In 2001 I was dismissed from my job in Park Rapids, Mn. I had a balance on my Capital One credit card. I was late on my payment. I contacted Capital One to make arrangments. I sent in my payment as they stipulated. My next bill showed a late fee that put me over limit, they then said I owed an over-limit fee. As I tried to get this striaghtened out, they closed my account and demained full payment. Since I was unemployeed at the time I could not make the payment. As they called several times a day harrssing me and my family, I told them I would only pay for what I origionally owed, $300. I have paid off all my credit card bill, two years later. I approached them in 2003, to pay off my debt. Capital One said I owed this huge amount. They would only except this huge amount. Since then I have been harrassed by about 4 other companies. Now Alliance One has taken up the Ball and said I can settle for a lump sum of 782.81, thats a 58% savings on my outstanding account balance. Or two payments of 493.92, which is 876.00, or 3 payments of 394.51 which is 1183.53. I want this harrasment to stop, and am willing to pay them $400. If I could I would sue them for their years of recking my credit and abuse on the phone by their representatives. Thank-you

Like most debtors, you think that you are not at fault at all, and that us big bad debt collectors are out to ruin your life. What you DONT realize is that you are wrong. Firstly. You signed up for the credit card. If you would have taken the time to read the LEGAL BINDING contract that you signed, you would know that you are completely responsible for any and all fees, penalty and interest. Basically, if you don't pay your bill when you are supposed to, and let it go on forever without payment, like you did, the bill will substantially go up. There really is nothing that you can do about it. Except not use credit cards. Basically the facts are these. At the point of collections, the third party collection agency is not obligated in any way shape or form to settle or even accept payments. You legally owe the full balance. Fees and all. Quite frankly you would be better off to cooperate before the amount gets larger and larger. Because you really won't win on this. What a lot of debtors don't realize, is that principal doesn't mean anything when you owe money. Frankly, it doesn't matter what you think you owe. You agreed to be responsible for all of it. So you can really fight paying your debt all you want, but it will get you nowhere. You owe it. Own up and pay it.

The consumer is under contract which states if you dont pay on time they can charge the late, overlimit and interest on the account. How is it harrasement to call and ask the consumer to pay the bill back? This is not a solicitation! They didnt ruin your credit...You did. Take responsiblity for it and fix it when you can. You should be happy they offered a settlement. Settlements are usually done in a 1 time payment. A 1 time payment you can usually get more money off. Who are you to dictate the terms of the contract You already signed?
