During the loan application process there was a third party involved. Between them and the loan officer the loan was set up as a re-fi (vs. an initial purchase) with cash out payments not going to any of my personal debts. One cash out was $105k (Private Mortgage was all it said on the page), another was $42+k to someone I did not know or owe monies too, and the third was to me for $25k (supposed to be $20k). (First off, why am I getting the lessor amount? and where is the lein or proof of debt from these people?)

The loan officer was told this was NOT a re-fi prior to closing, and I was not aware of any payouts except the $20k to me. While scanning the documents at closing, I noticed the seller was not there and the mortgage was set up as a re-fi. I objected and was told by the lawyer (this was held at Ameriquests' office in Tucker, GA) that the documents would be corrected and sent to me in the time allotted to "bow out" of the deal, and enough time would be given to stop the checks cut if the loan was not correct. She kept the pages for correction out of my closing documents.

The checks went out. Mine was cashed. Still no complete closing documents. I closed on April 30th of 2004. On May 14, 2004 I emailed the L/O (loan officer) stating this was not a re-fi and I was awaiting the proper documents. No response. So I emailed him again on June 26th, 2004. Still nothing. So I requested a copy of the appraisal (not included in the loan documents but I was charged for this in the closing costs) and was given an appraisal from another lender on the same property, (this was in August 2004).

I finally get a hold of the L/O and he meets me at the office door and asks what's wrong. So I ask him how he could re-fi a property for me that I never had a vested interest in. So we review the Title Committment letter I said at closing was incorrect. It said I was vested via warranty deed since January 2000 and was filed with Fulton County Courthouse in February 2000. He also points out the quit claim form as supporting documentation. The quit claim was dated 2004. I went to the Fulton County Courthouse and pulled the book number and went to the page number given on the Title Committment letter. I WAS NO WHERE LISTED on that sheet.

So now, not only can I not sell the property, but I can't re-fi it either. I'm looking for a lawyer so if anyone has any suggestions, contact me ASAP! They (Ameriquest) are still expecting me to pay a $1400/mo mortgage payment on a property I don't legally own or they'll start the process which will result in the destruction my credit. I'm now out 4 months of payments plus closing costs.

Thanks, I've contacted the State Attorneys' office, the GA Department of Banking and Finance, FDIC who referred me to the FTC, ACRON, and the local GREFAP (?). I did retain an attorney whose clients are normally lenders. Still, nothing. The FTC added me to the database for further reference, the local Coalition for RE Fraud referred me, I'm filing a formal complaint with GA Dept. of Banking and Finance, and no response from the other departments.

THE BRENT BARBER STORY. This story came from a news investigator in Kansas City, MO. IT WAS PUBLISHED MAY 22, 2003 IN THE "PITCH WEEKLY" OUT OF KANSAS CITY.. THE STORY CLAIMS THE FOLLOWING: Brent Barber WAS a sales rep at Ameriquest...and then used Ameriquest sales reps when his scheme grew larger..to fund these fraudulent loans.....over 4.5 million in dirty loans ameriquest funded, now the average loan size in Kansas City is around 60k....so 4.5 million is a ton of business... I found this story on the web, doing some research on Ameriquest Mtg. When I read it my jaw dropped...this man and the ameriquest offices in MO were running a ring of fraud so large, The majority of the loans he did, and that ameriquest sales reps funded for him....WHERE PURCHASES...DRESSED UP TO LOOK LIKE A REFINANCE...MUCH LIKE YOUR SITUATION. You need to contact the Office of the Attorney General for your state and notify them of the obvious loan fraud. In many states, the Consumer Advocate for the State will get invloved and help you. I suggest that you run a google search for attorneys that specialize in real estate cases. I am the Vice President for a Major National Lender based in Denver and have seen this situation before. This one seems very winable. Don't get disturbed by the above comment saying you wont win. Another thing to consider, if you are a minority, female single-mother, on a fixed income, or qualify as any specially protected group, their are agencies to help also like ACORN. The typical resolution on this type of loan is to have the entire loan charged off and no damage to your credit. The attorney would then have a note against your house for his winnings, but at a substantially lower dolar amount and monthly expense than what you are up against now. Ameriquest has been getting bloodied in court and they will probably try to resolve this once an attorney makes contact with them. Good luck....

First, If you are doing a purchase and see them marking it as refi - why didn't all your bells and whisltles go off and you WALK AWAY like any normal human with brains would do? Second, if THEY purpotrated this way, that is clearly fraud - and on a purchase you DON'T have any period where you can rescind anyway. They tell you you have 7 days, but you don't...read the fine print. These scammers have pulled this over on the feds...they were sued and had to add a period onto the normal 3 days rescission period, because they were SO bad...now they turn that around and quick-close loans and THEN chase after any problems with the 7 days the govt stupidly gave them. By the time 7 days passes, you're up the creek because you really only had 3 days even though they told you seven....the company still gets paid on the loan, including the management - the loan officer doesn't. That's why they are full of inexperienced dunces who don't even always know they are ripping you off...they are trained around the rules so neither of you know. This company has a bunch of thugs running it who don't care who they cheat or steal from. I even saw them fail to pay off a loan on a refi and someone walked away with $120K with no evidence it was paid...even 3 years afterward and 3 subsequent "internal" refi's later. Get yourself a good attonrey, but you seem to have had the old red-barn scam pulled on you. You're probably S.O.L. partner...you didn't read this place first and go somewhere else reputable.

Marlene, This is obviously a clear cut case of fraud, and the signing rep/atty, and sales rep, and title company and ameriquest...are all parties to it...and ameriquest in this instance has frauded the state, ....this was a purchase...disguised as a "refi"...so the deed was not reconveyed, and the property taxes where not reassesed either..not that you want your taxes any higher, but i have seen more and more of this at my company...if you have not received any help yet, from some one other than the office that booked your loan, (if they "helped" you it was an effort to cover their tracks..and quiet you.")..I do work for the company, but not in the capacity to help you myself but i can put you in contact with the right people in the company...direct #s or cell #s....that are not public....please respond if you have not received help, and let me know how to contact you..email etc...since i work for this company i am afraid to give you my info... hope this helps.
