Capital One was sued in a class action after suing California customers in Virginia who had held their credit cards when Capitol One was Signet Bank. ( Yu vs. Signet ). After a court case filed in Alameda County, Capitol One agreed in a class action settlement to not sue anyone in California in perpetuity who had been a Signet Card holder in California & who had been sued in Virginia. The sueing of California residents was illegal under California's SLIPP laws.

After this case was settled & Capital One agree not to sue, they sued me anyway in Contra Costa County. I went to court but had no money to hire an attorney nor could I find one to take my case. This was in 2001. Capitol One sold the judgement to Eskanos & Adler & it has been subsequently sold to other collection agencies. I was forced to quit my job when Eskanos garnished my wages.

I now am receiving letters saying I owe $10,000 when I should have never been sued in the first place.

The law firm that sued Capitol One in the original class action has refused to assist me when I informed them that Capitol One violated the terms of their own setllement.

I will eventually be forced to declare bankruptcy over this matter for money I should never have owed.
