Basically, I have a medical debt that I was unaware that when into collections about a year ago. I found out after receiving a letter/call of course from collection agency. Anyways, Joe from the Capital Accounts call and try to offer me a settlement for about $1800.  I informed him that I can only pay $1000 if they can settlement for that. He responded back YES and immediately started asking for my credit card/banking info etc to receive the funds.

I told Joe that I want to receive a letter via email or mail first saying that they will except $1000 for settlement. He told me, no just give me your credit/banking now and after the transaction I will be glad to send a receipt. I told didn't do it!!! He starting calling daily after this and about three days later a letter was emailed to me.

The letter said Balance $XXXX Settlement $1000. Must be paid within 15days for offer to be valid.

After receiving funds, we make necessary changes to account.

Therefore, I called Joe and stated to him that the letter does not say anything about after receiving the funds the account will be closes and the credit bureaus will be informed. He stated that I was a generic letter and would try to get another letter sent out to me. Instead of me waiting, I called my lawyer, my lawyer stated that settlement means a ton of different meanings and this letter does not say what is should have on it.

The next day Joe called me again and said that he spoke to manager and was told that this this way the always send out settlement letter and unfortunately he will not be able to send me another letter say what he was saying over the phone but not in the letter. I told him I have contacted my lawyer and do not want him or his company contacting me again. I informed him to expect a call/letter from my lawyer in regards to this matter.

This piss me off because he kept lying to me trying to get my money without sending letter saying that once funds received the account will be closed. Although, he was constantly telling me this over the phone. THEY ARE HORRIBLE!!!!

I have dealt with collection agencies before and it was very smart of you to ask for the agreement in writing. The agents are often not paid very well, not well versed in various laws concerning collecton practices and very often lie. They will tell you one thing on the phone and then they will not honor it. Always get agreements in writing. Another thing the collection agency will do (the unusally devious ones) is that they will tell you they will settle the debt for a certain sum, but on your credit report they will put long paragraphs saying "Settled but for Less Than the Original Amount". Mortgage companies and creditors hate that statement. You have to make sure that the only statement it will show is "Settled or Paid" and that is it. Your lawyer was right. These people are weasels.
