LEIN on July 23, 2014, as well.  Someone who works in law enforcement told me that my order of protection is one of the strictest orders they have ever seen granted.  Now, Adam S. can't so much as call me to ask how my day is going or he would be in a lot of trouble. He can't have any third party contact (having someone else contact me for him); he is prohibited from entering onto the property at my place of employment, etc.  Additionally, the order of protection prohibits Adam S. from purchasing or being in possession of a firearm.  I know for a fact that Adam has an unregistered pistol.  I am waiting for the day he gets arrested because I already know he will still have that gun; which means he will be in violation of the protection order. 

The other thing I am excited to share with everyone is that I am taking Joy to court in Minnesota.  The court date is September 9, 2014 at 11:00am.  She has no idea whats coming for her.  I don't want to give too much information beforehand because I don't want her to have time to prepare any bulls*** excuses; but suffice it to say that with the evidence I have, there is no way she can deny having knowingly taken part in this.

First let me start out by saying that it has been exactly one year since I left Adam!!  I was doing my grocery shopping yesterday evening and I saw this magnet that I thought fit my experience with Adam perfectly, and also would look great on my refridgerator. (see attached picture.)  Yes, that is right.  I am convinced the reason Joy has stayed with Adam S. this long is for the free money, because the d**k was NEVER any good.  I'll explain why I now have to differentiate between two Adam's in a minute.

Okay, now for the updates:

A few weeks before my court date for the washer and dryer, I was informed by Joy's coworker that one of the local news stations had found out about this Rip Off Report article, and did a news story on it. Apparently, they filmed at the Ace Hardware she was working at.  I was infuriated when I watched the video.  This is the link: http://www.wday.com/content/breckenridge-couple-dealing-online-allegations-made-michigan-woman .  Immediately after seeing this, I called Kevin Wallevand and WDAY News (Fargo, North Dakota) to inform them that Adam S. and Joy had lied, and asked them to air my side of the story.  Additionally, two of Adam S.'s siblings, his ex-wife, Joy's aunt and step-dad, and one of my siblings all called up there as well.  Kevin Wallevand refuses to correct the FALSE news report he aired, and WDAY's general manager has been of no assistance, either.  It is UNETHICAL and UNPROFESSIONAL to air such a story without doing a single ounce of research beforehand.  Because had Kevin done his homework, he would have gotten in contact with me and I would have done a conference call to Detective Koch, the detective who has been putting a tremendous amount of effort into making sure my case gets prosecuted since day one, and he would have heard the real story.  I would have sent him all my PayPal transactions, so when he was interviewing Joy and she claimed she doesn't know who I am or why I am saying these things, he could have pulled out all the PayPal receipts and told her to explain them.  Oh yeah that's right, Kevin Wallevand got all this information, but not until after he aired the interview with Joy and had the entire town thinking that she and Adam S. are victims of some sort of stalker.  And then, when he did have all the information, including Detective Koch's direct phone number at the police station, he REFUSED to do so much as a follow-up story.  I would have been happy with him doing a phone interview with me so I could tell my side of the story.  Of course I would have been grinning ear-to-ear if he went back to Joy and told her to explain all the PayPal receipts, too....  But no.  I've been trying to contact Kevin Wallevand as recently as two weeks ago (will elaborate later on in this update), but he still refuses to do any sort of a follow up story, even knowing everything he does now.  SHAME ON HIM, and the entire WDAY news station.

About a week and half, maybe two weeks at most after winning the civil suit against Adam S. back in December, I learned that Adam had once again faked a suicide attempt.  He took a couple boxes worth of over-the-counter sleep medication, let it kick in enough that he was just about to lose consciousness, and then called 911.  Adam S.'s ex-wife told me that Adam did the EXACT same thing when she filed for divorce.  He knew the over-the-counter stuff lacked the narcotic ingredient that would cause him to fatally overdose, but he also knew that if he called 911 he would look like a sad person who needed to be rushed to the hospital.  And that is exactly what happened.  Adam S. had his stomach pumped in the ER, then spent another two weeks in the ICU and inpatient psychiatric units.  As someone who works in the medical field, I can tell you that a person without insurance who gets admitted to the hospital for an extended amount of time like that acquires a very large hospital bill - yet another debt owed by Adam S. that he will probably never pay. Let me just say that I truly wish he had succeeded in committing suicide, and I wish him better luck the next time... 

The sick part is that he did all of this to take the attention away from the fact that he had just been served with paperwork from the Wyoming, MI District Court ordering him to pay me the $1564.04 for MY washer and dryer that he stole. Additionally, Adam S. lost his job because he was not able to work for over two weeks after the fake suicide attempt.  According to Michigan law, I had to wait 21 days after the ruling in court to be able to show them that Adam S. had not made any attempts to pay the judgement amount, and go through with the wage garnishment paperwork.  Adam S. conveniently did his fake suicide attempt before I was legally able to file for a wage garnishment.  Then, I tried to get an income tax garnishment put through.  I was extremely disappointed when I learned that I would not be able to do this, because of the way income tax garnishments work.  You CAN NOT garnish federal income tax money, only state taxes.  Because the ruling was in Michigan, I would have had to go to North Dakota where he worked (and was having state taxes taken out of his check), even though he lived in Minnesota at the time, and basically file all over again to have a North Dakota judge adopt the Wyoming, MI judge's ruling so I could use North Dakota's income tax garnishment form to garnish his state taxes there.  And I would have gone through with it, too, had it not been for the fact that by the time I had found all this out and was provided with instructions on exactly what I had to do, it was already January.  By the time I would have had everything submitted to the court in North Dakota, received a court date, paid to travel there for court, received a ruling from the North Dakota judge and followed their wait period for garnishments, Adam S. would have already gotten his taxes back and the money would have been long gone.  It wasn't worth the hassle knowing I wouldn't get anything back when it was all said and done.  Even today, I have not seen a single penny of the $1564.04 that I was awarded.  Chances are I never will, either.  At the very least, I get the satisfaction of knowing that the judgement will show up on his credit report as a public record/court judgement and will not be removed from it unless it is paid and he can provide documentation to show it as paid off. 

Well, two days after hearing that Adam had faked a suicide attempt, Joy's coworker emailed me and told me that supposedly Joy broke up with Adam S. and moved in with a guy named Adam Hoffman.  Adam H. is a "recovering" heroin addict who had just regained custody of his daughter.  Yeah, she really knows how to pick 'em...  I put "recovering" in quotes because I know from Joy's aunt Sandee that when Joy was living with her, she would go around to all the neighbors asking if she could have (for free) or buy any left over pain killers they might have had.  I am not stupid.  You can't tell me that two opiate-addicts live in the same house and aren't both using, especially when Joy was still snorting Vicodin's when they were in Minnesota (per her coworker). 

I thought it was odd that Joy would leave Adam S. so suddenly like that.  I also thought it was odd that she went right to another Adam who also had a liking for opiate-drugs.  Turns out I was right.  Although Joy is currently living with Adam H. in Breckenridge, Minnesota and is acting like his girlfriend, she is still very much in contact with Adam S.!  She's a dirty little s**t.  And I have the screenshots from Adam S.'s Facebook page to prove it!!! (see attached screenshots).   If she supposedly hated Adam S. and was afraid of him, why would she remain 'friends' with him on Facebook, for one thing; and why would she 'like' a status of his where he says how much he loves and misses her, and how the fact that she is living and being intimate with Adam H. makes him "so angry he can't see straight"???????  It's sick.  Oh but my favorite is where Joy 'liked' a status Adam S. posted saying I am in trouble with the police in Minnesota and am being brought up on charges.  That's funny, because I have NEVER been in trouble in my entire life; and at that point, Wilkin County MN was not looking in to any of this.  Even if they did look into it then, they would find Detective Koch's investigation so there definitely would not have been charges brought against me. I am convinced that Joy is now doing to Adam H. what Adam S. did to me; and Adam S. is out there doing this to some other girl.

On March 2, 2014, Adam S. sent me a text messages threatening to "make sure I'll end up the sorriest sad sack of s**t to ever walk this earth" if I continued to pursue charges against him.  I immediately called the police and they took a report.  Unfortunately, because Adam S. is not living in Michigan, they couldn't do a whole lot in the way of criminal charge for threatening me.  So once again he got away with this stuff...

At the beginning of April, I received a credit alert that there were 29 new credit inquiries on my credit report.  When I left Adam S. a year ago, I signed up for credit monitoring with Experian.  I had been checking it every day for a while after I left, but after about four or five months of not seeing anything on there and getting busy with school and work, I had stopped checking it.  So needless to say I was horrified when I saw all of those credit inquiries.  I knew it was Adam S. and Joy.  I contacted the Wilkin County, Minnesota Sheriff's Department in Breckenridge and filed a report.  A detective there looked in to all of this.  I am still waiting for them to do something about it.  I had to put fraud alerts on my credit reports, place a security freeze on all three reports which, by the way, cost $10 per freeze, and contact the social security administration.  It is a nightmare. 

BUT NOW FOR THE GOOD NEWS!!!

I found out about three weeks ago that the Oakland County, Michigan Prosecutor's Office FINALLY issued an arrest warrant for Adam S.!!!!!!! Now, if Adam S. get's pulled over or has police contact anywhere, he will be hassled with it because they will detain him until they speak with Detective Koch.  So I hope when it does happen it will be on a Friday night and he will have to sit there for a weekend.  Ha! I intend to hire a bounty hunter to bring him back to Michigan once I find out where he is.  I am incredibly grateful for Detective Koch.  He spent a lot of hours working on my case, taking statements from other victims, and working with jurisdictions in Pennsylvania to make sure the subpoena for Adam S.'s medical records went through properly.  I am also thankful that Gary Tunis, the prosecutor assigned to my case, took the time to go over every little detail to make sure he had everything needed for a solid case. 

Unfortunately, charges will not be brought against Joy; but one of the other victims and I are working on making sure she is held civilly responsible for her role in the scams.  I don't want to say too much about that right now, because I don't want her to have any sort of leg up when it comes time for that.  I'll post another update when that is taken care of.

The last I heard, Adam S. is living somewhere in West Virginia with a 28-year-old woman named Jessica.  Supposedly they got married.  I've been in contact with Jessica since last night and she thinks that even though there is an arrest warrant for fraud charges against Adam S., he's still a good man and a good provider.  So if you see this, Jessica, DO NOT come crying to me when he does the same thing to you.  I tried warning you.

This recently happend to me but he didn't claim he has cancer 

This morning I was awarded $1,564.04 by a Wyoming MI District Court judge for the washer and dryer.  Of course Adam did not show up... I wanted to thank the kindhearted coworker of Joy's who came forward with their address.  Had it not been for him I would not have had this small victory earlier today.  Now we're all just waiting for the police to arrest Adam and Joy.  I will celebrate when they do.

In the last 6 months of dealing with all of this, I had the pleasure of meeting some of my would-be in laws and I must say that they have been unbelievably supportive of me through everything.   Joy's aunt and uncle in Ann Arbor have been extremely helpful as well, and I really do appreciate everything that everyone has done for me.  I only wish we could have met under different circumstances. 

I've been asked several times recently why I am working so hard to make sure everybody knows what happened.  I can't remember if I mentioned this in my last update, but one of Adam's sisters informed me that this has happened twice before while Adam and Joy were living in Pennsylvania; and thats just what she knows about. For all we know there could be more victims out there.  The sad part is, the two PA victims never brought this to the attention of law enforcement, which enabled Adam and Joy to do it again, and again.... 

I am not sure the extent to which Adam manipulated the other two victims, but my experience took a heavy, heavy toll on me.  As I've stated before, Adam would make large cash withdrawals from the checking account we shared every time I got paid, and as a result their was hardly ever enough money to live off of.  I would lay awake at night terrified of what might happen to Adam if he didn't get his cancer treatments; and being that I am in the medical field, I know the ins and outs of cancer growth and exactly what it does to your body.  That knowlege only horrified me even more.  I would cry myself to sleep while Adam slept like a baby. 

He of course had nothing to worry about, it wasn't his money he was blowing through and he doesn't care about anyone but himself. Adam told me that the money he withdrew (AKA my very hard-earned cash) and where it went wasn't any of my business.  I was the only one working, but my money wasn't my business.  Adam and Joy ran up my credit card buying luxurious crap for themselves.  I'm still trying to get that paid down. My washer and dryer were stolen - I only just paid off the washer on November 1st.  Adam and Joy drained my checking account leaving only 87 cents for me, 2 days after I had gotten paid.  I had to wait until my next paycheck came through to have money to live off of. There's so much more that I could talk about but I don't care to sit here all night listing everything he did. 

I don't in anyway intend to blame the PA victims for what happened to me.  I should have listened to my mom in the beginning - as in 2 1/2 yeas ago - when she said she didn't like Adam. Had I taken my mom's "concerns" (for lack of a better word) seriously, I wouldn't be in this mess right now.  HOWEVER, had this been reported to law enforcement in PA, who knows.  I might not have met Adam in the first place.  They might have started posting on here like I am so when you google either Adam or Joy's name it pops right up.  So after everything I have gone through, I want to make sure this is public, make sure everyone knows, so they can't get away with it ever again.  The buck stops here with me.

So the detective working my case in Oak Park subpoenaed Adam's medical records.  HE HAS NEVER HAD CANCER IN HIS ENTIRE LIFE!!!! This whole thing was a scam done by Adam and Joy; driven by greed, wanting money for drugs without having to work for it, and a general disregard for the nightmare they create for their victims. 

Much to my surprise, I received an email from one of Joy's coworkers at the Ace Hardware in Wahpeton, ND.  As it turns out, Joy had been running her mouth at work and told her coworkers everything I've reported on here (as well as to the police) but claimed that I was lying.  Additionally, when Adam and Joy ran to Breckenridge, MN, they decided to live out of a run down motel room for $1000/month in cash when there are relatively decent apartments available in Breckenridge for about $500-$550/month. 

So Joy's storytelling, coupled with where Joy and Adam decided to live, what they pay for the motel and them always claiming to be broke, and the fact that neither one of them changed their addresses from Michigan to Minnesota but both work, made this coworker suspect that something fruity was going on.  Joy's coworker googled her name and found this article, and then emailed me to get my side of the story.  My story is 10000000000000 times more believable then Adam and Joy's, and I have the paperwork to back it all up.  So, being disgusted by Joy and Adam - as he should be - he told me EVERYTHING, including where they are living:

Adam works at BurchHill Construction in Wahpeton.  Joy works at Ace Hardware in Wahpeton as well as at some kind of liquor store in Breckenridge. 

Joy still claims she is away from Adam and is on the run because she's running from an abusive relationship.  In fact, as recently as two days ago, Joy swore up and down to her step-dad, James Jordan that she and Adam aren't todether anymore.  But this is just not true.  In addition to communicating with Joy's coworker, I've spoken with the motel manager, Sarah, at great length regarding Adam and Joy.  They are both living together in that flee-bag motel.  The original reason I wanted to talk with the manager at the motel is because I wanted to make sure that they were really hiding out there, and that this wasn't just Adam using a fake name and feeding me false information to get me to make a fool out of myself.  But Sarah did confirm that they live there, and we had a long conversation about everything that happened, too. 

Sarah also told me that she thought something was strange about Adam and Joy, but couldn't quite figure it out; and then I called and she put the pieces together.  I even put the phone number for the motel on here so you all can call and confirm this if you want.   I finally gave up going back and forth with the cops about the washer and dryer, so I decided to take it to small claims.  The Wilkin County Sheriff's Office served Adam in Breckenridge, and if this site allows PDF file uploads I will upload a copy of the proof of service that I got back from Wilkin County so you can see this all, too.  No law enforcement agency is going to hand over court papers to someone without first checking their ID and making sure that they are who they claim to be.  Adam was properly served in Breckenridge.  He lives there, without a doubt, and Joy is hiding him.  Actually they're both hiding because they both know they are in deep trouble.

And then, on Wednesday (October 30th), Joy's aunt Sandee Stevens got ahold of me.  She heard what has been going on only just a few days ago, and she desparately wants to help me put BOTH Adam and Joy behind bars - where they belong!  Apparently, Joy had lived with Sandee from January - June of 2013.  When she left, Joy stole about $500 worth of Sandee's clothing and shoes.  Further, when Joy was living in Germany with her grandma a few years back, she ripped her off, too.  Her grandma was livid, told Joy to get out and put her on a plane back to wherever it is that she came from THAT NIGHT!!!  Her own grandma. 

I just don't get it.... Sandee also told me that there were receipts from an Ann Arbor MI branch of PNC Bank that were found in Joy's room after she had left out.  That PNC account was mine!!! It's the one that I unfortunately was naive enough to put Adam on.  But Joy had absolutely no right to take my money out of my account.  According to Sandee, Joy also referred to PayPal a lot and claimed that her friend "Lonny" would send her money - "a hundred dollars here, a hundred dollars there".  So I pulled up the PayPal receipts that I still had on my email and showed them to Sandee.  She said that the amounts were the same.  I don't know who Joy thinks she is kidding, but #1, my name is not Lonny and #2, I am most certainly NOT Joy's friend!!!!  And the only reason I sent money to Joy via PayPal is because Adam said Joy is his sister in-law and that she was helping out by allowing him to use her PayPal account.

Please, if you know these two, call them out on what they've done. Don't allow them to keep living a lie.  Per Adam's sister, there are more victims in Pennsylvania that never had the courage to come forward and press charges and/or sue these two scum bags for what they did.  Besides for being pissed off and incredibly hurt, my intentions in posting all this is to try and make sure Adam and Joy can never, ever do this again to another unsuspecting, kindhearted person who believes they are helping a young guy supposedly sick with cancer.  He's never had cancer before!!! Ever!
