We are a family of three handicappers, two on the title, one on the loan. In Texas, we are not required to pay property taxes until we die or sell the home, so that, as permanently disabled with a fixed-income, we cannot lose our home simply because of ever-increasing taxes. American Home Mortgage Servicing, Inc./Option One Mortgage Co. will not honor our law. During the third year of our loan, while I was in the process of PAYING (by monthly installments by voluntary agreement with the tax office) our taxes, (I do TRY to pay my taxes without accruing late fees and interest charges), American Home Mortgage Servicing, Inc./AHMSI/Option One Mortgage Co./OOMC had a finance company come in and pay my taxes for a year IN ADVANCE, and then proceeded to create an escrow account and RAISE our payments by almost 50%! We struggled and starved to make those payments for a year, as it is difficult to find a wheelchair accessible home in our very limited price range, and most companies will not qualify our income for a loan. When I complained in writing and by phone, no single department ever knew what the other was doing, and all assured me their error would be corrected. They "lost" or "never received" the faxes and letters I sent, and refused certified documentation. After many many months, many insufferable calls (that raised my blood pressure at the very thought, morever the actuality, and then the recall!), they finally admitted to having received several copies, but would NOT change the payment and WOULD foreclose if those payments were not met. THEY CALLED AND HARRASSED US EVERY DAY, AS MANY AS EIGHT TIMES A DAY, FROM 7AM-10PM. However, the next year, the payments went back to our original $779 and we concluded they truly HAD finally fixed their problem. WRONG!!! January 2009 we were told our payment would now be over $1600/month (just shy of our total income for all three of us!). The calls began again. The ignorance and false confidence games began again. By March we had received a letter of foreclosure, despite our many calls and their many promises. When I finally insisted they do a loan modification application (and they refused to comply MANY times), someone standing over the shoulder of the foreigner I was speaking with ordered him to take the application, that we fit within the parameters, but nothing was guaranteed. I had little hope, but I had no options either! They were trying to charge us for the previous year, the current year, and the NEXT year's taxes all at once. We pay excessive property taxes, as we have no state taxes. After five months of anguish (I have congestive heart failure with life-threatening complications and my son is paralyzed from spina bifida), we received notice that our loan modification had been approved. WONDERFUL? Not exactly. Our loan balance was INCREASED BY $13,000!!!!! Yes, our exhorbitant interest (9.2%, which--despite the fact that they had raised it AT CLOSING--I agreed to because I did not want an ARM and subsequent payment increase--was temporarily reduced for a short time. HOWEVER, they ROBBED US OF ALL OUR EQUITY!!!! And, the loan ends up only being about 2% less interest than originally, but for $13,000 more!!!!! Further, they have included the taxes, of course, so we still are not even allowed the protection of our own Texas law, WHEREIN THEY RESIDE AND ARE LICENSED TO DO BUSINESS. These are not human beings who run this company. THESE ARE SICK, SADISTIC THIEVES, ALWAYS UNPROFESSIONAL, PREYING ON THE POOR AND THE MAIMED. We entered into a 30-year fixed interest loan agreement we could afford, and they have changed the terms of it like Simon LeGree. We're didn't need pity, but where is the JUSTICE? Is there ANYONE who can tame this beast?

I'm no tax expert but I did a quick search through Texas state law. You DO have to pay property taxes on a home if you are disabled. They are just reduced. What homestead exemptions are available? There are several types of exemptions you may receive. * School taxes: All residence homestead owners may receive a $15,000 homestead exemption from their home's value for school taxes. * County taxes: If a county collects a special tax for farm-to-market roads or flood control, a residence homestead owner may receive a $3,000 exemption for this tax. If the county grants an optional exemption for homeowners age 65 or older or disabled, the owners will receive only the local-option exemption. * Age 65 or older and disabled exemptions: Individuals 65 and older and/or disabled residence homestead owners may qualify for a $10,000 homestead exemption for school taxes, in addition to the $15,000 exemption for all homeowners. If the owner qualifies for both the $10,000 exemption for 65 and older homeowners and the $10,000 exemption for disabled homeowners, the owner must choose one or the other for school taxes. The owner cannot receive both exemptions. From what I see here, you qualify for having 25,000$ taken off the value of your home and then having the tax calculated from there. I cannot find anything that states you are 100% exempt from taxes. I found another law that states a disabled person's tax rate cannot exceed the tax rate the first year they were in the home. So there is a tax ceiling, but you do have to pay taxes. This company sounds as if they keep raising your rates because you refuse to pay your taxes.
