What does the name AT&T mean to me?

Years ago, I gave permission to an Anti-Telemarketing website to post a program I had written called, ?The Anti-Telemarketing Program.?

The Anti-Telemarketing Program is a short documentary of my personal experiences with the AT&T Company.

It documents my personal experience with various Telemarketing Companies that do/did AT&T's dirty work.

It also documents the futility of writing complaint letters to the Better Business Bureau, State Attorney Generals, Federal Trade Commission, and to the Federal Communications Commission.

There are three things that you the reader can do.

1. You can patiently read my post and keep an open mind.

2. You the reader can do a little research and find out how many times AT&T has been fined for violating the Telemarketing laws.

3. You can also look up on this website and read about other peoples experience with AT&T? there not good!

After you do those three things, ask yourself? why did our Government and the FTC award AT&T the contract to maintain the National Do Not Call List?

Do you think anything has changed? Do you thing that AT&T has stopped their predatory telemarketing activities? Can a Leopard change its spots?

Ripoff report #174448 just screams out to me, ?Predatory Telemarketing!?

AT&T has changed there corporate address several times, they have also changed there name several times. As Leopards, AT&T has been trying hard to fool the public into thinking they are different, that they are better.

What does changing from AT&T to SBC to SBC AT&T really do? What does moving from New Jersey to New York, to Indianapolis to San Antonio really do?

(For the record, I have not kept track of all the name changes or address changes.)

Personally, I think that it helps to wipe the slate clean.

In other words, a lot of the past complaints seem to have disappeared.

Why am I re-posting the ?Anti-Telemarketing Program? on the rip-off report website? Please look at www.ripoffreport.com/reports/ripoff164273.htm and you will understand why!

You still don't understand why I am posting this? AT&T is trying to buy out Bell South. Chief executive officer Ed Whitacre is on record saying that he thinks that it would be a good idea to start charging Internet companies more fees. He wants to reserve Internet Bandwidth for his customers.

Charging Internet based websites additional fees is a bad idea in my book!

?The new company would be the country's largest phone company ? with nearly half of all lines. It also would be the largest cell-phone carrier and the largest provider of broadband Internet service.?

What happens if he doesn't like a website?

What does this mean? If AT&T doesn't like a website or if a website doesn't pay a ?Premium Access Fee,? they will be able to limit the number of visitors? In other words sites like this one could be harder to visit.

AT&T Violates Telemarketing Act

(How to Get Rid of Junk Mail, Spam, and Telemarketers)

For years, US telephone company AT&T called me repeatedly against my request to be deleted from their telemarketing lists, in direct violation of the 1991 Telemarketing Act. Unfortunately, I did not log their calls nor did I attempt to collect damages. However, because of their telemarketing practices, I will never become an AT&T customer, and I can only recommend that others do not do business with AT&T.

Unfortunately, AT&T has gotten around USC 47 by subcontracting with hundreds of "independent" telemarketing companies (most of whom are shell entities created by AT&T yet legally operating independently and unaffiliated), each of which has the same lead list - so you get solicited even more, by different companies, and you can't nail AT&T because there is no provision in the Telemarketing Act pertaining to the entity being advertised as being responsible for the solicitation activities. (Thanks to Mike for this perspective.)

AT&T is still violating the law. The following letter fully documents the experience ****** *** had with AT&T. ****** has taken the time to follow through on AT&T's unprofessional practices, and to provide a copy of the following letter of complaint. I would encourage you to review the letter, as it contains a substantial amount of information you might want to use if you, too, are harassed by AT&T.

The companies listed above are divisions of, or are contracted with AT&T Corporation.

I have been receiving repeated and harassing telemarketing calls from, and on the behalf of, the companies listed above. Despite repeated requests to place my phone number on a do not call list, I have received numerous calls from AT&T over the past six months. This past week alone, I have received five phone calls. This is harassment and violates the 1991 Telemarketing Act.

It should be stressed that every time I have received a call from a telemarketer, I request that the name and number called, is to be placed on a do not call list.

AT&T Card Services employee's Tammy, Heather and Supervisor Cindy Pennanen clearly stated and refused to place my phone number on a do not call list. This is a blatant violation of the Telemarketing Act.

AT&T World Net Services employee's Ran and Supervisor Chris refused to identify themselves, gave fictitious information and ID numbers, refused to provided company addresses and phone numbers and failed to place my phone number on a do not call list. AT&T World Net Services Duty Manager Michelle and Manager Clyde Haggart confirm that some of this is the division policy for so called security reasons. Not only does this policy prevent identification of rude employee's, it is a violation of the Telemarketing Act.

Telemarketing company Reese Brothers is calling for, and on the behalf of, and represented themselves as AT&T. I was able to trace this company through the Internet and I have informed Reese Brother employee's James, Bill, Sharon and Susan to place my phone number on a do not call list. I have informed Reese Brothers supervisors Renee Phillips, Cary Chips and Susan Painter to do the same. I have also left messages with Reese managers Katrina Mainor, Linda Manfredi, Curtis Weidrin, Patrick Farley and Barry Reeserequesting that this number be placed on a do not call list. Reese Brother employees failed to identify the Telemarketing Company they worked for, (I over heard the company name in the background). Reese Brother employees failed to provide their companies phone number and address. Reese Brothers made repeated telemarketing calls to my home. This is a violation of the Telemarketing Act.

Telemarketing Company Western Telemarketing is calling for, and on the behalf of, and represented them selves as AT&T. Again, I was able to trace this company through the Internet. Western Telemarketing is violating the Telemarketing Act by refusing to identify them selves or provide their company's address and phone number. Western Telemarketing employee Kristen Herandez refused to place my number on a do not call list and shouted her sales pitch over my request to stop calling. After tracing Western Telemarketing's phone number and address and contacting the company. Their phone operators made it clear to me that they were very upset that Kristen Herandez violated their company's policy by identifying herself and the company's name to me. Her supervisor, Mr. Rob #104 and division manager Rod Bennett have been uncooperative with me. I have informed Western Telemarketing CEO Gary West to place my phone number on a do not call list. Western Telemarketing is in violation of the Telemarketing Act.

During the past six months, I learned from AT&T, that they contract with over 350 Telemarketing companies. If Reese Brothers and Western Telemarketing's conduct and actions are typical of AT&T contractors,(it is), then a serious problem exists and should be dealt with immediately. It would be ridiculous and unreasonable to expect a private citizen like myself, to inform each company to place my phone number on a "DO NOT CALL" list. Asking for my phone number to be placed on a "DO NOT CALL" list does not work with AT&T contractors, the calls have continued. Hanging up on them does not work either.

Calling the AT&T Corporation, (as required by AT&T and its contractors), and making the request for my number to be placed on a "DO NOT CALL" list does not work. My request is not passed on to the other AT&T divisions. AT&T even has the audacity to say that they have so many Telemarketing company's working for them, that they can not guarantee that I will not be called back. The 1991 Telemarketing Act Sections310.4 (A)(1), (b), and (b)(1)(ii) do not mention anything about guarantees, but it does say they are not to call back. The Telephone Consumer Protection Act Sec 47 USC, 227 and 47 CFR Section 64.1200 also says the companies are not to call back.

I demand that the AT&T Universal Card Company, AT&T Phone Company, Reese Brothers and Western Telemarketing their representatives, agents and companies that call on their behalf, comply with my request and comply with the laws regulating telemarketers by placing my phone number on a do not call list. They are not to make any telemarketing calls for any company to anyone at my phone number. My number is not to be given out to any telemarketing firm or by any of the companies listed in this complaint letter.

Because of the Internet and close contact with family, I have discovered that my complaint is not an isolated incident. This has also happened to other people. I am shocked and outraged to learn that a corporation like AT&T would resort to such tactics, or tolerate such poor behavior from its employee's, representatives and contractors.

My wife and I are AT&T customers, why should we be treated this way?

As of July 23, 1997 the following responses to my complaint letter had occurred.

Nebraska Attorney General Don Stenbergs office stated that they did not have the authority to enforce any telemarketing laws and would not help. I feel sorry for the citizens of Nebraska for voting in such a weak politician. Ohio, Florida and the Pennsylvania Attorney Generals have turned my complaint over to the consumer mediator five weeks ago, I have not heard anything from them since. This does show that the private citizen has very few options when dealing with illegal Telemarketing activities. They have refused to provide me with a copy of their "do not call policy" and have not sent confirmation to me that my phone number was placed on their do not call list. West TeleServices Corporation employee Emily N. Herrick sent a letter claiming that she was vice-president of Client Services for AT&T, Emily then claimed that she was not with AT&T. Call her and ask which company she works for and why her company has yet to send me the required information. You can reach her at (800) 572-0626. Her boss, Gary West, claims that some of the people that I have named in my letter do not work for his company. I would hope that people would call his company and ask why his employees would lie about their identity.

Complaints to the Better Business Bureau have as usual been a waste of time. The BBB's in New York, New Jersey, Pennsylvania and Ohio have refused to answer my complaint letters. The BBB in Nebraska wrote only one letter to Gary West, President & CEO of Western Telemarketing and then sent me a letter that was five days past their ten day limit that would keep my complaint active. The BBB in Florida wrote to AT&T Universal Card Services and has ignored my additional letters. Complaint letters about the BBB's lack of service should be sent to:

Dealing with illegal telemarketing activities is an upward battle. The citizens of this country will not receive any help from the State Attorney Generals, Better Business Bureaus or from the Federal Government. You will be on your own.

The Anti-Telemarketing Program

(How to Get Rid of Junk Mail, Spam, and Telemarketers)

This is a program - a recommended procedure. It is not legal advice.

Some general rules and statements that I believe in and follow:

1. I will always win if I keep my cool and stay level headed.

2. I will never lose my temper, yell, scream or threaten a Telemarketer. If I do yell, scream etc. They win.

3. Most people are not aware that the Telemarketer may be recording the conversation. This is their proof that a sale was made. However, phone calls should not recorded unless the person agrees to buy a product, and permission should be asked to record the call.

4. The recorded conversations could be used as training aids for Telemarketers, although this is not usually done because recorded calls contain confidential information.

5. I never make threats in any letter or phone conversation that I initiate.

6. I will get as much information from them as I can before requesting to be placed on a, "DO NOT CALL LIST."

7. I need to know the name, phone number and address of the company they are representing. Note that telemarketers will probably not give you their exact location.

8. I need to know what is the service or product they are trying to sell me.

9. I need to know what is the name, address and phone number of the Telemarketing firm calling me.

10. I also need to know what is the name of the person calling and who is their boss.

11. Some telemarketers may use fictitious names for so called security reasons. Some telemarketing companies will use this fact to make the claim that the person I named has never worked for their company, as an attempt to discredit my complaint.

12. I will never provide a Telemarketer with any information about me.

13. I will never give out Credit Card numbers to any Telemarketer or caller.

14. I will never confirm or deny that they have reached the person requested.

15. I will always state, "You will place the name and number called on your DO NOT CALL LIST." The telemarketer will then direct the company they are representing to delete you from their calling list.

16. I will make a follow up phone complaint to the company being represented.

Generic Master Complaint Letter

I have a "Generic Master Complaint Letter," that can be used for all Telemarketing calls. This letter is customized for the specific Telemarketer and for the company being represented. It also serves as a record of my reasonable attempts to have the harassing calls stopped. The following points in my letter are made.

1. Date and time I received the call.

2. They are to place my wife's and my names, and our phone numbers, on a "DO NOT CALL LIST."

3. They must send me a copy of their "DO NOT CALL POLICY."

4. They must send confirmation that our names and phone number has been placed on their do not call list.

5. They are not to call this phone number and ask to speak with any other person.

6. The letter will include a brief statement to the affect that I will not do business with or recommend them, etc.

7. I will contact the company they are representing and file a complaint.

8. Any future violations of the Telemarketing Act by their company will not be appreciated.

9. I reserve the right to post a copy of this letter on the Internet.

10. This letter is being sent to all appropriate agencies.

11. The company's named must not forward my address or phone number to any company involved in phone or mail solicitations.

12. I reserve the right to pursue all legal options.

13. The statement, "All we want is to be left alone."

14. I emphasize that I found the Telemarketing calls to be, "Rude and unprofessional."

15. They are not to call on the behalf of any other company.

16. A reference number for the letter is always used.

17. A copy of the letter is always kept.

I use this Master Complaint Letter for all correspondence when dealing with the Telemarketer and the company being represented. The letter is also modified to file formal complaints with the appropriate Better Business Bureaus, State Attorney Generals, Federal Trade Commission and Federal Communications Commission. This method cuts my paperwork and time down to a reasonable period. Another advantage is that the complaint is consistent with all groups.

When possible, after I receive the first Telemarketing call, the following actions are taken.

1. I follow the general rules and statements listed above.

2. I will call the company and file a verbal complaint. (I read the letter that will be sent to them.)

3. I will send a complaint letter to the Telemarketer. The Generic Master Complaint Letter is used for this. This letter is modified for the situation.

4. I send the same complaint letter to the company being represented.

If the companies involved violate the Telemarketing Act and my privacy by calling back, I take the following action.

1. I follow the general rules and statements listed above.

2. I will call the company being represented and file additional verbal complaints. (I read the new letter to them before mailing it.)

3. I send a modified complaint letter to the Telemarketer.

4. I send the same complaint letter to the company being represented.

5. I send a copy to the Better Business Bureau. Copies of the complaint are also sent to the State Attorney General, Federal Trade Commission and Federal Communications Commission.

6. I make follow up calls to the company being represented by the Telemarketer.

You Should Know About

From my experience, the following is information that people should know about the Better Business Bureau, State Attorney Generals, Direct Marketing Association, Federal Trade Commission and Federal Communication Commission.

The Better Business Bureau

1. In my experience, the Better Business Bureau is worthless for the consumer. The BBB will send you a follow up letter to your complaint with a time limit. They will do this every time you respond. Failure to meet the BBB's time limit will result in your complaint being listed as resolved. Failure to respond to the BBB will also result in your complaint being listed as resolved.

2. You can only make one complaint against the company, regardless what that company does or how often they do it.

3. Never allow the BBB to mediate a dispute, the odds of a favorable judgment in my opinion, are against you. Case in point, what is the BBB's mediation record with new car owners who file a complaint with the manufacturer or dealer? Compare this record with States that run their mediation program, why is there such a huge difference? Why do car manufactures recommend the BBB for resolving disputes? The consumer should do some very careful research before relying on the BBB for anything.

4. All of my correspondence with the BBB is for the record only. I do not expect anything from this over rated group. My cover letters to the BBB include the statements that, "The BBB is developing a nation wide reputation as a organization that favors businesses." "That I do not appreciate time limits being placed on my complaint and unless I write in stating otherwise, this complaint should be listed as unresolved."

The State Attorney Generals

1. My experience shows that you will be very lucky to get a response from the Attorney Generals when filing complaints against Telemarketers. Case in point, the New York and New Jersey Attorney Generals have never responded to my complaint letters.

2. The Direct Marketing Association makes political contributions to Democrats and Republicans, what makes you think that the Attorney Generals will bite the hand that feeds them?

3. Your complaint, regardless of the facts and details will be turned over to a consumer mediator.

4. Check out your Attorney Generals track record with complaints against Telemarketers. Look at the Texas State Attorney Generals website and see how many complaints he gets each year. Dan Morales might as well as post a sign that says. "Telemarketers are welcomed and should have no fear."

5. When the Attorney Generals do respond, they will refer you to the Federal Trade Commission and Federal Communications Commission.

The Direct Marketing Association

1. The BBB's and State Attorney Generals will suggest that you contact the Direct Marketers Association and request to be placed on their DMA list. Stay away from the Direct Marketers Association and its DMA list. Ask yourself, do you really want to give your name, address and phone number to direct marketers?

The Federal Trade Commission and Federal Communications Commission

1. If you do your research, you will find that the FTC and FCC track record with Telemarketers is poor. Basically, your on your own.

2. The FTC and FCC will send you pamphlets explaining your options and suggest that you file a complaint with your trusty State Attorney General.

Junk Mail

Information that I would like to pass on dealing with Junk Mail:

1. If you receive any junk mail that includes a "No Postage Necessary If Mailed In The United States," envelope. Do not panic. I take all of their junk solicitations, tear it up and mail it back to them using there pre-paid envelopes.

2. I also recommend finding other junk to stuff in their envelope. Why fill up your local landfill with their unwanted junk mail when you can mail it back to them, and more, at their expense. Why not fill up their landfill?

3. Some people write obnoxious messages on their return envelope like, "Only idiots do business with this company," etc.

By following these basic rules, you will have the satisfaction of increasing their mailing and disposal costs.

Letter to send to telemarketers

To whom it may concern,

Over the past several years, your company has called my home numerous times. We have repeatedly requested that our phone number be placed on your DNC list. Your company has failed too comply with Federal rules, regulations, and laws concerning this matter.

It is estimated that over ten thousand telemarketers in this country are engaged exclusively in fraud. Telemarketers are no different from terrorists; both have destroyed lives and caused immeasurable pain and suffering. For this reason, we will not do business, or recommend any business that engages in telemarketing.

Do not call my home again. You are to place my phone number on your Do Not Call List as required by federal law. If your company makes phone solicitations for other firms, my phone number is to be placed on their Do Not Call Lists as well. Furthermore, you are to mail your Do Not Call Policy to my address, as required by federal law.

Failure to comply with the Telemarketing Act may result in complaints being filed with the Better Business Bureau and State Attorney General in the state that you operate. Additional complaints would be filed with the Federal Trade Commission and Federal Communications Commission, whose regulations are, in my considered opinion, being violated. Additional legal action would be considered as well.

There never has been, nor will there ever be, a legitimate telemarketing phone call.

Additional Tips

Additional action that can and should be taken include:

1. Never, never, never provide your name on your personal telephone answering machine. The only message that should be provided is, "You have reached, (provide phone number), at the tone, please leave your name and number and I will return your call."

2. Write a letter to the Credit Bureaus requesting that your name, address and phone number not be provided to direct marketers, etc.

3. Avoid using 800 numbers from your home. Why provide a company with a record of your phone number? Call from a pay phone. Always provide a fake phone number to the business.

4. Do not allow a company to call you back. What they really want is your phone number.

5. Never enter contests that require your phone number. This is one of many ways, that the Telemarketers use to get your name address and phone number. Remember, there is no such thing as a "Free 18'X20' Photo" or "Exotic Trip." (I know of several people who love these fake contest gimmicks. They sign up her ex-spouses for them all the time.)

6. Never give out your real address and phone number to a company. For example, a local computer store near my home, "Micro Center," always asks for my address, phone etc. It is none of their business and I will give out a fictitious address and phone number when making cash or credit card purchases.

7. Never pay for anything using a personal check, it has your address and phone number on it and the stores will use this information to put you on their marketing lists.

8. When paying bills by mail, ink out your phone number on any personal check used before mailing it.

9. Never use a "Debit Card."

Please keep in mind that what I wrote is not legal advice. It is only a suggestion and you will have to modify what I wrote, that you will have to customize it to your unique situation.

All I tried to do was give you an idea of what is going on. It is a starting point for you, nothing more.

Why didn't I file a lawsuit? Lawsuits cost money? even lawsuits filed in small claims court.

Prior to writing the first complaint letter, I never kept track of the telemarketing calls. By the time I wrote the Anti-Telemarketing Program, I was keeping track of the calls. Yes, I had/have a very clear case and would win. Yes, I know all about what the laws say concerning Telemarketing. Yes, I would have won double and triple damages? I know all that.

So why didn't I file a lawsuit? Again, it costs money.

Here is what you don't understand? Let's say that I filed out all the paperwork to file a small claims suit. First obstacle is convincing the clerk that it can be filed in small claims? it is a federal law, not a state law, so most clerks would argue that I need to file in federal court. They will mistakenly claim that the small claims does not have jurisdiction. You have to politely suggest to the clerk that it is up to the judge too determine that? not the clerk.

Next point, OK so I win? big deal. How am I going to collect? Yes, a lot of you may have seen the local TV news stories of local people who filed lawsuits against telemarketers and won Ten-thousand, Twenty-thousand or Thirty-thousand dollars? Channel Nine top story, ?Stop Telemarketing Calls to Your Home!? It was a nice dramatic story that had no meaning? how come they never showed an actual check?

How come they never said, ?Yes, the bad telemarketer promptly sent me a check and I cashed it!?

Congress loves to pass laws that do nothing and are never enforced. The FTC loves to pass regulations that do nothing and are never enforced, as does the FCC.

I think a better question is why didn't the Attorney General's do their jobs? Before you find fault with my lack of action, keep in mind that the same laws stated that the Attorney Generals have jurisdiction and can file lawsuits as well?

Once again, I ask that you do three things.

1. You can patiently read my post and keep an open mind.

2. You the reader can do a little research and find out how many times AT&T has been fined for violating the Telemarketing laws.

3. You can also look up on this website and read about other peoples experience with AT&T.

After you do those three things, ask yourself? why did our Government and the FTC award AT&T the contract to maintain the National Do Not Call List?

Do you think anything has changed? Do you thing that AT&T has stopped their predatory telemarketing activities? Can a Leopard change its spots?

(Ripoff reports #174448 just screams, ?Predatory Telemarketing!? Both #174448 & #164273 show that there are serious problems with this company and nothing will be done about it.)

Why am I re-posting the ?Anti-Telemarketing Program? on the rip-off report website? Please, just think about it for awhile, give it some time and I am confident that you will understand why!

Some additional points that you may want to consider. Why do they write their contracts using fonts that are so small you need a magnifying glass to read it?

Why do they insist on a third party arbitrator of their choosing?

Why do they use telemarketing calls?

What will happen if AT&T buys Bellsouth?

You now know what the name, ?AT&T? means to me!

Stacy, If you made it this far then I would say you will do just fine. You have the first third of clues on your post. The other third is with the other links. The final third is found here. I wish it was easier You just have to find your own style. I just hope that what I provided gives you a major head start. If you find yourself coming back to this page, then what that is telling you; you have missed something important. John, Are you in Law Enforcement? Wow! That is pretty good so close. OK I give you a clue and you don't have to re-read this or bother trying to figure it out, it will not be that important to you. Clue: Ma Bell is broken up by the feds. Ma Bell forms new divisions. Ma Bells new divisions are spread across the country. (We are not talking about the Baby Bells.) Ma Bell gets sold, bought, purchased, renamed and now wants to buy a Baby Bell. A Leopard is a Leopard is a Leopard what is so special about? The question is the answer! Your right it is so long, in fact, it is really long and could have been presented a lot better. I tried to read all of the original post, but it was sooo looong. This may have been addressed, but... From what I understand, Cingular (owned by SBC and BellSouth) purchased AT&T Wireless. SBC purchased the rest of AT&T, but kept the name because of it's worldwide recognition factor. Therefore, the name is the same but it IS a different company. A leopard cannot change it's spots, but we may be talking about 2 different animals here. Now the new AT&T wants to purchse BellSouth. How confusing is THAT? lol
