Issues like this are why it's important to have a professional home inspection done prior to closing on the home. Home inspections are the norm these days and Realtors even recommend and insist that the home should pass a home inspection prior to closing. Professional home inspectors always check for termite infestation or signs of any termite activity. It does sound very un-usual for a brand new home to have any termite infestation at all and I find that hard to believe. After a buyer puts an offer on a home and the offer is accepted the buyer has the right to hire a professional home inspector to inspect the home before closing to check for any construction issues or defects, this usually costs about $300.00 to $400.00 that the buyer is typically responsible for paying. If the inspector finds major defects the buyer can back out of the sale and earnest money is required to be returned (if any) however you will still have to eat the cost of the home inspection even if you back out of buying the home.
