COMPLAINT:

July Mr. Kuchinsky requested an estimate to move a household from Stephens City, Virginia to Palm Coast, Florida for 10,000 pounds. Mr. Kuchinsky was given a telephone quote of $.25 per pound or $2,500.00 overall plus $75.00 per moving person (est. 3) at pickup and delivery locations.

August Mr. Kuchinsky received a call back from the mover (All Points). The movers were told that half of the household was already moved to Florida. The movers agreed to give us the same rate irregardless of the lessened poundage.

Mr. Kuchinsky contracted them to pick up the household in Stephens City, Virginia on August 12th at 8:00 a.m. The movers were given a 20% down payment ($300). The rest of the bill would be due on delivery. The driver would notify Mr. Kuchinsky within 24 hours of the delivery.

When the driver failed to arrive on August 12, Mrs. Kuchinsky called the company and was told he would be there shortly. Mrs. Kuchinsky continued to have several telephone conversations with the office in New York about the absence of the driver. She was told the driver would be there August 13. When the driver failed to arrived again on August 13, Mrs. Kuchinsky, having had several more telephone conversations with the company about the absence of the driver, cancelled the move.

The driver (Bondo) arrived at 7:00 p.m. on August 14th. He was advised by Mrs. Kuchinsky that job was cancelled due to the fact that it was 48 hours past their scheduled pick up time. However, after hearing of Bondo's problems and seeing his tears (plus 10% discount and reimbursement for airline ticket promised), Mrs. Kuchinsky relented and told them (Bondo & helper) to return the next morning for the pickup. Mrs. Kuchinsky was very anxious to have her and her furniture moved to Florida to be with her husband.

The packing was done in a professional manner. They wrapped the large furniture and the balance of the miscellaneous items. Mrs. Kuchinsky had already wrapped 45 boxes.

On August 16th at 3:30 p.m., Mr. Kuchinsky was advised by a secretary via phone that the mover wanted to settle the bill $6,602.00. He told them he was not prepared to pay such an exuberant amount, especially after being quoted a different price. The secretary said she would have a manager call him back.

A manager never called either Mr. or Mrs. Kuchinsky.

Mr. and Mrs. Kuchinsky both repeatedly called the representatives of the company in New York and Florida and were finally told on August 20th that the bill would be $2821.00 before delivery and $2800.00 on arrival of their furniture in Florida. At this point, neither Mr. nor Mrs. Kuchinsky knows where their furniture is.

What actions can be taken to help resolve this problem? At the moment, Mr. Kuchinsky is in Palm Coast, Florida and Mrs. Kuchinsky is staying with her daughter in Thurmont, MD. Both are eager to be together, but at this point neither knows what to do or knows what their rights are. Both are worried about their furniture and where it might be or what the company plans to do with it.

Please advise them as soon as possible as to what they may/can do.

You really need to get an attorney. Or, just write it off, and buy new furniture. They are screwing you, and unfortunately, you will find the law is on their side. Movers have basically an "open season" on consumers, and that's why companies like this can operate this way. They will give you a price that is 2 or 3 or more times the original quote, and you can either pay, or they sell everything you own at auction. You need to decide if you can afford an attorney to go after them, and if that is what you want to do, or if you would rather just write the stuff off. Frankly, you may be able to replace your furniture more cheaply than paying the "ransom" money that these crooks are demanding.

It's really sad, though, and I definately feel for anyone who got taken by these kinds of "legal" criminals.
