I can relate to this, OMG can I relate to this. I didn't even know that AmeriCredit deferred my car (7) months extra from the original (60) month contract to a (67) month contract. I have been charged major daily accrued interest and you should see all the lates they had on my credit report.

I have them under investigation by the Office of Consumer Credit Commissioner (OCCC) and after the OCCC requested that they produce all the records with my signature agreeing to these said extentions(deferments), AmeriCredit has not come up with any.

On your copy of your contract you should see a Commissioner's address listed on there. Go to the website and file your claim. So far everything from the lates of 30-60 days being reported, which AmeriCredit has to produce the date I sent off a electronic payment from my bank to the time they recieved it. There is no way that a online payment takes 1-2 weeks to be posted.

AmeriCredit is caught posting payments that should be posted the same day its sent off electronically from my account to their account. Being 30 days late is not being 1 day late. They are using this to their advantage to damage people's reports so they can not get a Prime rate and be stuck to go with them again.

For years I wasn't even getting statements from them and all the ones I was getting was listing me as (60) month loan, not (67) months as claimed. I also reported them to the HOuston BBB and their response was as follows, "AmeriCredit is not required by the Texas law to provide a consumer with written verification and/or confirmation regarding deferments and extentions."

OCCC states a WRITTEN confirmation of an amendment is Texas Credit Title,Texas Finance Code, 348.116 which reads as follows:

"An amendment to a retail installment contract MUST be confirmed in a writing SIGNED by the retail buyer. The holder shall:

(1) deliver a copy of the confirmation to the buyer;or

(2) mail a copy of the confirmation to the buyer at the buyer's most recent address shown on the records of the holder."

AmeriCredit stopped answering the BBB after I fowarded the letter from the OCCC about the Texas laws. Isn't it obvious that they are caught in a hole? Today is their deadline to produce every scrape of paper defending these findings or they MUST apply all deferments(4 months) on payments and the interest back to my account.

In addition I have had some late fees removed and if they can not produce the other late payment evidence of being 30 days, not 1 day late, they must remove all lates from my credit report. I welcome you to look on your contract and find at the bottom the OCCC's address so that we can bring these well dressed theives down and out of business.
