In June 2005 we bought 2 boilers in an ebay auction from Bay State Machinery Sales Inc for $7000 dollars. Both equipment were located in a factory in Woonsocket, RI. The seller would disconnect the boilers and load it to our trucks. But after Hurricane Katrina, transit of heavy stuff was difficult. Since the boilers were heading to South Texas, it was hard to move around so the operation was delayed. This was accorded with the seller.

In December 2005 we were ready to proceed and the truckers were waiting the signal to load boilers. But the seller start making excuses that the weather was very harsh and it was not possible to get a crane to do the job.

This was a F.O.B. Sale. But according to the seller we needed to pay all the expenses for the contractors, the cranes, etc. We paid $5,670 dollars for preparations, cranes, labor.

After that the seller never returned the calls or emails. From time to time he wrote back with a bunch of excuses. He backed up and said that we need to hire our own crew to do the job. He never refund the $5670 and said we lose that amount because the landlord was charging storage. We hire a contractor to do the job but he never allowed us to do the job. His excuses were from problems with the power lines in the factory to insurance requirements.

We were very frustrated with this, since it had passed a year since the payment. We decided to make a visit. When we arrived unanounced to his doorsteps he acted very nervous and told us that he was about to call us because the landlord was finally let us take the boilers. But after the meeting he never returned our phone calls and was anywhere to be found.

We were there with contractors ready to do the job but he hided from us. We went back to Texas and he write with some tragic story why he didnt show up. He always give excuses when we make arrangemnts, and delays everything two or three months. He says that its not his fault, and blame the landord. Well, he was the one that sell the equipment and the one we paid in full.

He deserves to go to jail. We are starting to take legal action.
