This company bought our loan from CITI Lending when we were three payments behind. The reason we were 3 payments behind is because citi lending jacked the interest rate immediately after purchasing the loan from AMC. I told them this would be impossible for us to do in our time of hardship. Secondly, I had completed one modification on another of our rentals and before they would even talk to us we had to be 3 payments behind! My sister lives in this rental and has done so for 15 years. They gave a verbal modified payment of $739.00. The original was $743.00. The jacked up payment was $789.00. the very month this happened, my brother-in-law was laid off, my sister is a care giver and the lady she took care of died! The first payment in the trail period was 24 days late. I immediately sent the next one 5 days early.

Seven days later the returned the payment and told us we were in default. I was able to get a hold on the foreclosure while we supposedly filed for a modification on this house. I sent 3 months bank statements, proof of income, and my 2008 tax return which has 55 pages as we had a dream of owning 10 houses by the time we retire. There are 5 schedule E's and my husband is a truck driver as I was until I was injured on the job, denied my workers comp, went 8 months without any income. We then received a phone call from Anthony Nugen (pronounced Win) telling us we could not get a modification because we did not make enough money? daaaa So I sent them a financial report showing us having $1200.00 left over each month.

So he allegedly started another modification application. In June I received a letter dated April 16 saying they could not modify because of lack of contact! How do you loose contact with the people in the house? So I called frantic and told them that Mr. Nugen's message says do not leave multiple messages because it will only take longer to return his call. They told me to re-submit all doc,s for the third time. I begged them since Sept. of 2009 to please take the $729.00 payment they refused. Saying when you are in default we can not except a payment! They sent me a letter telling me my last submission was incomplete... That they can not except my bank statements as proof of income and for me to submit the award letter for my SSD and my husbands SSI award letter. That notice was dated June 15. June 24 (my husbands birthday) they sold the house to and put a letter on my sisters door to vacate.

I contacted an attorney online and she informed me that this was illegal and I needed to file a motion to set aside the sale because they had not followed proper procedure thus denying us due process of law. I contacted a Redding CA attorney and he told me that "it is not just a motion, it is a law suit and they cost lots of money and that the BANKS have lots and lots of money and have been able to do what ever they want with these foreclosures. We bought this little dam house, built when Shasta dam was built in 1989 it was our second rental property. We paid off the private party we bought it from and borrowed $40,000.00 with EMC mortgage Co. paid them for years without one payment being late. In 2005 we completely re-modeled it and borrowed $50,000.00 on it.

Still we paid as agreed to AMC. Then the real estate market crashed, citi lending took over AMC or bought it the home owner knows nothing of these transactions. They immediately jacked the interest from7.5 to 8.5%. On Oct 18 2009 we received a form letter telling us that our interest rate of 7.5000% had been lowered to 7.25000% and that our new payment would be $723.00. I then called (which is a 23 minute delay before you talk to a person.) They refused to except the payment, I told them I wanted to go before a foreclosure judge. In their default notice it states that they can take the house without going to court! We have no money for an attorney, we can only get a modification on our primary residence.

We can't file bankruptcy because we don't owe enough on our first home, and they will take it. SOMEONE PLEASE HELP? We have two houses in Shasta Lake this one and another that we have a modification on, and have been trying for two years to give away to anyone that wants to take it. Talk about the silent victims. What about the people with a real estate dream for retirement? Why are landladys and landlords treated like some kind of criminal because they own more then one house?  PLEASE HELP STOP THESE HOME RIP OFF COMPANIES. Kat from Coquille OR
