Today I received a letter from America's Servicing Company , also known as ASC .

In this demand letter, ASC's Hazard Insurance Processing Center claims that it is their policy that the flood insurance on my property have an equal dollar value to the replacement cost dollar amount on my properties.

There might be some reason for this if the value of the loan I have was anywhere near the replacement cost of the buildings , but it is not.

What ASC wants me to pay for is insurance that amounts to almost 3 times the value of the loan.

My loan was purchased from GMAC Mortgage a few months ago and all that was required at the time was that the limits of the flood insurance be at least the dollar amount of the loan.

ASC states that they can force me to buy additional insurance because of wording in the original deed of trust, but there's no wording in the deed of trust that says anything about the lender being able to force me to insure the property for an amount which exceeds the amount of the loans.

The letter goes on to say that if I don't buy additional insurance, that ASC has a sister company, American Security Insurance Company that WILL write the insurance.

I contacted the State Division of Finance in Missouri and the man I spoke with told me that he knew of no law that would require me to buy more insurance than the value of the loan.

Now, I am stuck with spending an additional $ 1000 to $ 1500 per year for insurance I don't want and don't need at least until I can find a legal way to get out from under this crazy demand by the lender.

Insurance Scam by ASC turns into Insurance and Escrow SCAM

After ASC claimed that they could force me into buying insurance coverage for more than 3 times the loan amount , they turned around and created an escrow shortage in my loan account by adding the taxes for ALL the property I own in the County to the escrow on ONE piece of property . When I originally called ASC about their demand for outrageous amounts of insurance they claim they can require , I asked the person what this drastic increase in insurance costs would do to the escrow accout on this loan . The ASC Rep told me not to worry , that escrow accounts are reviewed in MAY . Well , within a month of paying out of my pocket about $ 1000 for additional flood insurance I didn't need or want , I get an escrow account statement from ASC claiming that the account is $ 1374 short . Reviewing their statement , I see that they have added to this account ALL 3 pieces of property to this escrow account , even though this loan is only on a single piece of property . To make matters even worse , they added the tax bill for 1 piece of property that is ALREADY escrowed on another loan serviced by ASC , so now I get DOUBLE BILLED on taxes on this property . Plus , they added the taxes on a 3rd piece of property that they don't even have a mortgage on . So , I called " customer service " . This Account Rep tells me she'll put an " inquiry " on this . The next week I called back to find that no inquiry had been submitted . Again , an inquiry was supposedly submitted . To make matters even worse , ASC refuses to acknowledge that I have increased the flood insurance on one of the loans I have through them , so they put into effect their own insurance , even though my insurance company sent them a copy of the new declarations page and I have TWICE faxed the same information to them . I made THREE calls to ASC in ONE day trying to get someone on the phone who might accidentally want to straighten out this mess , but NOTHING seems to work with these people . One Rep even had the County's Assessor on the phone , but even after the Assessor's Office told this woman that these were 3 DIFFERENT pieces of property , nothing was done to give me my money back . ASC sent me 2 different escrow shortage bills , one for each loan that they service . On these statements it said that if I paid the full amount of the shortage , the monthly bill would be less than if I paid the supposed shortage monthly . So , I paid the entire amounts of the supposed shortages on BOTH loans . In the mean time , I received an updated payment coupon on ONE loan , because I had paid the escrow shortage , but on the loan with the $ 1374 " shortage " I never received a new payment coupon , so the only coupon I had was at the amount where the shortage was being billed over a 1 year period . This payment was $ 225 HIGHER than my original loan payment . When I called to see WHY I hadn't received an updated coupon , the Rep told me that my $ 1374 was applied to the principle of the loan . When I asked HOW a payment , made with a coupon that said " ESCROW PAYMENT " could have been applied to the principle of my loan , she had no answer . This Rep told me that she had corrected the payment and moved it from the principle to the escrow account , but all I have on that is her word . In the mean time , I still HAVE NOT received an updated payment coupon reflecting that I have paid this " shortage " that ASC created out of thin air . The last Rep I talked to , yesterday , said they were " waiting on the County " to contact them about the tax situation , this even after another Rep had the County on the phone 2 weeks prior . It certainly has all the appearences that once ASC has your money , they are in no hurry to do anything to fix what they've screwed up .
