Capitol Recovery contacted me in 2006 claiming that they could reclaim lost monies as a result of a HUD home loan. They claimed that if we paid them 28% of the monies owed, that they would contact HUD on our behalf to collect our refund. We supplied Capitol Recovery with all the necessary paperwork and information as they requested.

I did not hear anything back from Capitol recovery on our refund and did not recieve a refund. Concerned that we had been scammed, we continually checked our credit report to make sure no one had taken our information to commit identity theft.

Early this year in 2010 I contacted HUD to inquire if in fact there was a refund owed to us. HUD confirmed that there was a refund owed to us and explained what paperwork they needed to process the refund. We filled out the paperwork provided by HUD and had it notorized and returned it. A couple of weeks later we recieved our refund.

Two weeks after we recieved our refund Capitol Recovery sent us an invoice. I called them and explained that we owed them nothing as they had done nothing to assist in collecting our refund. I also explained that they had not even bothered to contact us with regards to the refund for almost 4 years. They claimed that this did not matter and that because we signed thier agreement in 2006 that we still owed the money even though they did not assist in the recovery. I in turn sent them a cease and desist letter and have sought out council. Once I sent the letter I recieved notice that I have now been turned over to a collection agency.

 

This is all happening over $400.00 that is not legally owed to this company.

 

Beware of this company as this process is a scam. In fact I don't even think they actually try to get the refund for thier victims. I assume they just get you to sign thier unenforcable agreement and then wait until YOU get your refund yourself then bill you for thier so called services.

 

These guys are dirty. If you recieve a letter in the mail from them, dispose of it immediately.
