I received a letter from Capital Management Services, LP reporting a delinquent debt of $1895.79. They listed a Current Creditor as Atlantic Credit & Finance and a Previous Creditor as HSBC. I called them to dispute the debt and they HAD THE LAST FOUR OF MY SOCIAL SECURITY NUMBER! I ran a credit check and none of the reports showed any delinquent or late payments. It did show an account with HSBC that was closed by the customer in  2006. My Credit Report indicated I have an "Excellent" credit rating.

I wrote Capital Management Services a letter and gave them the results of my search and asked them NOT to contact me by phone, send me verification of the debt, any judgment verification and information on the original creditor so I could resolve the dispute with them.

In the original letter they were "offering" to settle the debt with a 50% payment to be sent to their office. They have called several times (I did not answer). They have sent me another "offer" to settle the debt with a 40% payment. I have not received the information I requested in writing.

This is obviously a scam but I cannot afford to hire an attorney to settle it. Can anyone offer advise?

Hi -

Yesterday I found myself in your shoes, as outlined in your report and claims against this same company. My debt was charged off nearly 20 years ago, and these "BOTTOM FEEDERS" are trying to get me to send them money.

I've written NY Senators - Charles Schumer and Christine Gillibrand. - Come to find out - SENATOR GILLIBRAND's Buffalo District Office is located in the very same building as these people are - so they are operating right under her nose with these tactics and threats they are sending people like us.

May I suggest you contact both NY Senators, and reinforce what I've sent them, and with both of us bringing attention to this company, maybe we can help others from becoming victims.

 It seems to me that Capital Management is in deep trouble with N.Y. Attorney General's office I would suggest that you file a complaint with the attorney General demanding the copies of the orginal document bearing your signatures and all transaction receipts leading to the balance.  Additional provide the A.G office copies of all letters from them and letter you sent them. 

I would also file a Complaint with the Federal Trade Commission.  The more complaints the merrier.  Then they will investigate.

Now if the serve you.  You must answer.  Take the case to jury trial.  be careful and watch for sewer service.  This means that they get a judgment without serviing check your local clerk of courts for pending actions.  Do this weekly till resolved.

If you fall for the scam of "Settle for X percent', you acknowledge the debt is yours and restart the statute of limitations, don't Give them a single cent if you fall for this the statute of limitations restarts.

If they won't validate it's probably out of statute (4 Years is out in most states) and cannot be collected, it's a fraud.

Go to Budd Hibbs website for what to do next, they're the best out there

Don't be scared that they have a part of your SS, it's common knowledge and easily available.

If you don't remember making any such debt it's probably a stolen identity, or Far out of statute, past 3 years is usualy uncollectable (Google the State you live in to be sure.)

Past 7 years and it's a dead issue, many of these "Collectors" Buy very old debts out of statute and try to scare you into paying.

They CANNOT

1 Have you arrested

2 Garnish your pay (Lawsuit needed first) or have you thrown in jail (No debtors prison in the USA but they can and will lie their a*s off and threaten you, ignore them.

Send them a certified or registered letter Return receipt requested (Be sure to type the Registered number on the letter itself) and demand they only contact you in writing. and validate the supposed debt (Important to always say Supposed Debt)

they annot ignore it, and be sure to state that "Validation is NOT simply printing the ammount on a piece of paper, they MUST state the name of the original creditor and original date of debt. (Look for them to use a fake date to avoid the Statute of limitations)
