Subject was hired and paid by check number 1693 in the amount of $500 on specified date. Amount paid was inclusive of materials and labor. Subject purchased materials and constructed windows on site, and proceeded to install one window within a week check.

Subject is related to (brother-in-law), and employs Jason Davis, who was a tenant at the property. This is documented.

Repeated attempts were made to arrange for completion of said work. Phone conversations and meetings scheduled resulted in no appearance by subject.

Work was not completed, and subject claimed that he could not enter property to complete work. This was denied by Mr. Davis. During this period, Mr. Davis was appearantly released of employment with B & D Remodeling.

Mr Davis removed the three remaining pre-made Glass Block windows on or about March 22nd. A police report was filed with Columbus Police.

In all subsequent attempts to have work completed, subject acknoledged that Mr. Davis had possession of said windows, and that he was 'trying to meet up with him, but he never showed'.

During a call on April 1st, 2004, I explained that the check written for $500 was given for a service to be rendered, and that the funds from that check 'put food on the table for his family'. I additionally stated that the $500 was removed from my ability to provide for my family. In a very appropriate way, I made my best effort to explain that this situation had caused a burden, a hardship, and needed to be resolved. He declined, and actually responded with unexpected anger when I indicated that I would file a small claims suit to recover the funds if the situation was not resolved by April 12th, 2004

In this final call to resolve this issue or face a small claims suit, subject responded with highly abbraisive language, threatened harm, and stated "You aint ever going to get yer f***in' windows in now, you b***h!". At this point, he yelled not to contact him again, said Good-bye, and hung up the phone.

I hope you have a clearly WRITTEN and signed CONTRACT stating all of the specifics to prove your case. Otherwise, going to court will do you no good. Also,I have to ask, does your boss pay you in advance for doing your work? That's very unlikely. Then WHY did you think it wise and necessary to pay this man in full in advance. You were begging for trouble by doing so. If it makes you feel any better, thousands are scammed every year because they pay in advance and don't have a proper written contract.
