In 2016 I had a listing in Long Beach. My managers Alftedo and Kirk (Bruce's Son) urged me to sell to Mr. Mulhearn on the M.A.P Program. It's a program where you find distressed properties fix them up and split the profit. Well after previewing the property he decided to purchase for $420k the properties in that area sell for $600k+. I was excited to participate too. My seller felt at ease since this was the broker. This should have been a 20 day cash offer. Mr Mulhearn even hand wrote a letter stating he would not cancel. After removing ALL contingencies, he cancelled. I was in shock to say the least. How can this happen? He mentioned he had another buyer, Guillermo S. (manager/agent) for Berkshire Hathaway. Hence Now this agent and Bruce will to take over the M.A.P program and indulge in the profits.

Bruce said he will loan Guillermo the money to buy it. Usually the map agent will forfeit the selling side of their commission back into the pot for repairs. I was not only forced to give up my MAP program I had to give up my sales commission. My broker has taken Advantage of me and my seller knowing they needed this money for personal reasons I divulged to my broker I was forced to agree or he would cancel. Abuse of power is an understatement. Till this day Mr Mulhearn avoids talking to me the agent Guillermo won't return my calls. I'm about to lose my house because I won't pay me until the agent is finished fixing the house and it sells. I was told it would be 6 mos and it's going on 2 years. Avoid this Broker at all costs. I can't leave this office until I get my money.

In Kirk Mulhearns own words Traci Thompson will recieve the monies owed to her once the property is sold....REALLY... I finally took the time to read his rebuttal ....a VERY wrong characterization of me.  I would never do anything illegal or immoral to anyone. 

This ordeal has been a strain on my true love for real estate.  I live on refferals...makes no sense to behave unethically.  This is a case of greed and lies.   I have all the proof showing all contingencies were removed, escrow commission was changed and a hand written letter from Mr Mulhearn to my seller that he would NOT cancel escrow, HE LIED.

1. Berkshire Hathaway Home Services, The Mulhearn Group, never agrees to automatically purchase any rehab property unless it waives all contingencies after making a thorough inspection of the property. In this case, we retained two separate experts to consult with us on the viability of this project. One was a practicing Contractor/architect the other an experienced investor. Both Consultants observed major problems with this property and advised the company not to close escrow. Traci Thompson lied when she said that the company had waived its contingencies. 2. The Seller was extremely reluctant to allow access to the property during escrow. On several occasions, we were refused entry and had to reschedule for the inspections. Why? We believe that the Seller was trying to hide the many structural problems that were not properly disclosed to the buyer. Was Traci Thompson aware of these defects? We do not know, however, she was very close to the Seller. 3. When the company decided against the investment, Traci Thompson was given options: A). Put the property back on the market with full disclosures to any other future buyer on the structural defects. B). Accept the proposal from another investor with changed terms at Traci Thompson's option. Traci Thompson agreed to the investor purchasing the property, this agreement was signed by all parties. 4. Unfortunately, the investor who purchased this property has taken an in ordinate amount of time to try to have the house pass inspections through the City of Long Beach. This was delayed partly because of the structural defects on the property. It does look like the property will be going to market shortly. 5. Thompson conveniently failed to disclose that already she did receive 50% of the commission and that when the house is resold she will receive the balance. This was agreed to in writing by her when she agreed to the modified terms of the sale. 6. No one is holding up Traci Thompson from leaving the company. Any commitment made to her will be honored by the investor and will be carried out, regardless. It is interesting that Thompson made these objections but has chosen to stay with the company as an independent contractor. Our attorneys are looking at the option of a defamation suit base on Thompson's own comments.
