I attended a sales presentation at Capital Resorts in North Myrtle Beach, SC on December 20, 2014 and as a result purchased a trial travel package at a cost of $995 and was told I could vacation at the locations on the map posted at www.capitalresortsgroup.com.  I purchased the program because I wanted to travel the week after Christmas to Treasure Island Florida and there was a location listed there.  I was told my points would be available and if I paid half of the contract price I would be able to book almost immediately.  When I attempted to book the travel I was informed that I could not book at ANY of the locations in Florida because they were not open for booking yet.  I then asked to cancel my contract and was told to send a written request and Sherry Carpenter would process my request.  I never get a response so I call the company several times over the course of a week and get voicemail every time.  When I finally get a call back I am told that an email is being sent to the appropriate person to process my request.  This has been going on for several weeks and I have even called the local person Johnny Aces cell phone with no returned calls.  I am at a loss as to what to do when you purchase something and the company does not deliver or care enough to even return phone calls or emails. I see several similar reports on this site so I am hopeful that someone can help.

The grievance expressed here reflects a very common problem that continues to frustrate many timeshare owners. Often promises are made during the sales process verbally and in glossy literature touting the opulent surroundings and accommodations in exotic locations throughout the world. However, when you finally book and travel to whatever site may be available - if anything at all - you find yourself in something less appealing. The prices that you pay annually could easily have bought you a four star resort with unlimited resort destination options. When you complain about it to the resort developer, you are directed to read the fine print in the contract full of disclaimers and waivers that purport to justify this bait and switch.  What's worse, there doesn't seem to be any way out.

 

You owe it to yourself to obtain sound, competent legal representation by counsel with over twenty-five years experience in contract litigation. You will be made aware of your rights in addressing the situation with professionalism and integrity. In many cases we can obtain a legal rescission of the contract so as to get you out from under that oppressive lifelong timeshare obligation. At the very least, there often exist good faith legal grounds to warrant a formal dispute invoking federal consumer law to protect your credit with the national bureaus.
