"Earned vacation pay, commissions, and bonuses cannot be forfeited unless the employer has a written forfeiture clause in its vacation, commission, or bonus policy or termination policy pursuant to N.C.G.S. 95-25.13(2) of the WHA. Keep in mind that vacation pay, commissions, or bonuses have to be earned, regardless if a verbal promise or a written policy, before an employer has to pay them at all. Also, even if there is a written policy that has a written forfeiture clause, an employee may still be due the earned vacation pay, commissions, or bonuses at termination. It all depends on the language of the forfeiture clause and the reason/s the employee's employment was discontinued, and if the reason/s meet the criteria in the written forfeiture clause"
That should help your case some. In North Carolina your employer must pay you any bonuses due when you are terminated from a job.
UNLESS they have a written policy that they will not pay bonuses to terminated employees. Was there a policy in your employee handbook that had a clause to not let them pay you? Do you have written proof that this bonus is due to you? If you have the proof and they don't have a clause, you can file in small claims court for the money.

I recently made a report against Auntie Anne's store #NC117, which was my former job. Just this Saturday, I had a meeting with my manager Kerry Johnson and the district manager Eric Bianchi. The meeting was pretty much straight forward and I signed the papers to let this job go, it was too much unnecessary stress for me anyway. However, I had received a 100% for a mystery shop back in June and I had been questioning both Kerry and Eric about when I would be able to receive my reward of the promised $100.
At the end of our meeting Saturday I questioned Eric about receiving my $100 and he stated that he would have to be discussed with Moe because he wasn't sure. This shop was back in June and I should have been rewarded my $100 but as usual you can't get in contact with Eric for anything so it has been put off. I feel that although I no longer work for this company, I should still be allowed to receive my reward because this was promised before this incident happened. Eric told me that he would get back with me about it on Monday (which would be today) and I haven't heard from him yet. I do plan to take legal action if I am denied my promised money. I have been put through too much with this company so I feel like the least they could do is still provide my promised reward.
