i have a 2 year contract with cingular. my cell phone is broken and has been broken 3 times. the last time they state they don't work on this phone any more and they will not replace it with another phone equal to the phone i have . the only way is for me to upgrade and sign a new 2 year contract. my contract is up in 7/05.

if i upgrade it is at least 200.00 and i don't feel i need to do this. i am paying 50.00 a month for this phone i can't use. cingular states it will only replace the phone up to 1 year, but they make you sign a 2 year contract.

i just don't feel this is a good customer practice and is a fair one..

if you could advise me of any recourse with this company.

First, Cingular does not "make" you sign a two year contract. The two year contract alows you to get the phone a reduced rate. We also have one year and no commitment pricing on the equipment. So, by taking the cheap route, you penalized yourself. Cingular does not have or imply any warranty on the equipment. We honor the manufacturer's warranty, and act as an intermediatary to facilitate getting phones repaired. We also recommend the insurance program as well. Furthermore, doing the exception upgrade, the phones will start at 69.99, not the 200.00 you claim. It is obvious you are confused as to what you heard and what you wanted to hear. Second, the two year contract was for service, not on the phone. The service is still there waiting to be used when you get a new phone.
