I had Bolt Internet install internet

service
in my home for $107.13. After installing the installer brought

out a contract and said I had to sign it or face extra charges for uninstalling

internet. I signed the contract and was promised high speed internet at a low

price. The service was inconsistent, didn't work on a regular basis and dropped

connection about 5 times a day on average. I called 4 times for customer service

and they never sent anybody out. When I requested that the contract be voided,

Erick Loss, President of Bolt Internet told me he could sue me for failing to

meet the terms of paying for 1 year and also threatened to sue me for slander if

I took my complaint to such places as the Better Business Bureau. I returned all

equipment to him undamaged and he said he would void the contract, shook my hand

and then sent me an invoice for $324.95 for early termination fees

Mr. Kinsch subscribed to our least expensive, slowest Internet service plan for one year. The contract has a 30 day warranty in which we ask the client to contact us with any service related issues and allow us to try to correct them. If we are unable to correct the issue we will cancel the contract and refund the installation fee and first month of service charge. We never had one call from Mr. Kinsch. Our phone logs do not show one call from him at any time of day or night. When he called to cancel he said the service was too slow to stream video. The contact and the invoice and the web site all state that this plan is not fast enough for streaming video. He was informed of this by the installer as well. He never made this complaint prior to canceling and he was aware that this level of service would not stream video.

He signed an agreement to subscribe to our service for one year and was made aware of the early termination fees at the time he signed the contract and when he called to cancel service. He did not dispute this when he came to my office to ask to have the early termination fees forgiven.

Our attorney advised me not to forgive the early termination fees to him or anyone else because we would not be able to hold anyone to the contract if we started making allowances not stipulated in the contract.

We followed all of our policies and provided the service as spelled out in the contract. We did everything we were supposed to do. Mr. Kinsch did not meet his obligation to us. He did not inform us of any problem with the service and we did not have any outages or issues related to his connection to our network. He had an unreasonable expectation of the service and we informed him it would not perform at that level before the purchase, during the installation and after he called to cancel.  

We are not inclined to forgive any part of the early termination fees. We did nothing wrong. Mr. Kinsch is like a dine and dash patron at a restaurant. He skipped out without paying his bill after we served him.

Many complaints to the rip off report are about businesses not honoring their contracts with customers. The businesses should be challenged when they do not meet their obligations. The same should be true for the clients that dont honor their responsibilities to the business.
