I was so disappointed in the way Cedar Mountain Construction Inc. built my home at Table Rock Lake that I attempted to sell the property. The home failed an inspection by a certified inspector within a couple months of being built. Cedar Mountain Construction Inc. was paid to do a turn key job and said they offered a one year home warranty. I have tried to make this company respond but they will contact me back.

I have filed a complaint with the BBB, I have contacted the County Commisioners Office, I have contacted area realtors, I taken the advice of a Union Law firm investigator, I have hired to Attorneys to communicate my demands to this company and I have contacted and filed a complaint with the Attorney General's Office of Missouri for consumer fraud. No one seems to be capable of making a difference or they just are not interested in following through. Even the Attorney General's Office hasn't done anything noteworthy in eight months since I first contacted them.

I have included a copy of my first attempt letter to Cedar Mountain Construction for your review.

There more issues than these items listed below.

Cedar Mountain Construction Inc. answer seems to be not to respond at all the problem will go away sooner or later. As the General contractor of my home Cedar Mountain Contruction Inc. either ignored their resposibility to me with their sub contractors or they told them to make short cuts. Either way I'm on the hook for a home I can not be satisfied with.

I first sent this letter to Cedar Mountain Construction 08/01/05 and still I have not received one single response from them and only one response from an Attorney they contacted after several months of my efforts to resolve these issues.

As you are aware I have decide to sell my home, the home that you were responsible for building at ------ , Ridgedale, Mo.65739.

The home was inspected by a certified inspector in your area at the request of the buyer and failed the inspection for these reasons;

1. Post 911 address on front of house.

2. Provide switch at bottom of stairs and top for light.

3. Dishwasher hose shall a trap for back siphon age.

4. Garbage Disposal outlet is missing cover and cabinet backer board shall be trimmed to the outer edge of the of the receptacle and covered.

5. All outlets that serve Kitchen Counter shall be GFCI protected.

6. Range Outlet shall be secured in place and the Manufactures Anti-Tip device shall be installed on the range leg.

7. Island Peninsular Kitchen Counter is 57" long and shall be served with one GFCI outlet.

8. Chain length light shall be grounded.

9. All sleeping rooms/ bedrooms shall have interconnected smoke detectors and all outlets ARE- Fault Breakers.

10. Inspector needs to gain access to Attic space, Attic area access can not be removed.

11. Deck spindles or pickets shall have a Maximum spacing of 4" opening 1st and 2nd floor.

12. Lap siding has spacing where it over laps.

13. Window at winder stairway shall be safety glazed tempered glass, may need to check with manufacture.

14. Exposed electrical circuit in crawl space running to nothing, just laying on the ground.

15. Tighten down all nuts on anchor bolts thru out the crawl space.

16. There shall be 1-8"x12" crawl space vent for ventilation at all corners of the crawl space area and one for each 1500 ft of crawl space area.

17. Provide full bearing from main girder support area at front of foundation wall to 8" concrete

column.

18. Toe nail all I-Joist to sill plate or install per manufactures spec's.

19. Seal all penetrations in floor to habitable space and insulate at tub drains.

20. Provide nut on anchor bolt NW corner crawl space, missing Anchor bolt NW corner crawl space.

21. Deck Joist are over 8', they shall have hangers or pressure blocks on outside of header.

22. Seal hole in stem wall in crawl space, looks like sewer was going to run thru.

23. Phone line is coiled up at siding, shall be connected. Cable line also in same condition.

24. Need to check with Truss Joist company to approve deck being attached to house rim joist perimeter.

25. Exterior lights shall be tighten down and water tight, may also have to caulk.

26. Check with truss manufacture for lateral bridging.

27. List subject to change after attic inspection.

28. I-Joist shall be nailed to girder beams with a minimum of 3 nails, 10D nails.

29. Electrical panel directory is labeled wrong.

Because of these reasons I lost the sale of the home to a qualified buyer who lives in your area, the buyer lost confidence in the home and with you as the builder. The buyer had plans to expand the home and was considering contracting you to do the work so we both lost out. You need to make arrangements with me to correct these problems.

You still have items to finish or repair on the list I gave Debbie and I have discovered other items since.

I will be in contact with an attorney if you can not or will not correct these issues.

You will be receiving a copy of the inspection report via fax within the next few minutes.

I have included a copy to our Realtor for verification reasons.

BEWARE OF DEALING WITH CEDAR MOUNTAIN CONSTRUCTION INC. CEDAR MOUNTAIN CONSTRUCTION INC., 140 MULBERY LANE, RIDGEDALE, MO. 65739. PRESIDENT ERIC SMITH; THE COMPANY IS NOW APPARENTLY PRESENTLY UNDER THE DIRECTION OF DEBBIE SMITH. THIS COMPANY IS RESPONSIBLE FOR BUILDING OUR HOME ON TABLE ROCK LAKE IN THE OAKMOUNT SUBDIVISION. THEY FAILED OUR EXPECTATIONS IN EVERY WAY POSSIBLE, THEY DID NOT EXECUTE THE BUILDING OF OUR HOME PLAN PROPERLY AND NOW THEY WILL NOT HONOR THE HOME WARRANTY. DEALING WITH CEDAR MOUTAIN CONSTRUCTION INC. COULD BE YOUR MOST COSTLY MISTAKE. THIS COMPANIES FAILURE TO RESPOND HAS FORCED ME TO FILE A COMPLAINT WITH THE BBB OF SOURTHERN MISSOURI AND TO FILE A FRAUD COMPLAINT WITH MISSOURI ATTORNEY GENERAL JERIMIAH (JAY) NIXON. DON'T ALLOW THIS COMPANIES MISTAKES TO BE YOUR NIGHTMARE, AVOID DEALING WITH CEDAR MOUNTAIN CONSTRUCTION INC. I would like to add. The States Attorney General's Office of Missouri has not followed through on the complaint filed with their office. eights months ago. Missouri Attorney General Jerimiah (Jay) Nixon. Taney County Comissioners Office did nothing to assist. Beware of dealing with them because they have stated they don't care if the builder was to have built my home on beer cans. The Attorneys hired to take action against this company did not do anything more than send the letter I drafted against this company, or just used it as reference. The BBB of Southwest Misouri in the Greater Ozarks would not update their report, even though the copmpany I filed a complaint against is not a member of the BBB and the same company(Cedar Mountain Construction) failed to respond to their request for comment about the complaint.
