Complaint Review: AMS Properties Charleton Building Credits & Mr. George Czarnecki - London Ontario

I recently purchased a home that I did not own for very long to find out that I would have to apply for a claim with my insurance company the furnace caused black shoot to enter my enter home destroying my personal effects along with the walls and floors. I put in for a claim for damages proof of loss and called all the inspectors and got all the estimates I felt I needed and basically did all the calling and running around for the adjuster put in charge of this claim. He them filed for work I had done to be paid out by my insurance company.

My girlfriend whom I had living with me had to do all the work as I am a truck driver away from my home in USA 90% of the time. I drive long haul for a transport company. I proceeded to fill out all the proof of losses and type them out very neat and have letter sent to this insurance company on a daily bases for months and still they wanted more.

After one year I finally had enough loosing money every day from having my friend not work and concentrate on this and get all the contractors to give estimates and so on. I completed all the forms and still they were not satisfied hoping I would give up dragging it into I would have to hirer a professional public adjuster at the cost of 10% of the claim that was at this point $50,000,00 now this was going to take more time as he was hired last October/00.

His name was Judson Lee he had to hirer a lawyer to sue the insurance company as they only wanted to pay very little for the repairs. The name of the Insurance company I am talking about is called Bel Air Direct. So Mr. Judson Lee tells us he will get the work done by Christmas well it is now March and still we have not had repairs even started.

Now we contacted our Mortgage Company before we hired Mr. Lee to ask them if they could help us get through to this stubborn insurance adjuster and there company at was controlling the whole matter and asked them if they could write them a letter from there lawyers. They refused and said it is our insurance and they refuse to get involved as we pay our insurance. So now that we hired this Judson Lee this public adjuster he went to the mortgage company to sign there name off our mortgage and this insurance claim and he offered them $5000.00 to do this.

The name of this mortgage company is AMS Properties Charleton Building Credits P.O.Box 684 Station "B" London Ontario N6A 4Y4. Mr. George Czarnecki is principal owner of this mortgage company. He has up it to a lot more and also been very rude to us with threats to use this money instead of holding it for repairs he wants us to pay down the mortgage by $15000.00 we don't want to do this with our insurance money as we need all this money for our repairs.

This is our insurance and they refused to help us in the beginning and now it is a different story now that we are paying a lawyer and paying for our own public adjuster. To even find anyone to help us was very slim as public adjuster don't exist anymore as rights for the public has diminished in Canada it took us a month to even find anyone who knew of such a person. Unless if you have big money no one works against these insurance cases even lawyers are hard to find. Is this fair? No, I felt this is wrong that people are getting screwed out of funds to repair there homes so I continued my search.

I found a Government Agency that is to over see these greedy Mortgage Companies that make rules up along the way as we have no book of the rules they must follow by when we are buying a house we are not told these rules mortgage companies have power over you. If people were told I am sure they would think twice before buying a home in Canada and having to borrow from a mortgage company. They make it so they have rule and you have no protection and they will shut you down and win every time as you will be the looser. I had to take what I could get as I went bankrupt several years ago and they punish you by charging you 12% interest as you are looked at a high risk.

Only because the government is ripping me off and keeping me poor by having unfair taxes for truck drivers and little we can do about it. If I had a choice what I want to pay I would not have to go bankrupt I would have enough to pay my bills. But this government keep me poor so I get myself in debt force debt. Impossible to work any more hours as I work 104 hours a week already in the trucking industry that this government refuses to regulate so we can have a proper hourly wage.

As Banks won't even give us a loan as we do not have steady enough balances every week give there minds an hourly income. Well, with all this under handed working against people I have continued to work all my life and never been unemployed my whole 28 years and I pay my child support of two children on top of this. I work hard and I have never missed a payment on my mortgage ever.

I refuse to be railroaded by this mortgage company and this Mr. George Czarnecki and this insurance Company Bel Air Direct or this public adjuster working for these people not us. I contacted the government office support to be protecting the public from shady Mortgage company tactics. I spoke to a Mr. Bob Brown financial services commission of Ontario well every time I talk to this man he says he lost the file or he doesn't have it in front of him and passes the buck.

We were told by a lawyer that this office won't do anything. They get paid from our taxes to just do nothing. So we were told our complaint would be handled and looked at after they hear from the Mortgage company. Well, we had a copy of all letters sent to us from them so we read it to this Mr. Bob Brown and even said we would fax him a copy. Sure enough he refused and said that they really had nothing they could do for us. Oh great, we find out that there is just another office run by this government that just is put in place to do nothing for the public. I ask them to send me there mandate and what they intend to do about this. I am sure I know the answer to that but I hope I am wrong for a change.

So, as it stands, I will be talking to my lawyer further on this. Well, I would hope that these rip off exhausting experience will help others to avoid buying a home ever from a mortgage company like this and keep there name off of any document including your mortgage contract or print a clause in that they have no rights to insurance claims for damages and money will be given directly to yourself to do repairs as you seem fits your home. Also, that any other person holding any other mortgage cannot lay claim to these funds. People must learn to protect themselves from insurance companies also and have your own contract they must sign government should make it mandatory a choice be given to you up front not hidden as it is.

Replacement value is what it is not negotiable or changed by some adjuster. Loss of wages and time penalties for insurance companies causing delay time in doing repairs etc etc.. This is a warning to never trust what you see from others it is what they hid you have to worry about. Insurance companies like this and mortgage companies are only for the rich as poor working class can't fight an elephant with a bow and arrow.

The biggest rip off I have ever seen in my life and hope I never have to deal with this ever again. The stress has been enormous trying to drive a truck in traffic and worry about my home and family like this living in such dirt and filth all over our home and freezing in sub zero temperatures as the insurance company is to cheap to put us in a hotel till we get the house cleaned up. Well, I a very disappointed in this insurance company and this mortgage company and how this whole thing was handled or miss handled. Thank you for your time and this web site.
