Hi, I had the same problem with the credit report. Please see my post badbusinessbureau.com/reports/0/270/RipOff0270505.htm Toward the bottom of the page, there are links to information regarding the legality of BWP pulling a credit report. I reported them to the BBB and they responded saying they were "100% in the "right"" and quoted the Fair Credit Reporting act. What they failed to do was look up the definition of business transaction and the FTC Staff Opinion letters that I list in my post. These specifically address this type of situation. According to the Fair Credit Reporting Act Section 616 and 617 you can sue them for up to $1000 + punitive + legal fees in any US District Court not just Nevada or Georgia. I'm in the porcess of finding out if I can sue them in Small Claims court. Hope this helps you get a little revenge. I didn't get as far as signing a contract. Boy, am I LUCKY !! But I can tell you , I will be suing them. It just ticks me off that this so called "business" thinks they can do whatever they please and the general public is uninformed about any of it. I'm not out any money, other than I did get turned down for a credit card for too many recent inquiries, but I think they should be held accountable. BWP spouted off the wrong thing to the wrong perosn. I may even look into finding an attorney who would be interested in a class action suit. $1000 is probabaly a drop in the bucket to them , but 10,000 people x $1000 is not.
