First of all, I want to say that I've been working in the Oregon legal system for over 20 years now, and I've had my share of run-ins with lawyers - both those I have employed, and otherwise.  Despite that however, and despite the fact that Oregon has some pretty smarmy lawyers, I've never before felt the need to publically warn others about a specific attorney.

However, this particular lawyer (who has been one for only about a year), and in fact, his entire law firm, are completely unethical and unprincipled.  Earlier this year, he had a minor functionary in his law firm, send me an email, purporting to inform me of a court appearance.  The only problem, is that the email was completely without text, contained an unidentified attachment, and was sent by someone, completely unknown to me, who identified herself by the last name of "Titzler".

I mean, really; who in their right mind would open that email?  To say nothing of the attached file?  Nonetheless, based upon that anonymous email, Mr. Robinson went into court and alleged that I had been properly "notified".

When I found out, about a month later, what had transpired, I contacted Mr. Robinson by email; and, in response to a request from him, gave him a physical address where I could be personally served with documents, as well as a time-line, for when I would be available to receive the service.

Instead of sending the documents for service however, Mr. Robinson went back into court, and falsely alleged to the judge that I was "unavailable" for service.  In his supporting declaration however (which the judge never, apparently, bothered to read), he admitted that, although he did know my whereabouts, he did not have a process server already lined up for that locale.  In other words, this pampered elitist, asked the court to allow alternate (and improper) service, simply because the law firm that he worked for had not already provided him with a pre-arranged process server, meaning he would have had to go get on the internet and telephone and find one, just like anybody else.

Apparently, that was too much effort for this young barrister, and true to his elitist attitude, he got the court to permit him to "serve" me by email, EVEN THOUGH THE OREGON COURT RULES SPECIFICALLY PROHIBIT IT!!

Sorry about that "shouting", but I really wanted to make a point of that last fact.  ORCP (Oregon Rules of Civil Procedure) Rule 9G says:  "Service by e-mail is PROHIBITED unless attorneys agree in writing to e-mail service." (emphasis added)  Despite that however, Mr. Robinson, knowing in advance, full well, that I do not and would not open emails from anybody I don't know personally (especially IF those emails contained attached or embedded files), concealed that information from the court, and proceeded to "notify" me of all sorts of court appearances, depositions, requests for sanctions, default judgments and the like, without my ever being aware of any of the proceedings.

Now, this ambulance-chaser has managed to rack up about $5,000 in attorney fees against me, and I have still never seen an actual physical copy of a summons, complaint, claim, or other document filed against me.  In fact, I found out a few weeks ago, by accident, that they were even going to try to have a bench warrant issued for my arrest, for not attending a "show cause" hearing that they had scheduled; again, without notice to me.

When I contacted this attorney's law firm and his immediate supervisor to complain, I discovered that they not only stood behind his improper, immoral and illegal actions, but that they were, if possible, even more arrogant about it, than he had been.

I am in the process of filing a "bar complaint" against him, and his entire firm, but, since the Oregon State Bar is not actually a disciplinary body, but actually functions as the lawyers' union, I'm not expecting much to come from that.  Heck, I know of an attorney who showed up in court, drunk as a skunk, and the Bar refused to do anything, because the complainant couldn't prove that the lawyer had handled the case any less compentently than she would if sober!

That's why I turn to this forum.  I have always respected "Rip-Off Report"; I think it's one of the best consumer sites out there.  I hope that anyone who is considering employing this attorney, or his law firm, will think twice about it.  I also want to emphasize that my complaint is regarding attorney Blake "J." Robinson (OSB #
084543), and NOT Blake "V." Robinson (OSB # 053647).

Two follow-up items:  First, this morning (11/04/2009), the Multnomah County Circuit Court set aside the judgment for attorney fees, based upon my motion to the court.  Second, this attorney firm (Davis Wright Tremaine LLP), just about 10 days ago, agreed to the entry of a $30,000,000.00 (that's 30 MILLION DOLLARS folks) judgment against them, to settle allegations of fraud in a cas einvolving the Sunset Homes financial fiasco.  Now, common sense tells you they didn't agree to pay $30 Million just to settle a nuisance suit!  Again, if you do business with these lawyers, you will be known by the company you keep!
