On February 1, 2004 we signed contracts to take delivery of the RV, accessories, Warranties, and other miscellaneous fees for $44,872.

A down payment of $5,000 was placed towards the purchase price leaving a balance of $39,872 that was financed with Bank of the West at a rate of 5.99% for a term of 15 years, with payment of $336.00 per month.

This purchase was represented by the General Manager Mark Nunzio as being purchased for $200 over the Dealer Invoice (wholesale cost) from the Beaudry Mesa.

We took delivery on the unit on February 16, 2004. The dealer said that did a thorough Pre-Delivery Inspection of the unit I will refer this as now the PDI. Of which they charged the manufacturer back several hours for that service.

With the main unit purchase we bought various warranties because we did not want to have to deal with headaches and expenses of repairs, these warranties were the :

Good Sam Continued Service Plan

Pro-Pak/Perma-Plate Paint and Interior Protection

Road-Shield Emergency Road Side Assistance and Tire Warranties.

These warranties cost us $3800.00, and were represented as a full protection to cover us for anything that may go wrong with the unit during the terms of the coverage's, ranging from 5-7 years.

We also then immediately secured a covered storage unit to protect the unit while not in use at A-Secured Storage in Chandler, AZ for $74.99 month. Covered Storage was chosen to keep unit out of hot sun to prevent damage and deterioration to the units interior and exterior.

We were also given specifics upon delivery of the unit that when the unit is planned to not be in use it is advised to keep a bucket of water in the inside for it to evaporate and keep the interior humidified, as well as treat the interior wood with something similar to Murphy's Oil Soap, this would keep the wood in the interior from deterioating and cracking from the dryness.

Since the purchase in February (7 months) the unit has been out of service (or in service at Beaudry) for a catalog of defects its nearly laugable, that is of more than 5 months long.

1. On the units maiden voyage over the weekend of February 27-29, 2004 upon arrival that Friday evening we came to find the generator would not stay running. It ran for about 15 minutes then shut down, and would no longer start and stay running for more than a few seconds. The temperature outside got down to around 40 degrees, and because we had no power we had no heat. My father got extremely ill because of being forced to sleep in this condition.

We had 12 volt power, which would have run the heater but choose not to in fear of not having a charging system and running the units and tow vehicles batteries dead and being stuck and no way to start the vehicle. On Saturday morning we called Beaudry and after several hours of arguing with them on the phone they finally agreed to deploy mobile technician from the next closest town, who came out and after spending about 2 hours came to the conclusion that the problem was internal to the generator and could not be repaired on-site. We arrived back in town on Sunday evening, and immediately took the unit over to Beaudry where it took them 2 weeks to fix the unit. Upon their repair work they also scratched the cover of the generator.

2. The shower leaks in two spots, one in front and one that somehow gets into the lower storage areas. These have been reported to Beaudry for repair, but the problems persist. This should have been caught by the PDI.

3. Foam sealant is missing around fresh water tank inlet, and creates a vibrating noise. This should have been caught by the PDI.

4. Broken drawer runner, and interior trim is missing. This should have been caught by PDI, and has been reported to Beaudry for repair numerous times.

5. A 110 volt plug under sink that goes to the water heater was never plugged in, we could not figure out why we could not get quick hot water, once we plugged it in hot water was excellent, this should have been caught by the PDI process.

6. On last repair a door was replaced without our knowledge, but while installing the door they not only did a terrible job at the install, they scuffed the door in the process. Because of the terrible install job now the door binds upon opening and closing it.

7. We have yet to receive the Pro-Pak services in complete, they have attempted to do this 3 times now and can not seem to get it done correctly. On the last attempt we made specific markings in key places that would have to have been removed had they actually done the work, upon picking it up those marks were still intact.

8. Isolation problem in water lines, while the water pump runs creates a loud jackhammer sound throughout the unit. This should have been caught during PDI, and has been reported numerous times to Beaudry.

9. Main Slider Unit now pops and grinds as its being used, this started after that last repair work.

10. Fire-Hazard exists as the fueling station still leaks raw gas, they have attempted to repair this 2 times. This leaked from the get go, and should have been caught during PDI.

11. Awning and mounting system still not functioning correctly after they supposedly repaired it, in addition their repair work is extremely poor.

12. Inside wood is drying out because the unit sat un-maintained at their location for repair, they don't follow their own recommendations of keeping the interior humidified while in storage.

13. New batteries left to run down during the repair thus shortening the life by 50%, we invested $100 in a extended life battery setup just for them to ruin it by not keeping it charged while at their site during repair.

14. Both door stops ruined during the repair processes while on their site.

15. Two tires have disintegrated, and the other two were damaged beyond usability due to what seems to be a frame issue or alignment problem, or faulty tires. The first two could have been caught and repaired during a proper PDI. When these tires disintegrated they caused major body damage, and blown holes in the bottom of the unit that you can now see up inside the unit now. Because this happened during rain now the unit has sustained massive water damage.

16. The main separating wall between the garage area and living area is showing signs of moving nearly inch.

17. Because of water damage from tires blowing a 110v plug had been deemed unusable and a hazard that we are afraid to use.

18. The Road Shield tire package was not all Beaudry represented it as, so far to date we have had $736.37 out of pocket expenses due to uncovered tire failures by having to purchase new tires and roadside assistance services. Let alone the Road Shield is supposed to offer 24 Hour assistance, however it has been found that they can only be reached during M-F / 8-5 business hours. This package cost us $500.00

19. There is various trim places in the garage area that is coming loose or bowed.

20. There is a major water leak that has caused damage to personal property stored below, from the shower drain area, which when taking a show will fill a 4 gallon buck in a matter of minutes.

21. The A/C circuit breaker continues to occasionally blow, we feel this is due to water damage in wires and there is a potential short involved.

22. The unit has received numerous scratches and dings while in service at Beaudry.

23. Misleading statement by Beaudry Service employees as to when the unit would be done. They also told us that on many occasions they were waiting for parts, we bought this explanation the first time, but when we called Four Winds (Dutchmen) we found out that this was untrue and that Beaudry had never even contacted them to order parts, and the parts were there and ready to be shipped.

24. Very rude statements made to us by Beaudry Service employees such as Oh, you again.. what now

25. We were promised like new detail by Beaudry employees because of the trouble, however have yet to receive this like new detail

26. Unit is still missing parts that we were told on delivery would be delivered soon those being: spare tire, and a ramp piece for rear fold down door.

27. We have also asked on numerous occasions to get copies of the service orders that we were supposed to have gotten upon each repair request, they have yet to produce this documentation.

28. Literally in each of the 4 times we have been able to use the unit something or many things have happened that required the unit to be returned to the dealer for service.

29. The unit has spent more than 5 months of the 7 months that we have owned it in shop for repairs, and 1.5 of the months it has sat unusable at the storage center because of Beaudry's inability to fix the unit properly.

30. Each time the unit went in for service, it came back damaged and in worse condition that what it was left with them.

Negotiation Attempts -

Over the past several months we have attempted to make various levels of negotiations with the dealer to bring this to a peaceful closing.

1. 100% Refund of our money, minus the cost of the installed hitch and brake controller, plus any interest fees that we have paid on the loan.

2. They offered to us replacement 2005 Weekend Warrior CL4005 unit for wholesale price of $40,000 by Merv the sales manager in Tucson however that deal was quashed by dealership management, and they then wanted us to pay $13,000 just to give them back a faulty unit.

3. We offered a third a final settlement that was also rejected because they felt it was unfair, it basically involved reimbursing us for our lost usage monthly payments, license fees, and storage fees, it was only about $5500.

4. On August 27, 2004 a phone call was received from Beaudry's attorney Mike Murphy, for a settlement of $2104.00, but in return I must sign confidentiality, settlement, and gag orders, as well as remove my information website that I created on that matter and retract and public posts made in regards to this case. He also mentioned that Beadury would no longer service us or the replacement unit, nor help with the transfer paperwork. Obviously we rejected that offer because we would have a unit that could not be serviced by the selling dealer, and would have to goto a dealer that is not "certifed" by the builder for service.

We have been told that on many occasions that this sort of experience is to be expected on a new RV. Respectfully, we feel that statement is a yet another insult, and its like if one purchased a new vehicle, and the steering wheel falls of, the transmission fails, the brakes go out, and air conditioning works intermittently, its just to be expected. While perhaps in isolation there might be some apology for the odd problem, but this string of defects is so significant that we are justified under the not-so well known for relief under the A.R.S. 47-2608 Revocation of Acceptance, A.R.S. 47-2313 Express Warranties by affirmation, promise, description or sample, A.R.S. 47-2315 Implied Warranty, fitness for particular purpose sections of the Uniform Commercial Code.

In addition to the dealers mismanagement of the problems, and failed attempts to repair, we feel that a large majority of the problem could have been prevented had Beaudry done a proper PDI. However Beaudry continues to assert that all the problems are none of their doings, and is attempting to push it off on the manufacturer. This is not fair to the manufacturer Director of Quality Bob Ries has stated that They are not confident that Beaudry is capable of making the repairs correctly

At this point we have revoked our acceptance of the unit, and it looks like this may end up in court... but given the law is on our side, and the string of defects this should be a no brainer to win... and we will be able to collect our attorneys fees...

We put $29,000 down on a Rv at Beaudry Rv. Now this is not a
10.00 deposit or chump change, we are talking twenty nine thousand dollars
of our hard earned retirement savings for Beaudry RV to hold a RV for us
upon qualifying for a loan. They told us if we didn't qualify we would get
a full refund.



So they took the application and our money. We did not
qualify for the loan and three weeks after the money was given to them -
they SOLD the RV! They said they could put us in a newer model but it
would cost us more! What a bunch of thieves. Now on top of everything,
they will not give back our money. We now have traveled back to Arizona to
file a criminal complaint and we have to get a attorney and try to sue
them for our money because they won't even talk to us or return our
telephone calls, please help us.

I USED to be an employee there. i cant reveal my name since i stand out-and that is al i can say about me. I sold a brand new unit (towable) to a GREAT couple. later on they came back with a problem about the unit they already took possession of. i told the manager at the time i have a customer with a problem about unit purchased. What i was told was basically that it was their problem and that i should not waste time on them and to go outside and grab another sale. I refused and instead took the couple into an office and with a closed door i proceeded to call on speaker phone to company custmer service; the fianance office; the insurance; the maufacturer of the item. i let the new owner talk to them freely after i explained what this was about who who i was--i gave my name and didnt hide that there was a REAL problem here. they were given the run around. the man was VERY upset, but he and his wife thanked me very much for the effort. Before that i really thought i was working for honest clean outfit. that was before. The unit was BRAND NEW, i even remember what it looked like inside as it was before posession. The beaudry company supposedly check and re-check every connection and hinge on the unit before they bring it to you to take . BUT THAT IS FAULSE! THE BRAND NEW UNIT PIPES TOTALLY BURST AND THE ENTIRE FLOOR WAS SAGGING BECAUSE OF FAULTY PIPE CONNECTIONS--WHICH I BLAME BEAUDRY RV TOTALLY FOR-SINCE THEY ARE SUPPOSED TO (THEY TELL YOU THIS IN SALES CLASS) CHECK AND RECECK EVERY UNIT AS IT COMES, AND BEFORE IT LEAVES WITH THE NEW OWNER. Alot as happened since then, they give sales a list of endless amounts of names numbers and addresses of each person who ever filled out a card, to get them to come see our "new sale". during one of those calls an older man really took his time to colorfully describe to me how beaudry RV failed him and why he would never buy a tire from "us" again. i kept that call info to myself. Its really sad that true customer service with CARE is a thing of the past. i see that everywhere-even in very reputable restraunts. I cant list my number for obvious reasons. if you rebut to me, ill see a notice and i will log on for it, maybe somehow we can manage to meet in person without having my name on google.

I would like to bring this to closure. That is the reason for the meeting. If you cannot make the meeting times, then I will provide you with other alternatives. Any meeting will take place at Beaudry RV Mesa. Do you need me to come up with alternative dates for me and Mr. Holman to drive up from Tucson?

Just to let you know, I have received a call back from my father, and he will be available for the meeting as well.

We have also spoken to Stick (Consumer Advocate from Rip Off Report), and he wants to make sure that this is going to be a COMPLETE closure on this, and WILL NOT include ANY sort of Arbitration.

Just for the record our definition of closure must include at minimum:

1. COMPLETE unwind of the contract.
2. Refund of all monies paid for the unit, taxes, licenses,
etc..
3. Refund of all warranties at 100%
4. COMPLETE release of our financial responsibility for the
unit.
5. PROOF of the loan being paid in full. (I personally will
call lender and verify this, then only then will we
consider this closed)

I am in receipt of your letter to dated Oct 1, 2004.

Yes we will meet with you, but here are the terms:
Meet in a Public Place in Surprise, AZ
Must be Week of Oct 4, and no later than Oct

8. Must be after hours, because I refuse to take any more time off from work on this.. I currently have over 30 hours of time that I have taken off regarding this mess.

The appointment must be IN WRITING or EMAIL.

Yes, you have stated correctly that I have been addressing letters and faxes to : Len West, Marty Holman, Linda Smith, Mark Nunzio, Robert Beaudry and general delivery, because the attempts to keep this under the "wraps" and "hide" this from others as to what is really happening will simply not work with me.

I did this to get the attention of the company employees and management to start asking questions "about just what is going on here", and judging by your reply, I have been able to do just that.

I started contacting others as mentioned above because I felt that I was not getting anywhere with you, so by going to Robert Beaudry and other executives within the company, and alerting to them as to what was going on within their company.

Please note that all reports on RIP OFF REPORT website ARE PERMANENT, AND HAVE (AND WILL) NEVER BE REMOVED, THEY ARE ONLY ABLE TO BE UPDATED.

So far Beaudry has chosen not to defend their side of the story on the website for all of the public to see.

Mr Murphy... why is this? do you have something to hide that you don't want potential customers to see. The intent of Rip-Off Report is to bring all the dirt that companies like to shove under the rug into the open so that consumers can make informed decisions about doing business with a company or not.

I know that most car and RV dealers don't like to deal with the informed consumer.......

Also, please tell me about the gentleman who drove around Mesa a few years back with his coach and great big banner on the side "DONT BUY FROM BEAUDRY" What did you do to him.. I sure would like to hear his story... as well..

What about when Beaudry Honda got sued a few years back for improperly installing a timing belt in a Honda they sold to a family... (these peoples son are renting our house in Chandler, and this is how I found out about that!!!)

How many RV PDI's do RV makers pay you to do each year?

In your PDI's what pressure do you want the LPG system to be at when you sell a new RV?

How long to you do a RV LPG system leak down test?

What are the things a good RV tech looks for when doing a COMPLETE RV LP Gas system?

What is a safe operating pressure to be coming out of an LPG gas regulator?

Do you know which has a higher operating pressure, LPG or Natural gas?

Do you know how to properly test a Fuel tank for leaks?

Do you know how to properly pressure test a fresh water system for leaks or air entry?

Why did I not receive a copy of my PDI for my unit when I asked for it upon delivery? I was told that information was privileged information, not so.. I paid for it in the cost of my RV...

I dont see how my efforts could "polarize" the situation any more than it already is at.... we are still at other ends of the world... so I dont see any change in that... whether I picket or not.

Please also show me the Arizona Law that states that its illegal to picket? I spoke with your sales managers today of towables in Tuscon and he seems a bit misguided about that... I explained to him that picketing is legal and protected under the 1st and 14th amendments, as long as we dont do it on your property after being asked to leave by the OWNER, however we can continue to do so.

Why you would be dumbfounded by this action is beyond me... put yourself in our shoes for 30 seconds and see things from the consumers eyes for one moment... ..

I finally got around to printing out the communications log of all emails and letters that were sent to and from Beaudry (only about 1 to 2% were actually from them, the rest was from me to them...) and I kid you not, this stack of papers printed took over 1 ream of 500 pages to print out....

And they have the gumption to tell me that I have not been communicating with them...

I am going to take digital photo of the stack of papers printed and submit as a photo to be on my report, for all to see that should you purchase from this dealer this is what you have to look forward to.....

RIP OFF REPORT FLYERS DISTRIBUTED...

Today we distributed several brightly colored copies of our Rip Off Report on Beaudry today to RV Dealers up and down Main Street in Mesa, AZ.

While distrubuting them I learned several facts about Beaudry.

1. They have a bad name in the RV Business. (gee.. wonder how they got that).

2. Several of the sales people have quit Beaudry because of their business practices.

3. Learned about the gentleman who bought a coach a few years back and then ended up driving up and down main street with a hugh banner attached to the coach "Dont Buy from Beaudry", however the persons I talked to do not know if the issues got resolved or not.

4. Many of the dealers said that they would use the Rip Off Report as sales tools should a customer state that they are going to compare with Beaudry.

Then later on that day we learned that the people who are renting our house in Chandler, his father is a lawyer that filed a lawsuit against Beaudry Honda for service issues on a Honda they purchased from them. They settled out of court, and I will work with him to see if he can get me the details of that situation.

Dear Mr. Swenka:

I have indicated to you that I am the person who will make any decisions regarding your demands. I have also indicated that all of your correspondence should be directed to my attention so that I may be able to promptly respond to you on behalf of Beaudry RV.

Over that last several weeks, I have been receiving numerous emails, faxes, and telephone messages from you that have been addressed to other Beaudry RV employees. Specifically, you have been addressing Len West, Marty Holman, Linda Smith, Mark Nunzio, and Robert Beaudry. These employees are not responsible for handling your demands. By directing correspondence to them, you are delaying the time it takes to get me the correspondence and in turn delaying the time it takes me to respond to your correspondence.

Further, as a result of your misdirected correspondence, one of our employees is personally contemplating seeking legal action against you for defamation and harassment.

The latest pieces of correspondence from you, which have been forwarded to my office, are indications that you intend to picket various facilities. I am dumbfounded by this approach, as this will only polarize our positions and possibly cause defamation lawsuits to be filed against you from parties unrelated to your transaction.

One of your many, ever changing demands required the trade of your 04 unit for a brand new 05 unit and reimbursement of expenses to you of $5,800.00. The manufacturer agreed to give you an '05 unit in exchange for the '04 unit. You refused to take delivery because you would not sign any of the title or lien transfer paperwork. It is my understanding that the manufacturer is still willing and ready to give you the '05 unit. Beaudry RV is still willing and ready to assist you with the transfer to the '05 unit.

You indicated that Beaudry RV is not responding to your demands. That is simply not true. You have received responses to each of your new demands, even though most of the responses were
rejections of your demands. Further, Beaudry RV has made offers to you which you have either expressly rejected, or have failed to provide a response, other than publication of your rejection somewhere on the internet.

If you wish to be reasonable, rather than continuing to polarize our positions, Beaudry RV is willing to listen to your demands in person. Marty Holman and I will meet with you personally. Please call me to schedule an appointment.

I would like to know does the RV manufacture pay the RV dealer to do a PDI. I wonder how many PDI's they pay for each year! If a RV maker is paying for PDI's to be done, how is it that a RV buyer can purchase a "NEW" coach in such poor shape? Seems to me that someone forgot to do something on a check list.

Hey RV maker do you "FFEL" ripped off if a RV buyer buys a NEW coach in this shape after you paid for a PDI? How many PDI's have you paid for? How much money to RV dealers charge you for a COMPLETE PDI? Do they charge you less if they do only half of a PDI, or do they still charge full sticker?

Here is some insider info you all you RV owners. Lets say that you have 15 liquid gallons of propane in your LP gas tank. Let's say that you bought a RV that had a POOR PDI. Let's say that you or your wife cooked a hot meal on the stove and everything went ok, SO you THINK!

Later in the night when you are DEEP ASLEEP a propane leak that should have been found in a GOOD PDI starts leaking. later in the night it starts leaking really bad during the time everybody is sleeping and enjoying a good dream.

No body knows about the leak because a POOR PDI was done. Remember if a poor PDI was done, nobody will tell you about it. Later in the morning a sleeper gets up for an early morning smoke or a hot cup of coffee. Tried to light the stove and K BOOM!

Here are some numbers for you RV owners. If you have 15 Gallons of Liquid propane in a tank and you release it into the air, that 15 liquid gallons expands to 4050 gallons of explosive vapor.

Do the math on how many gallons you have. 1 liquid gallon of propane is equal to 270 gallons of propane in an explosive vapor form once released into the atmosphere.
1 is = 270
10 X 270 = 2700
15 X 270 = 4050
20 X 270 = 5400
25 X 270 = 7650

Mr RV dealer How many RV PDI's do RV makers pay you to do each year?

In your PDI's what pressure do you want the LPG system to be at when you sell a new RV?

How long to you do a RV LPG system leak down test?
What are the things a good RV tech looks for when doing a COMPLETE RV LP Gas system?
What is a safe operating pressure to be coming out of an LPG gas regulator?
Do you know which has a higher operating pressure, LPG or Natural gas?

Hey Scott did the RV dealer forget to give you a copy of the PDI document? Did they show you how to operate a RV LP Gas system. You know, the do'a and don't when using a LP Gas system?

Hey Mr RV dealer, Post the list of things that you do during a PDI that is paid for by the RV maker.

Mr RV maker, you should see to it that this guy get's all and I mean "ALL" of his hard earned money back. This RV BUYER should get a full refund on the Extended warranty aswell. Trust me, this Rip Off Report will be seen by many. I have seen this web site get up to 15,000,000 that's 15 MILLION hits in 24 hours.

In less than 1 month of having my ad on Google that points to my "Beaudry Bad Deal Website" and "Beaudry Rip Off Report", is getting some great click throughs.

So far I have received 4886 impressions (views of my ad on Google), and 126 of those have clicked through onto my site and report, thats a whopping 2.5%, an almost unheard of rate in advertising, most advertisers are happy if they get less than 1% conversion rate! And the site itself So what I am doing must be
doing it well!

Yes, the dealer did a "demo" of the unit, however it was only about 15 minutes, and he was in a rush to go. Also at that time the main water tanks leaked at at that time, and even after they tried to fix that they still do.

The service guy was "Lee" (has really long hair and in a pony tail, and smokes like a chimney).

The unit even had a broken window on delivery, and that took them 3 months to finally get it replaced and when they did they did a shotty job of it... scratches, and caulk job, etc..

Not to mention we we left with the unit, we were told it was "Ready to Go", and they left the black and gray water valves open (but the caps on), so it made for real interesting time in dumping the waste tanks... I brought it back to them full and told them their losers working their left the valves open so they get the fun of cleaning up the mess it makes when they remove the caps...

Hey Scott read my thoughts on the UGLY WORD called "Arbitration" Trust me on what I am about to tell you. A local attorney hired me to come in on a case againest a local RV dealer. He wanted to make sure that he had covered all bases.

The law firm gave me 350 pages of documents pertaining to the law suit. I reviewed all of them and found Fraud, Forged documentation and and much more,I also found that the RV dealer had presented a Forged PDI document that shows that if a good PDI was done that they would have known that they should NEVER have parked the RV on their lot for sale.

The RV dealer's attorney tried to pick me apart in a Depo. Fat chance! I put him on a new train track.

After all was said and done. The RV dealer got away with a big Rip Off, The Arbitrator got some BIG CASH and the RV buyers had to put their pants on backwards.

In other words, they got the big one! We also found that the Arbitrator was in bed with the RV dealers Attorney on another big case.

Needless to say the Arbitrator rulled in favor of the RV dealer EVEN THOUGH I exposed FRAUD, FORGERY and DECEPTION!

Don't be too fast to love Arbitration!

Now car dealerships-already with all the advantages in their corner-are increasingly locking the door on consumers who might raise a dispute after the purchase of a car--even where outright fraud may have been involved.

This is being accomplished by requiring consumers to sign an agreement to forgo their Constitutional rights to ask the courts to settle a dispute with the dealer. Instead of an impartial judge or a jury of randomly selected jurors, the consumers are required to place their fate in the hands of an arbitrator. This is called binding arbitration which keeps the consumer from seeking justice in the court room even after the arbitrator's decision.

Arbitrators are not required to follow state law or precedent, or federal law or precedent in consumer arbitration either. By forcing consumers to relinquish their rights, companies are able to circumvent laws enacted to protect consumers from harm. Consumers have no recourse because the appeals process is functionally nonexistent

The arbitrators of consumer disputes owe their economic well being to the defendant corporations because they are paid per case. Companies keep records of which arbitrators found in their favor and can choose companies and arbitrators that are defendant friendly. Since public records are not required in arbitration, consumers have no way of knowing of this bias on the part of arbitration companies and individual arbitrators. In many cases, this conflict of interest is not disclosed to consumers.

While arbitration is often touted as cost effective, many consumer claims are for modest damages that will be exceeded by the arbitration filing and hearing fees, making arbitration a losing proposition. This serves as a disincentive for consumers to pursue a claim. Because class action suits are usually prohibited by arbitration, large groups of consumers who have been harmed for only a few dollars are prevented from forming a class, further allowing companies to escape accountability for wrongful actions.

Consumers are also forced into compulsory arbitration in "take it or leave it" contracts, but consumers have even less power when they deal with auto dealers. Unlike auto dealers negotiating million dollar auto franchise contracts with auto makers, consumers do not have an attorney at their disposal to advise them of the consequences of an arbitration clause. Furthermore, consumers are increasingly less likely to find merchants who do not require arbitration clauses, contrary to the myth that consumers need only take their business elsewhere.

"June 7, 2000Chairman Gekas and Members of the Subcommittee, Public Citizen is submitting this testimony because we believe that the use of mandatory pre-dispute arbitration clauses presents a grave problem for consumer rights and public safety.

The use of mandatory pre-dispute arbitration clauses is growing at an alarming rate and congressional action is urgently needed. If the trend continues, soon we will have a private justice system adjudicating disputes that is largely controlled by corporations.

Automobile Consumer Credit Fraud

On January 31, 1999, Ann Brown of Sandusky, Ohio borrowed $5,500 at 25% interest from a J.D. Byrider Franchise car lot to finance her purchase of a car from Byrider's used car lot.

The car turned out to be a "junker" and a safety hazard. The entire wheel and axle fell off when Ms. Brown's teenage daughter was driving down the road.

In her lawsuit in Ohio court, Ms. Brown alleged that she was forced to pay an artificially inflated price in violation of the Truth in Lending Act.

Ms. Brown also alleged that Byrider violated the Truth in Lending Act by requiring her to accept an $895 warranty fee that was also to be financed by J.D. Byrider at 25% interest. In addition, Ms. Brown alleged violations of the Ohio Sales Practices Act and fraud.

But Ms. Brown was denied her day in court by the district court in Ohio, which ruled that the arbitration agreement contained in Ms. Brown's contract had to be enforced because of the FAA's policy favoring arbitration.

Under that arbitration clause, Ms. Brown LOST ALL her claims under state and federal lending and consumer protection laws although Byrider retained the right to sue her.

She also waived her right to punitive damages, no matter how reckless or malicious Byrider's conduct. Instead, she must proceed under Byrider's choice of arbitration, for which she must pay half the costs and attorney fees.

The costs of arbitration, which begin with $300 -- $500 filing fees and approximately $1,500 per day arbitrator's fee, exceed the value of her claim. It is simply not worth it to take the case to arbitration.

In sum, Byrider is using this arbitration clause to insulate itself from the consequences of violating the Truth in Lending Act, Ohio Sales Practices Act and flat-out fraud.

Ms. Brown did not understand that she was waiving her right to go to court when she signed an arbitration agreement with Byrider.

This is hardly surprising because the Byrider financing officer himself had no idea what arbitration is or what the rules of arbitration are, so he was unable to tell Ms. Brown what rights she was waiving.

Nor was she given an option -- the credit contract was presented in a standard form, take-it-or-leave-it format and she was not allowed to challenge any of its provisions.

The mandatory arbitration provision only applied to Ms. Brown. Had she defaulted on her loan, Byrider would have been able to file a lawsuit against her.

When Ms. Brown first filed her lawsuit, Byrider stopped using the mandatory arbitration clauses in their contracts. But once the courts refused to vindicate Ms. Brown's rights in court in favor of arbitration, Byrider began using the clauses again.

Ms. Brown's attorneys have received inquiries from over 40 consumers similarly defrauded by Byrider. Unfortunately, no matter how many of J.D. Byrider's former customers are defrauded, they cannot file as a class action because the mandatory arbitration clauses in their contracts waive their right to maintain class actions.

Don't EVER think that car dealers hire lawyers to write up car buying contracts that help protect consumers from auto dealer deception.

If your so called friendly car dealer wants you to sign a contract that has a built-in mandatory arbitration clause in their contract or a single document that is an arbitration addendum
tell them to SHOVE IT.

Scott I would NEVER agree to any arbitration!
Get ALL of your money back or continue to make big waves.

Scott, Keep up the pressure. The PDI you stated is Joke it is a guide for some problems that the dealer found in the past and to look for them. At delivery did the dealer go out and demonstrate your unit? Some of these problems should of showed up at that time. I Agree that you do have serious problem with this dealer. Some words of Advice, Document every thing you can about this, As much as you may not want to make sure that you keep up with your payments, or one day it may be reposed, Good luck on this Situation.

I just got the email from Sherri with the reply to the Phoenix BBB in PDF format. It is identical to the reply sent to the Tucson BBB, with the exception of the file number and the address to lines.

I have emailed Linda Smith and provided her with 3 options to see wants to proceed and those are:

1. Friendly Rescinding of the contract, and forget this ever
happened.

2. Tempt Fate with Arbitration.

3. Have us continue our public presence, execute the picket process, and disperse literature about them to all neighboring businesses in similar lines of business, and continue this sort of activity indefinitely.

The last email sent to Andrea Menier promted a phone call from her at around 2:00pm Sept 28, 2004, where we discussed options.. out of that call came this email to Linda Smith of Beaudry, of which I also cc'ed: Marty Holman, Len West, Bob Beaudry, Bob Burden and Mark Nunzio.

Mark Nunzio deleted the message without reading it!! Too bad for him... (this is not un-usual, as Marty Holman has deleted messages from me as well without reading them...)

Every message I sent I sent high-priority with a return receipt....

I just finished a conversation with Andrea Menier (Ethics & Arbitration Liaison for BBB) she is going to forward to me the reply that they received from Beaudry for us to review and reply.

1. Move into a friendly contract rescinding process, and each of us both go our separate ways and forget this bad deal ever happened.

2. Tempt fate and goto arbitration, should we so choose that route it is my understanding that you are bound by obligation to goto arbitration should we so choose it. We are confident the arbitrator will side with us as we plan on coming armed with:

a. We are fully prepared to uphold our decision to revoke our acceptance of the unit.
b. Parents are fully prepared to give statements on the latest experience they had with the units massive failures.
c. Provide statements as to the verbal challenge you issued to me regarding "Going public is a waste of my time" as well as the written challenge
issued by Mike Murphy of "Your Media Barrage will not change our mind"
d. The dealerships total lack of cooperation to meet with us and resolve, and the gross lowball offer to settle by Mr Murphy.
e. How Beaudry refused to answer my attorneys demand letter, as well as the letter from the Attorney General's office, and then lied to the BBB
saying that your working with our attorney (I called him, and he says he has not heard from you)
f. Why it took more than 3 letters from the BBB to even get Beaudry to reply to our complaint.
g. How everytime we took the unit out something else or many things went wrong.
h. How Beaudry lied to us on the fact they actually contacted the manufacturer for warranty services, or had ordered parts, but failed
to perform any follow-up as to the status.
i. How the dealership put words in our mouths in the statements to the BBB.
j. How your dealerships made offers to us to settle and then they got shutdown by higher management. (explains our back and forth on decisions)
k How the dealership made crude statements to us in person... because they got tired of seeing us back for repairs.
l. Show how per your letter to the Tucson BBB that my father is actually in total agreeance with the decisions that I have been making regarding this
matter.
m.How the dealership curtly rejected all of our offers to settle and this to closure.
n. How this is not something new to Beaudry as per AZ Superior Court records, and other Rip Off Reports filed.
o. How Beaudry rarely kept us informed as to the status of the unit while it was in repair.
p. The list goes on, and on...

3. Force us into even more public actions, picketing of the locations where corporate executives are located at. Distribution of literature to all like business, services centers, parts suppliers, etc.. in the Mesa and Tucson areas. The signs and the literature have been prepared all I have to do is go and pick them up at Kinko's, then proceed to publically humiliate you by any means required.

Please advise on how you wish to proceed with this. I anxiously await your answer.

It is our understanding that your experience was with the location in Mesa, and you filed your complaint against both the Mesa location and the headquarters in Tucson. Arizona has 2 Bureaus; one in Phoenix and one in Tucson. Since you filed in both service areas, both Bureaus began the complaint process. In this case, your complaint is being processed by the Tucson Bureau and we are going to allow them to finish the process. There is no reason (and it is not our policy) to handle
the same issue with two different agencies. After all, you will be receiving the same response from both Bureaus anyway.

Please continue working with the BBB in Tucson and keep us updated as to what is going on so we can update our files.

Thanks for the reply, depending on what their reply states, we will decide upon what direction will be moving in. However if the reply is much like the reply packet they sent to the Tucson BBB (which failed to address many of the most serious concerns), we still will be seeking mediation/arbitration per their membership with the BBB.

I have replied the Tuscon BBB message, and they and Linda Smith should get those replies in a day or two, at the very end of that document it stated how we wish to resolve this matter, and was signed by both myself, and my father (where Linda had claimed that she felt that possibly him and I were not in agreeable terms on this matter)

We still remain hopeful that Beaudry wants to bring this to negotiate a resolution as quickly as possible before this gets to far out of hand, and becomes a situation that neither of us can recover from.

Linda Smith at Beaudry says "Going Public is a waste of your time"

Mike Murphy at Beaudry says "Your media barrage will not change our decision"

Both of these statements are true.

Picketing a dealer; be it an automotive, boat, etc..only shows that you have too much time on your hands, and have unreal expections of what this will accomplish.

Personaly, when I see a picket or a motor home with leamons on it, I have to laugh at the driver or the person holding a lemon sign.
What are you trying to prove? That you have a problem with your product and have such poor commucation skills that you can work with your dealer or manufacture?

I will am willing to bet that you are the type of person who can not be pleased judging my the amount of complaints on your RV. And you will never be pleased by the outcome of this situation.

If you want to make the point that you are a nut case then picket away. Personaly, I would try to work with the Manufacture or an attorney, and if an attorney wont take your case, then you must have nothing to complain about.

I got a huge packet of mail today from the Tuscon BBB where Beaudry sent them a bunch of documentation and did nothing but skirt the issues that I had been bringing to them.

They also keep saying that they are working with my attorney (I called him and he has not heard from them...)

They also said that I said things and did not, signed certain documents and did not, but this is of no real surprise to me.

As well as stated that they are working with me to get a resolution... (yeah right... ) have not heard a word from them in over 1 month now...

By the way Scott don't let anybody tell you that they can't cancel the warranty policy. They can cancel it and give you a refund. They will not give you 100% back but most of the time you can get 80% 0r 90% of your money back.

Not too long ago I helped a local law firm with a case against a local RV dealer. I caught them sending fraudulent doc's to the court. They fabricated a few extra doc's to try to make the court think they were on the up and up.

The RV buyer got bent over in a big way and the Arbitrator ruled in favor of the dirty RV dealer. Later we found out that the RV dealer's lawyer and the Arbitrator were in bed together on a much bigger case. So much for justice for the consumer.

I tell people all the time when you go to a car or RV dealer NEVER sign anything that has an Arbitration clause in it. If you do and you have troubles, you will get screwed!

Can't say who was right or wrong but here is what I found. You be the JUDGE!

More Confirmed Faxes... Mark Nunzio, the Finance Department

I called and confirmed today that Mark Nunzio, the Finance Department, and Service Department all received copies the Rip Off Report that I faxed over to the Beaudry Mesa Location.

The admin who answered the phone, new exactly what I was talking about and said that like "5" different faxes came in yesterday and today regarding this situation.

This was confirmed at 1:47 pm Sept 23, 2004

Today I called and left messages with:

Bob Burden - COO of Beaudry. Left message with his secretary Laura Cierna at 9:58AM - 9/23/04. She acknowledged the reciept of both RipOffReport Faxes. Told her that if they continue to ignore us we will only get more vocal, and persistent.

Bob Beaudry - CEO of Beaudry. Left message with the operator. He is located at the Beaudry Mercedez-Benz dealership in Tuscon. His assistant name is Brenda Pierson, this message was left with the operator at 9:49AM - 9/23/04. Explained that if they keep ignoring us we will only get more vocal, and persistent.

You're probably right about 3 On Your Side and auto dealers. I know that most local advertising both on TV and radio is from the local auto dealerships.

However, I still think it is at least worth the small effort to write them, even if all they say is they are booked with stories. I am hoping that they can help me with my own situation (see the reports here on Starbiz).

I've never heard of Rich Skidmore (was he before Gary Harper?). I have only lived here since Feb '03, so maybe it was before my time.

Hi Paul-

Your right, I left that part out my mistake. Its 35 foot fifth wheel made by Four Winds (Dutchmen) part of the Thor company.

It is the Toy Hauler version also.

I have been in contact with the manufacturer, and they did agree to build a new unit, BUT not provide any compensation for having to endure the expenses of keeping this "Piece of Junk", I even tried to negotiate with them and Beaudry and nothing worked.

Even if I were to accept the new unit, I would still be out of pocket over $7000, my warranties and extended protection packages would not transfer over either I would have to buy those again, that makes my total loss over $10k. So that is why I have chosen not to accept the offered replacement unit at this time.

Hey Pat don't think that 3 TV will help a car buyer that is having trouble with a car dealer Rip Off. Ask yourself this question. How much money do you think 3TV gets in car dealer advertising?

I have worked as a car salesman and now I am a car buyers advocate here at ripoffreport.com.

In Arizona it is legal for one of two involved in a phone call to secretly recorded the phone conversation. You might have a ton of fun listing to some tapes that I secretly made of me Rich Skidmore from 3 TV. Tapes are about CSI Diversion. Skidmore said that 3 TV had big balls and that they would air the story. He said that they were going to "Sand bag" the story until the sweeps, then they would air the story.

I feel that 3 TV did not want to air the story because their biggest advertiser was also doing this CSI diversion. No TV station likes to bite the big hands that feed them. After I brought this story to Skidmore, he found a guy that told him of a BIG dealer in Tempe AZ that was doing it. This dealer was the biggest advertiser on 3 TV's web site.

Hey Pat when was the last time you seen a local franchised new car dealer get exposed on a local TV station?

Pat email 3TV and ask about the Rich Skidmore/Stick Bogart CSI diversion story. Ask them why they never aired it. Ask them why they never do in-depth stories on car dealers. Then post their reply on this Rip Off Report. I would love to read their reply.

We have taken this one step further... decided to call the Credit Card Company that we used for the $5000 down payment on the unit, and dispute the charges. They have so far sided with us and that this could be a fraud case on their hands.

We have also contacted the lender, and they are telling us the same thing that since we have yet to receive a fully functioning unit in a reasonable time they to are going to investigate them for fraud as well.

As far as lemon law goes... I am not covered, because -
1) Its a Trailer
2) Its GVWR is over 10,000 lbs

So it now falls back into the AG, or Revocation of Acceptance laws.

Maybe by them being seen on here, they will "own up" to the problems, and finally retract the contract. Thanks to Tim above, they have lost a $90k sale! YEAH!!! :) Hope for more to be affected as well.

Your buddy Linda Smith "Customer Service Manager" is dead wrong with her "people will still buy what they want" comment. Well, perhaps not *totally* wrong.

I have worked very hard to save the $20,000. cash I would put down on a $90,000. RV. A Beaudry RV no less, as I saw them at the Arizona State Fair. I am just over $19,000 and so very excited about purchasing my brand new RV...

And she's right, I suppose... I'll still buy what I want... but definitely not from Beaudry. Not after reading your clear post. THANK YOU for submitting it -- I know it must have taken you some time.

I'm sure Beaudry would respond with the fact that I'm not likely to have those kinds of problems on a new unit -- and that's not the point. Who wants to patronize a company with those kind of bad business practices???

I aim to finally make my purchase in November. I *guarantee* you I will go somewhere else. I hope they realize they could have solved this problem with you, and then still had MY sale.

I hope my decision helps you feel at least the tiny-est bit better.

Because I have taken this so personal (I think you would to if a company decided to do what it has done to me).

I decided to get noticed on Google, and took out a Sponsored Link on their site. So now when you search on -

Beaudry
Beaudry Motor
Arizona RV
Beaudry RV

and you look on the right hand side of screen.

My "Ad" will show up in the list most of the time!

This company needs to learn the hard lesson in business you rip-off a customer and they will tell as many people as possible not to use your business or services. Right now they think that "Going Public is Waste of My Time", and "Your media barrage will not change our minds"

I have also posted on every RV\Camping forum I could find, the American Sand Assocation Forums (40,000 members!!!)

There "current mindset" may be the case, but when my efforts start effecting the bottom line and Bob Beaudrys pocket book... I am betting that they will resolve my issues and retract the contract!!

Everything on my postings, rip-off report, etc.. are true and they know it.

We are hoping that someone see this and can help us out here... as the dealer has done nothing blackball us during this whole ordeal, and we just want it to end so that we can move on with our lives, and find a dealer that will work with us. They have ignored the demand letter from our attorney, as he states we are protected by law under the Uniform Commercial Code ARS 47-2608 - Revocation of Acceptance. Their management and "corporate counsel" has done nothing for us, except provide insulting settlement offers, when all we want is our money back, and the interest paid on our loan.

They have also ignored the letters from the AG and BBB.

There has to be one news channel or radio station out there willing to take the story and make this company look like fools.

This place thinks 40+ years of being in business is their invincible shield, and that no amount of public humility will hurt them...I have set out to prove that wrong and get my money back!!!!

Too top it off.. the last comment made by Linda Smith "Customer Service Manager" for the corporate office in Tucson was "Going public is a waste of your time, people will still buy what they want", I also asked her if she would go on camera (mine or a news channel) and she said "NO", if she is so in the right, what is she afraid of...

You will also notice below that they have made statements to me, that despite the unit leaking fuel, electrical shorts, holes in bottom, and defective plumbing - "Its safe to use", and "that these kinds of problems are just expected"

I have put up a website, that is getting national attention, and in less than a month has received nearly 5000 hits!!

I am even considering making up some posters for the side of the RV and driving around Mesa (near the dealership) that says "Beaudry Sold me a Lemon - And Wont Take it Back"

Beaudry can end this today by just simply allowing us to return the unit, and give our money back to us... if we have to goto court, not only will we seek our money back, we will seem damages and attorney fees..
