Benjamin D Cushman ripped me off and is the worst attorney in Olympia, Washington. Nobody in the profession, including judges, respect him. Walk into a courtroom with him and you will see the other attorney's high-fiving each other.

He got into trouble by having sex with one of his clients.

He was recently sanctioned $7000 in a case in Washington for lying to the courts. He ought to be disbarred. Look in the records. The opposing counsel was an attorney in Gig  Harbor, WA named Mike Johns. Don't just take my word for it. Call and ask him if you want proof.

One tactic he uses, instead of being honest with his clients, is telling them that they have a great chance of winning even when it is very obvious that they will lose. He does this just to get his client's money. He doesn't care if they win. He just cares about getting their money.

His father, Jon E. Cushman, is well-respected in the legal community.

But the with Ben Cushman, the apple fell far from the tree because Ben is known in the lawyer community as a sleazy, dishonest, rotten bum. Not only is this scum bag licensed in Washington. but also in North Carolina, Oregon, Idaho, and U.S. District Court, District of Idaho,  as well as Alaska. This isn't saying much. All you have to do is take a test.

If you even consider this thief, run away as fast as you can. You'll be spending money like water. He pads his hours because bills you even when he is not working. Your bank account will be sucked dry and you will lose the case.

Oooh, don't like this, do you, Ben? Getting a little too close to home, isn't it? Literally. Well if you were honest and were not such a thieving, conniving, lying scum, maybe stuff like this wouldn't have to be said about you.

If you could just turn over a new leaf and be honest with people, maybe people wouldn't have to reveal these truths about you, would they? Take some advice from your dad.

If you act like an a*s in a deposition, the other side will clam up, get just as belligerent as you, and you will not get the cooperation you seek. If you act honorable and courteous in deposition, the person you are questioning will tend to open up and be more cooperative with you.

It's not just about trying to get money from your clients, it's about being respected. If you are honest and well-respected the word will get out. If you are in court or in a deposition and and you try to deceive people, the opposing attorneys will all talk about you and say bad things about you and you will be shunned by your profession.

Your would-be clients will hear about the bad things you have done and will avoid you. Most people are not idiots. Most people can smell it if you are tying to help them or just tying to get their money. And with the Internet, Ben, things like this get out there a lot easier than they did in the past. If you put your client's best interests and the best interests of dignity, honesty and respect, Ben, you will have more clients and make more of that green stuff you seem to lust for.

That's about all I have to say for now. Believe me, if you try to find out who posted this or try to do anything against me, you will not find me. Even if, by a long-shot, you do, and you try to do anything about it, I will put 100 more posts on 100 more websites revealing the truth about you.

You can't hide from the Internet. You can't get away with your crap anymore.

So, take this as a lesson. Learn from it. Grow from it, stop lying and start telling the truth.

None of the substantial factual allegations, other than that I am an attorney and was aggressive in a deposition, are accurate.  For instance, any person who has met with me in an initial meeting will know that I do not oversell cases or ignore risks to get clients signed up.  Given the description of the event and the time of the event, I can explain what it involved.

I was litigating, on behalf of a plaintiff, a case involving equity stripping mortgage fraud.  That is a scheme in which a person buys a property without providing full cash at closing, convincing the seller to take a promissory note and deed of trust for the remaining balance.  The small amount paid is then advanced by a third party, who takes a "first position" deed of trust.  The buyer and the first position lender then collude such that the first position lender forecloses on the property, which is bought for far less than the purchase price or fair market value (often for the face amount of the loan for the money that was paid at closing).  The original seller's deed of trust is wiped out in the process, leaving them with an unsecured promissory note that they cannot enforce.  This is called "equity stripping" because it induces the original seller to sell their property for a pie-in-the-sky price and then deprives them of both the property and the benefit of their bargain.

In this case, I deposed one of the participants in the fraud (in fact, the guy who trained and recruited the three participants needed to work the fraud).  My practice style is very aggressive and I would not let the mastermind fraudster get away with evasive nonanswers in the deposition.  Eventually, rather than answer my questions, he "took the fifth" and refused to answer questions on the grounds that answering my questions could incriminate him.  This works in criminal cases, but not in civil cases.  In a civil case, unlike a criminal case, the other side can use the fact that a person "took the fifth" against them -- and I did so.

This is a shock and surprise to the guy who refused to answer my deposition questions.  He (or his friend) posted this report in retaliation.  A reading of the report shows this to be the case.  However, it is my job to represent my client and to do so aggressively and without hestitation based on possible consequences to myself.  That is how I practice, and I don't care a bit for attorneys who shy away from the anger and possible retaliation of the other side.  That is my real reputation, and I invite anyone who wants to test that to ask my clients or the attorneys in my community about me.

Ripoff Report - Please remove the above post. I feel like this guy has hurt a friend of mine and I am very protective of my friends. I take back everything I've said above because it is what I was told and not firsthand information. I don't want to be the one exposing this guy. Let him expose himself.
