Complaint Review: Aimco Regency Oaks Apartments - Fern Park Florida

First, this is not a report from an angry resident, or someout out to ruin a reputation. Its a real account of how this apartment complex is truly improperly managed and how it truly lacks respect for its residents.

I moved into Regency Oaks back in January, 2011. Shortly after being fed the "bait and hook" ideas on how the community was remodeling, how it would shortly be a 'closed gate' community, and how the club house and pools were all undergoing extensive renovations, I was up for a rude awakening!

Ill put aside the fact that its a roach and flea infested comminuty. (And it has nothing to do with how clean, or how often you spray your home when the outside areas are not treated, and the roaches live in the interior walls)...so ill let that go...it also is a waste of time to mention that the club house was never renovated, and the gates remain open! I moved out September 2012...

It would also be a waste of time to mention how I saw the office staff turn over more times then a 7-11 hotdog! I literally saw 7-8 different office staff members in two years. I mean, the manager Sandra was completly nuts and had no problem being rude to your face when you asked about issues....maybe thats why the staff kept leaving...

My first issue started with a leak that lasted for 3 months, resuting in my bathroom ceiling collapsing 2 days befor Christmas. And I notified management four seperate times, (10/5/12, 10/31/22, 11/14/12, & 12/10/12). Each time they could not locate the origin, and just blew it off...just bad luck I guess.

No, my time is going to be used to inform you of the 'borderline theft' of my security deposit! See, I moved out September 12th 2012. First just to cover all bases, I provided my forwarding address 'in writting' along with.my intent to vacate. So far, I think im all set to say farewell to this joke of a community! So, Here comes august 20 and I contact the office to make sure im all set to move out 9/9/2012. Now they have a new manager by the name of Lisa. She informs me, she didnt see any record or letter of vacating the property (red flag #1). So i produce the copy I made and she (after admitting to being 'new') says she has to call the regional manager to verify since im within the 30 days (only at Regency...). So 24 hours later, i go back to the office and Lisa informs me she spoke to Erica (assistant manager who is truly 1 fry short of a happy meal) and she 'kinda' remembers my situation (see, I complained so much to the Aimco coorporate office they allowed me to move under the 'coast to coast' option 3 months before my lease was over). So again, I think I'm all set to move.

Fast foward to 9/1/2012 and i call Lisa to have my move out inspection set. She provides me with a list of things they will charge me for if they are not cleaned and even went as far to tell me that the Coorporate office 'makes them charge' for carpet cleaning, even of you have it done. So, I go about my business and clean the apartment top to bottom! Honestly, better then it was when i moved in!

So the inspection day comes. The new maintanance supervisor Mike comes, looks the place over and says, "you have two cracked blinds, and a couple small holes in the walls , but they dont charge for paint if youve been here for a while" (maybe I should have asked what was considered a 'while'). So he informs me that he has never seen anyone get their deposit check back, but I can be hopeful. When I mentioned my deposit was $844.00, he then said, "ohh, you should get a good $600 back, first refund ill see". So now im signing off on the inspection, thinking im finally done...so I thought!

The day is October 1 and my car breaks down...now, im thinking that i should have a $600.00 check on the way. So, I call Aimco that day to see what the status is (I know with state law, they have 30 days to refund if the land lord wishes to hold any portion). So Damion at Aimco says he sees "no record of move out" and my account is currently showing I owe the community $79.20 (my last water bill). So remember those red flags...yeah! So I debate with him but the Aimco reps in the customer relations department sound like such robots. He says hell send an inquiry to the accounting department and regional manager to see if they have any info or can follow up with Regency oaks. Two days pass and no call back. Its now 10/03/12 and I take it on myself to call Regency oaks. Sandra 'a new girl' informs me that Lisa(the property manager) is no longer with the company. (Shocking). And aparently, my move out paperwork was 'misplaced ' (now I'm kicking myself that I didn't wait the full 30 days before calling). But she mentiomed Erica, the assistant would have it processed immediatly. So, i get the lovely certified letter on the 6th, dated 10/02/12 informing they will be holding $380! What the??? $100 for carpet cleaning (I knew that was going to be held), $80.00 for the two cracked blinds, AND $200.00 for PAINT! Wow.....just wow!!!!

So im already pissed that I'm being charged $200.00 for something i didnt think I was suppose to be charged for. But then here is the begining of the fun part. I called Aimco the same day (10/06/2012)to verify they had received the same info. Matthew informs me yes, but, no forwarding address. Nice ONE regency. So he takes it down and says hell forward it to the accounting department as they usually mail the checks out 5-7 days after recieving the info. Fast forward to Thursday, october 12. No call, no check! So i call Aimco customer relations again...lucky me I get Matthew again. This time I inform him, I haven't gotten a call about the status,nor have I received the check. So he says he'll forward a request to the accounting department and will be giving me a call back within 24 hours. So, now its Saturday, 10/13. No call, no check. So I call Aimco customer relations again, and get Natasha. She says she'll forward the info to Matthew and I should get a call MONDAY to see if they have an answer. Come Monday, October 15. I call and I'm in luck, I get Matthew AGAIN! This time he says how he got a responce from the accounting office and they mailed my check out on October 5th!!! He then pauses and says, "but they mailed it to your old leasing office at Regency Oaks." WHAT THE HECK!!! So he just informed me to contact Regency Oaks and see if they can forward the check to my current address. So I call Regency (with extreme reservation) get Sandra who says "we dont have a check here for you" At this point I was really mad...like blood shot eyes/ slight twitch mad. So she (Sandra) says, "but we just got a new office manager by the name of Matthew, he is very thorough, ill let him know of the situation and hell be in contact by tomorrow."

Well people "tomorrow" is now today, its well into the pm and yes you guessed it, no check, and no call! I think part of me has givin up hope, and part is so d**n upset that I need to act like this is a bad nightmare! Will I get my check? I honestly am starting to lean towards no...and no lawyer will take a case for a near $400.00 deposit (that should have been $600.00 if i asked what was meant by not charging for paint if you have been in the apartment for 'a while'First, this is not a report from an angry resident, or someout out to ruin a reputation. Even after you get past the drug dealers, loud teenagers, roaches, fleas, lack of proper maintainance, horrible management, unknowledgable Property managers, and even more clueless Corporate office employees...they'll still find a way to rip your last from you when you make a ligitimate exit!

And p.s. I was NEVER LATE on rent. (I was forced to sign up for direct debit when I moved in...was told it was 'required'...guess that was another of their lies!!!)

Hello maine508, I am very sorry to hear that your experiences at Regency Oaks Apartments are unsatisfactory.  We appreciate you sharing your concerns as this is where we can evaluate items mentioned such as staff, pests and move out charges and procedures. We value your opinion and I will be sure to address your concerns with our community management team. Upon further research into your refund, we found that your check was mailed to 112 Monarch Circle # 05, Fern Park, FL 32730 on October 5, 2012. As of October 18, 2012 we show that it has neither been cashed nor returned as undeliverable. We normally advise our residents that it can take up to 10-14 business days for these to be delivered by mail. If you would like you can contact the Regency Oaks office and they can send a Lost Check Affadavit to request a replacement check. Let's just focus on your deposit as everything that happened while you were there is really a non-issue now. 

You have two issues.  First of all on the deposit you were expecting $600 and you got a letter stating you will get back $464, so the reality of this is that you are actually disputing $136.   The problem for this is that your only proof is a verbal statement from the "new" maintenance supervisor.

Now the bigger issue is that you have not received the check.  If the deposit laws require them to not only send you a notice of what they are withholding, within a specific period of time. But to also send the actual check within a certain amount of time.  And that time has past you have every right to go after them.  You can file this in small claims court for probably less than $100 and the best part of this is that you don't need a lawyer.

The advantage to you is that you already have a letter stating how much you are going to get back, so they can not pull any "stunts" saying that you actually owe them more.  If they have no proof that they actually sent the check per the terms of the law, this seems to make it a "slam dunk" case for you.  If you prevail you will get the court costs back, and may even get any additional "damages" that may be provided for in the laws.  Such as in some jurisdictions(may not be yours though) the landlord is subject to penalties of up to 3 times the amount of the deposit for not following the law..so this is something to definitely look into.
