Apparently my complaints to Michigan's Attorney General, as well as the complaints of thousands of others across the country, have been heard. Last year, Ameriquest agreed to a class action settlement and restitution. I received noticed in the mail yesterday, July 2, 2007, that I will receive restitution payment from Ameriquest. I am sure it will be a paltry amount, nothing compared to my $800/month interest payments on a $100k loan; but there is some vindication with Ameriquest forking out money. I am the poster of the original complaint. The prepayment penalty if we refinanced within three years was 12 months interst - which was almost $10,000. Additionally, Jodi Van Den Hout announced our quoted interest rate changed at our closing. They also did not escrow our taxes and insurance or we would not have qualified for the loan, but required us by contract to keep both taxes and insurance current. Further, there were no witnesses present to the transaction and our documents were all notorized after we had left the building. Our original documents and those they have on file, I have copies of both, show that the witnesses (notaries) did not sign our documents and were not there. Please note that Ameriquest Mortgage has changed their name to AMC. I wonder why?
