Butte County Sheriff Deputy Jason Miller was illegally talking on his cell phone when he crossed in to my lane forcing me off the road. Deputy Miller was off duty and driving his son to school. My car suffered approximately seven hundred dollars damage.



I wrote an e-mail asking for the deputy to apologize and to not drive illegally (talking on cell phone). I told the deputy that I did not want to have him reported or cited, only an apology and accept responsibility for his actions.



Instead of accepting responsibility Deputy Miller had his supervisor contact me implying that I had committed a crime. Deputy Miller's job is to enforce the law not break the law. A few days later I saw Deputy Miller again driving his son to school while illegally talking on his cell phone.

What really upsets me about this incident? When I found out that Jason Miller was a Butte County Deputy I wanted to give him a break. In my first e-mail I sent him I told him that I did not want him disciplined or cited. I never asked him to pay for the damages in my first e-mail. All I asked for was an apology and to not drive while talking on a cell phone. Talking on a hand held cell phone in California is dangerous and illegal. It caused Deputy Miller to cross a solid yellow line, drive half way in to my lane, and forcing me off the road.

I followed Jason Miller only to obtain info so I could file a report. Once I realized he was a Deputy I chose to give him a break. Instead of accepting responsibility and apologizing Deputy Miller had his Sgt Supervisor contact me stating that the deputy and he are concerned for the safety of the Deputy and his family. Concerned? If he was concerned about the safety of his family he wouldn't drive recklessly with his young son in the car.

Deputy Miller and his supervisor never showed any concern for my safety, and I was the victim of Deputy Miller's reckless and illegal driving. This is why I later decided to not give him a break and request he be held accountable for his actions, including damages. Deputy Miller and his supervisor tried to make me the bad guy. I believe Butte County Sheriff Deputy Jason Miller believes he's above the law and that the law does not apply to him, and that he doesn't feel he should be accountable for his actions.

If anyone is ever pulled over and cited by Deputy Miller for illegally talking on a cell phone, please use this report in court to show that the Deputy also breaks that same law.
