I had a auto accident calim#565245K108 filed on October 7, 2004 with AMEX Assurance company. I was told by the claim representative to take my car to their authorized body shop, which I did and rented a car. Body shop took 5 days to fix my car, my claim rep. said he will pay for 4 days of car rental since the repair job should be done in 4 days. I have to talk to his supervisor, who also didn't want to pay for the 5th day. She said car was ready on 4th day.

I did got the call from the body shop on the 4th day around 4:30pm and they were closing around 5pm. I was in the middle of the clients appointment also with the traffic situation it was impossible to make it by 5:30pm, so I have to pickup my car next morning. They finally paid me for the 5th day's rental after checking what time bodyshop had called - WHAT A LOUSY CUSTOMER/CLAIM SERVICE, NO TRUST IN CUSTOMER.

My accident was in parking lot, when I was backing up other driver hit my car. I had a witness, whose name and phone number was given in the claim. The witness show the accident and told me that the other driver was in the hurry and hit my car.

I have called numerous time to Cheryl Zuraski who is a new claim representative. She told me in January that claim is going in the arbitration on Feb 14, 2005. I called her again in March and she said that the arbitration date is still not decided. I asked her how long it will take and she said she has cases panding for almost 1 year.

Anyway I have paid $500 deductible and would like it back since it was not my fault. I have canceled my policy with AMEX due to very bad customer service. I am still waiting for my claim/deductible after 6+ months.

Insurance is a funny beast. Just because the other person hit you, doesn't mean it's their fault. If you were backing out of a parking spot and were hit, it sounds like it's mostly your fault. Regardless if the other vehicle was in a hurry or not, you pulled out in the way of the other vehicle and they had no choice but to hit your car. Maybe you should pay more attention to others. It sounds like the two insurance companies are trying to figure out who was the most at fault in this case... but I doubt you're going to get your deductable back.
