If they don't want to sign for the certified, that is real sleazy, but they are sleazy so it fits! Just get about 5 or 6 pages of heavy bold print and graphics stating your request to cease communications, tape them end to end, feed through fax machine and re tape into a continuous loop and press send just before going to bed. That way he cannot say he did not get it!

Thanks for everyone's suggestions. I have a letter from AEP stating that we never were delinquent on any accounts. Every letter that I have sent them was cc'd to our local police chief. I have one refusal for receipt of a letter that I had sent them. I will send them a cease and desist letter again. I'm so tired of all of this and I am so digusted with how that company is treating people, that if an attorney takes this case, I am willing to sign over to him 100% of whatever we get. I'll be worth it knowing Boyajian is no more!

Boyajian is required by federal law to validate the debt they are trying to collect. They are also violating the provisions of the Federal Debt Collection Practices Act by calling you names and harassing you. You can google the title of the Act and read the provisions. Have you tried sending them a cease and desist letter? There are several templates available on this and other sites. Just write one up, send it certified mail and they should stop harassing you. Be sure to report them to the Federal Trade Commission and your state's Attorney general. That's how sCAMCO got shut down.

Boyajian's claims have no legitimacy in my case. I had called AEP (whom Boyajian claimed I owed money to) and they stated that we had no delinquent account with them. Requests for orginal documentation from Boyajian have been met with insults and threats. Requests for the harassment to stop have fallen on deaf ears. We have told them that we do not acknowledge their debt and will continue to do so until they provide proof of it, including documentation with our signatures on it. We were told that we were "stupid" for asking for it. If anything, the statute of limitations for Texas in such cases is 4 years. Boyajian wants money on a debt they claim we incurred in 1996. I just don't want these people to think that they can get away with this type of behavior and harassment.

Just because your credit report doesn't show the debt doesn't mean anything. A creditor doesn't necessarily report to a bureau. So this isn't proof of anything. However, THEY need to provide proof of the debt, and if they can't produce any proof, then you can pursue legal action against them if they keep calling you. Did you have relationship with the company that they claim you owe money to? And are you just looking for an out to someone you may legitimately owe money to? You don't really say whether this was a legitimate or not.
