Update, Bursey and Midland realized they were dealing with litigious people, (people who hire lawyers whens laws are broken) who will not stand by quietly and allow others to break laws, who own and use phone recording devices (following state law). One phone recording and several months later we settled out of court. They are out considerably more than they would have been if they had just followed the law. We are happy and have moved on. my suggestion consult a lawyer, get legal representation if you have a case, and sue. Do not allow these people to break the law, there are rules for every profession, when these rules aren't followed punishment is needed. If you allow this to continue people will continue to break the law.

My mother informed me yesterday that Bursey and Associates somehow gained access to not only her checking and savings accounts but the accounts she opened from my 12 year old nephew as well. They took just under $500 from her checking, about $200 form her savings and then the theives took my poor nephews $20 in savings and about $40 from his checking account as well.
My mother has a car payment and a credit card which she pays the full balance on every single month. She has never been contacted by Midland or Bursey for any debts and she certainly hasn't received any letters threatening garnishments of any kind. My brother ran a Google search on them yesterday and found out they are a bunch of sleaze balls.
My mother is contacting her bank (Bank of America) today and will be demanding to know how they allowed this to happen. This is an OUTRAGE!!!!!!

Bursey and Associates Attorneys P.C. working for Midland Management LLC. One last phone call to bursey after they sent a collection letter to my husbands ex-wife a collection letter for same debt. Sleazy tactic that totally backfired. This debt was incured before they were married and closed with oc in october 2002. Ouch! So I assume this attorney's office thinks its ok to send debt collection letters to anyone and don't bother to verify who they send it to or who the account really belongs to. Shame shame. Well we legally recorded this call to bursey, and they did exactly what they always do, they lied. I repeated how they hadn't validated the debt, she said they were sending us all paperwork on that it had been requested on Friday the previous week. Then she wanted our employeers names, I said I would not give that out, she decided to say that's fine we will garnish your wages then, I asked if there was a lawsuit she said yes I said. When were we informed, she said someone called on may 5th and told us about it, she said we will just keep checking your credit and get your employeers name from that then garnish your wages. I said oh ok. Next day took tape to a lawyer. Bursey we will see you in court. And will not only get you for all the lawyer fees but actual damages incured which will be a chunk of money since you caused a house to fall out of escrow, we lose inspection money, escrow fee, utilities etc... not good. I guess these guys reckless illegal tactics will finally get them. As you reap so shall you sow. Very sad. Very disgusting. This collection of bad debt, this company trying to collect what we don't owe is repulsive. True debt owed should always be paid, but when someone tells you they don't owe what you say, you have wrong info and you threaten them? Not good.

We called bursey once again after calling midland who said they could not and would not talk to us, we called Bursey and Associates back, at this time they threatened a lawsuit and told us that the debt was validated, we disputed that with them. We tried to explain our side but were continually interupted and threatened with lawsuits. This agent was named Barbara Barnett or Burnett. She clearly did not know about ftc, truth in lending act, nor apparently is she aware there are laws that regulate collectors, you know that you can't threaten a lawsuit if it would be illegal to do so or don't have intentions to do it, well sol in this state, az, where collectors are also located, is 3 years, this account is nearly 7 years old. Shame on you bursey and associates attorneys pc. A bit of advice, have your "lawyers" learn the law before they threaten and try to intimidate consumers. We should not have to tell them the law. Matt and barbara are obviously liabilities. Not good. Now you can see us in court!
